A RESOLUTION DECLARING THE ANNEXATION OF A 13.74-ACRE
PARCEL OF LAND LOCATED IN THE NORTH TENTH STREET,
UPTON ROAD AND I-5 AREA INTO THE CITY OF CENTRAL POINT, OREGON
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL
POINT, OREGON, AS FOLLOWS:
Section 1. The following-described real property located at
the intersection of North Tenth Street and Upton Road is not
within the corporate boundaries of the City of Central Point, but
is contiguous thereto and is within the City's Urban Growth
Boundary:
a~fc3~NNING at a point far the most Westerly Southwest corner of
PINECREST SUBDIVISION to the City of Central Point, Jackson County,
Oregon, according to the Official Plat thereof, now of record, said
paint being on the current City of Central Point boundary; thence
North 41° 58' 4?" West, along the Northeasterly right-of-way line
of North Tenth Street and said CXty boundary, 1064.88 feet to the
point of intersection of the Northeasterly right-of-way line of
North Tenth Street and the Easterly right-of-way l~.ne of. Upton
Road; thence continue North 41° 58' 47" West, along said city
boundary, 53.06 feet to a point on the centerline of Upton Road;
thence, leaving said City boundary, along the centerline of Upton
Road, NORTH ].95.33 feet; thence South 88 ° 56' 00" West ~ . 36 feet to
a point of spiral; thence along the chord of a spiral curve to the
right, North 02° 1.6' 00" East 249.66 feet; thence along the arc of
a 716,198 foot radius curve to the right (the long chord to which
bears North 16° 40' S9" East 193.16 feet) an arc distance of 193.75
feet; thence along the chord of a spiral curve to the right, North
31° 06' 00" East 12.64 feet to a point 150.00 feet Southwesterly
of, when measured at right angles to, the centerline of interstate
Highway No. 5; thence South 45° 00' 50" East 93.05 feet to the
point oP intersection of the Southwesterly right-c,f~way line of
Interstate Highway No. 5 and the Southeasterly right -ot-way line of
Upton fioad; thence continue South 45° 00' 50" East, along the said
right-vf-way ~.ine of Interstate Highway Na. 5, a distance of 701.69
feet to a point an the boundary of the aforementioned PxNECREST
SUBDIVISION, sa~.d point being on the current City of Central Point
boundary; thence along said boundaries South 89° 52' QO" West 46.51
feet; thence South 06° O1' 05" East 1009.47 feet to the Point of
Beginning. Containing 13.74 acres, more or less,

Section 2. The owners of the property described above are
as follows: Wayne Christian Corporation Profit Sharing Plan and
Trust, Wayne Christian, Trustee; Gerald A. Schatz Pension Trust,
Gerald A. Schatz, Trustee; Patrick G. Huycke Money Purchase
Pension and Profit Sharing Plans, Patrick G. Huycke, Trustee; and
Lathrop Living Trust, Ernest J. Lathrop, Trustee. There are no
electors residing an the property other than Ernest J. Lathrop.
All of the owners and Mr. Lathrop have consented in writing to
the annexation of the subject property, and such written
statements of consent are on file with the City.
Section 3. Pursuant to ORS 222.125, the real property
described in Section 1 above shall be, and hereby is, annexed to,
and made a part of, the City of Central Point, Oregon.
Section 4. The City Administrator, or his designee, shall
.transmit a copy of this resolution to .the Oregon Secr~etary.of

State, and this annexation shall be effective as of the"date'`of ~ ~`~
+ filing with the Secretary of State, pursuant to ORS 222.180.
