A RESOLUTION DECLARING THE ANNEXATION
OF 23 ACRES OF LAND LOCATED ON THE SOUTH SIDE OF UPTON ROAD,
NORTH OF BEAR CREEK AND EAST OF INTERSTATE-5 INTO
THE CITY OF CENTRAL POINT, OREGON

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT,
OREGON, AS FOLLOWS:
Section 1. Application has been made by the owners of certain real property for annexation
into the City of Central Point, Oregon. The property consists of one tax lot consisting of a total of
23 acres. The property to be annexed is more particularly described as follows:
Assessor's Map P7o. 362W35 Tax Lot 2200, as described in Instrument
No. 77-26649, inniuding aii of the right of way adjacent to said
parcel.
Commencing at the southeast corner of Donation Land Claim No. 56 in
Section 35 in 'Township 36 South, Range 2 West of the Willamette
Meridian in Jackson County, Oregon; thence West 176.2 feet to the
POINT OF DEGINNING on the east line of said Government Lot 5 of
Section 35 in Township 36 South, Range 2 West of the Willamette
Meridian in Jackson County, thence South, 840.00 feet; thence North
51°20' West, 432.24 feet; thence South 88°09' West, 154.1 feet; thence
South 65°28' -West 226.4 feet; thence North 81°22'20" West, 154.52
feet; thence North 67°00' West, 396.0 feet; thence North 51°54' West,
162.36 feet; thence South 84°38' West, 246.0 feet; thence South 49°06'
West, 119.1 feet; thence North 85°16' West, 560.0 feet, more or less,
to the center line of the relocated Upton Road, as said center line
is described in Volume 519, Page 111 of the Deed Records of said
county and state; thence continuing North 85°16' West, 50.0 feet more
or less to the northwesterly right of way line of said road; thence
along the westerly and northerly right of way line of Re-located and
Old Upton Road to a,.point, said,..point being North 30 feet of a point
being West, 396.2 feet of said Donation Lind Corner; thence South 30
feet to the POINT OF BEGINNING.
The above -described property is not within the City of Central Point's Current corporate
boundaries, but is contiguous to the City's existing corporate boundary and is within the
Central Point Urban Growth Boundary (UGB).
Section 2. The owners of the property proposed for annexation is Jackson County
School District #6, and there is mutual consent to the annexation. Such written consent is on
file at Central Point City Hall, 155 South Second Street, Central Point, Oregon.
Section 3.ORS 222.125 provides that when all of the owners of land in the territory
proposed for annexation and not less than 50% of the electors residing in such. territory have
consented in writing to the annexation of the land in the territory and file such written consent
with the City Council, the property may be annexed without the requirement for an election
or a public hearing.
Section 4. Annexation of the described property is consistent with the City's ability
to provide facilities and services to the real property, as required by the City's Comprehensive
Plan.
Section 5. Pursuant to ORS 222.125, the property described in Section 1 above, shall
be and hereby is, annexed to and made part of the City of Central Point, Oregon..
Section 6. The City Administrator, or his designee,. shall transmit a copy of this
resolution to the Oregon Secretary of State, and this annexation shall be effective when filed
with the Oregon Secretary of State pursuant to ORS. 222.180.
Passed by the Council and signed by me in authentication of its passage this day of July,
2001.
