RESOLUTION APPROVING MINOR LAND PARTITION
(Clayton D. Zeeb, Applicant)
WHEREAS, Clayton D. Zeeb has submitted an application for a
minor land partition on property consisting of a 7.25 acre parcel
situated at 1000 N. Pacific Highway (Highway 99 ), Central Point,
Oregon, described in the Jackson County Assessor's records as 37
2W 3B TL 1500, and
WHEREAS, the Planning Commission of the City on the 2nd day
of October, 1990, by Planning Commission Resolution No. 209
recommended approval thereof with conditions as set forth
therein, and
WHEREAS, a public hearing was held thereon by the Central
Point City Council on the 18th day of October, 1990, at which
time the Council received the staff report, Planning Commission
report and evidence thereon, and the Council being fully advised,
now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL
POINT AS FOLLOWS:
Section 1. The Council finds as follows:
A. That. the application complies with the requirements
of Municipal Code Section 16.44.030.
B. That the application does not involve the creation
of a road or street. and is therefore a minor partition.
C. That no flag lot. is created or, if a flag lot is
created, the same complies with the terms of Municipal Code
Section 16.44.050.
D. No variances are required herein.
E. Applicant has submitted a plat of the proposed
partition suitable for recording with the. Jackson County
recording officer, together with all necessary and appropriate
fees for recordation thereof.
F. As submitted, subject to the conditions set forth
hereinafter, said application conforms to the requirements of the
Central Point Municipal Code.
Section 2. The. application for minor land partition of
applicant Clayton D. Zeeb is hereby approved, subject to the
conditions set forth in Exhibit A, attached hereto and by this
reference expressly made a part of the within resolution..

Minor Land Partition
1. Any improvements made to Parcel 2 which requires a building permit shall
require the conditions below to be completed.
2. If Parcel 1 is not constructed as approved by the site plan for the Oregon State
Police Facility, then Parcel 1 would also be subject to Condition 1. above.
3. Highway 99 shall be widened to accommodate a 60 ft. street section according
to the requirements of the oregon State Highway Department. The widening
improvements shall include paving with asphaltic concrete, curbs and gutters,
sidewalks, street lighting, and storm drainage. Highway 99 shall be designed
based on the strength of the soil fora 20 year life, 20,000 vt/d and 20%
trucks.
Applicant, owner, or assignee may defer making this aforementioned street
improvements until such time as applicant, owner or assignee constructs the
Oregon State Police Facility as authorized by Conditional Use Permit granted.
by the Central Point Planning Commission, via Resolution No. 1.84 on February
9, 1990 or until such time as any other construction or improvements are made
upon either of the parcels created under the Partition, whichever may occur
first.
Such deferral shall. be by execution of a Deferred: Improvement Agreement
which shall be recorded. and the obligation. of which shall. run with the land.
4. Parcel 2 shall provide 15 ft. storm drainage and sanitary sewer easements to
Parcel 1 to provide access across each property.
5. A street lighting plan shall be included in the construction documents according
to the requirements of the Public Works Director. All ingress/egress locations
shall be illuminated. Developer to install all pads and conduits for street lights
as a part of the construction. of this project. The developer shall also pay for
street lights and' the installation of all. street lights by PP&L.

6. The developer shall install or cause to be installed, conduits for utilities at
intersections or locations determined by utility companies and utility companies
who will not install their services until after this project is constructed. The
developer shall be responsible for all costs associated with the installation. of
these conduit crossings.
All utility construction (i.e. power, telephone, gas, cable t.v.) shall be
constructed according to the requirements of the governing utility and the
franchise agreements with the City for each utility.
7. This development shall not impact the 100 year flood capacity of Griffin Greek
or the Scenic Avenue bridge. If improvements are required, they shall be done
according to the plans completed by Developer's engineer and approved' by the
Central Point Public Works Department.
8. Developer shall design the storm drainage system to provide for discharge of
properties in future phases or within the drainage service area of this project's
storm drainage system.
On site storm drainage shall be designed to handle a 10 year storm runoff.
9. According to CPMC 8.24 and 8.28, the owner of the property adjacent to a
1.00 year flood plain or a drainage channel is required to maintain their portion
of the channel free from obstructions that would affect the 100 year flood
elevation or block flow in the channel. The developer shall provide access to
Griffin Creek a minimum of 15 ft. for equipment to maintain the Griffin Creek
channel. Alf maintenance of Griffin Creek Channel is the responsibility of the
property owner.
