RESOLUTION NO. ~~ A~RESOLUTION APPROVING AN AMENDMENT TO THE CENTRAL POINT COMPREHENSIVE PLAN MAP AND ZONING MAP (37 2W 03AA Tax Lots 4000 and 4100) (Applicant: Wayne Christian Corporation Profit Sharing Plan and Trust, et al) Recitals 1. This matter came before the City on applications for an .amendment to the City's Comprehensive Plan Map and Zoning Map, seeking to change the designation on the Comprehensive Plan Map .from Neighborhood Convenience Center Commercial to Low Density Residential and the Zoning Map designation from C-N, Neighborhood Commercial District, to R-1-8, Residential Single-Family-. 2. On August 6, 1996, the Central Point Planning Commission conducted a review of the applications, and recommended approval. 3. On October 3, 1996, the Central Point City Council -conducted a duly-noticed and advertised public hearing on the applications. The Council reviewed the written materials submitted by the applicant, City staff reports, and heard testimony from all persons wishing to be heard. Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Nature of Application. This matter consists of two applications, one for an amendment to the Comprehensive Plan Map and the other for an amendment to the Zoning Map, seeking to re-designate 13.74 acres of land in the city from the present Comprehensive Plan Map designation of Neighborhood Convenience Center Commercial to Low Density Residential, and the Zoning Map .designatipon_from C-N, Neighborhood Commercial, to R-1-8, Residential Siigl'e-Farmly. Section 2. Approval Criteria. In order for an amendment to the Comprehensive Plan to be approved, Central Point Municipal Code Section 17.96.050 requires an applicant to establish that: A. There is a public need and justification for the change; and B. The proposed amendment is consistent with all applicable statewide planning goals. 1 - RESOLUTION NO. ~[L (093096) :: ,.. ~i Section 3. Findings and Conclusions. A. The City Council hereby adopts by reference the findings and conclusions contained in applicant's submitted ~~Findings of Fact and Conclusions of Law~~ received on May 29, 1996, as well as the findings contained in the City staff report dated August 6, 1996, placed in the record, all of which are by this reference incorporated herein. B. The Council finds that applicant has established the public need and justification for the proposed amendments, and further finds that the amendments are consistent with all applicable statewide planning goals. Section 4. Approval. The within applications are approved. The Central Point Comprehensive Plan Map and Zoning Map shall be amended so that the properties located at Township 37, Range 2W, Section 03AA, Tax Lots 4000 and 4100 shall hereafter be designated on the Comprehensive Plan Map as Low Density Residential, and on the Zoning Map. as R-1-8, Residential,,Single-. - .
