HomeMy WebLinkAboutCouncil Resolution 507RESOLUTION K0. 507 A RESOLUTION SUPPORTING THE EFFORTS OF JACKSON COUNTY TO RETASN PUBLIC OWNERSHIP OF PROPERTY WITHIN Tf~ BEAR CREEK GREENWAY WHEREAS, the City of Central Point has been made awaze of the possible sale of property within the Beaz Creek Greenway by the Oregon Department of Trans- portation; and WHEREAS, the City has supported the efforts of the Bear Creek Greenway Committee to preserve the wildlife and floodplain chazacteristics of this unique community asset; and WHEREAS, the City's Comprehensive Plan contains a goal "to acquire lands along Bear Creek to preserve the natural environment of the floodplain and to protect the recreational, scenic and historic aspects of the creek; NOW, THEREFORE, Be it resolved by the City of Central Point, Oregon that the City of Central. Point reaffirms its committment to the goals of the Bear Creek Greenway project; and THAT, the City of Central Point supports Jackson County in its negotia- tions with the Oregon Depaztment of Transportation to retain public ownership of Bear Creek Greenway lands. This tax lot is part of the Bear Creek Greenway and included in the county's adopted plan. It is imperative to retain this valuable riparian area. ODOT has proposed selling the easterly portion (right bank) of tax lot 400 to Mr. Beebe, an adjacent property owner. Mr. Beebe apparently would like to control this creek bank for security reasons. However, I strongly urge retaining the entire parcel in public ownership to protect the integrity of the stream and to meet the long. range goal of protecting wildlife habitat on both banks of Bear Creek through the basin. Greenway lands are set aside for open space purposes in perpetuity, private ownerships will change. In addition, when Pine Street is widened, the creek channel must be pro- tected above and below the bridge. If excessive vegetation is removed, serious erosion problems could occur and a channel change during high water periods. is not out of the question. Finally, ODOT will need to utilize some of their riparian properties for the purpose of mitigation when they take lands needed for highway projects in the county such as the extension of Hwy. 140 and the widening of Pine Street. Tax lot 400 is an example of a property that would fulfill mitigation require- ments. It has been recommended that our office meet caith P4r. Beebe to discuss the situation and cae will follow up on that suggestion. Jackson County has worked hard and spent considerable local and federal money to preserve the floodplain along Bear Creek in the Central Point vicinity. I feel it is in the best interests of the citizens of your community and Jackson County to continue this endeavor. I strongly recommend that we encourage the ODOT to retain all of tax lot 400 for the purposes outlined in the adopted Greenway plan.
