HomeMy WebLinkAboutCouncil Resolution 773°i` r RESOLUTION NO. 7 3 A RESOLUTION APPROVING AN AMENDMENT TO THE CENTRAL POINT ZONING MAP (37 2W lOC Tax Lots 4800, 4801, 4803 and 4804) (Applicant: Wayne Christian, for Vincent and Kathy Mendolia) Recitals 1. This matter came before the City on an application for an amendment to the City's Zoning Map, seeking to change the designation on the Zoning Map from R-1-10, Residential Single- Family, to R-1-8, Residential Single-Family. 2,. On September 3, 1996, the Central Point Planning - Commission conducted a review of the application, and recommended 'approval. 3. On October 3, 1996, the Central Point City Council conducted a duly-noticed and advertised public hearing on the applications. The Council reviewed the written materials submitted by the applicant, City staff reports, and heard testimony from all persons wishing to be heard. Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Nature of Application. This matter consists of an application for an amendment to the Zoning Map, seeking to re- designate 12.04 acres of land in the city from the present Zoning Map designation of R-1-10, Residential Single-Family, to R-1-8, Residential Single-Family. Section 2. Agproval Criteria. In order for an amendment to the Comprehensive Plan to be approved, Central Point Municipal Code.Section 17.96.050 requires an applicant to establish that: A. There is a public need and justification for the change; and B. The proposed amendment is consistent with all applicable statewide planning goals. Section 3. Findings and Conclusions. A. The City Council hereby adopts by reference the findings and conclusions contained in applicant's submitted "Findings of Fact and Conclusions of 1 - RESOLUTION NO. 773 (110896) ~_ _ . Law~~, as well as the findings contained in the City staff report dated September 3, 1996, placed in the record, all of which are by this reference incorporated herein. B. .The Council finds that applicant has established the public need and justification for the proposed amendments, and further finds that the amendments are consistent with all applicable statewide planning goals. Section 4. Approval. The within applications are conditionally approved. 'The Central Point Zoning Map shall be amended so that the properties located at Township 37, Range 2W, Section lOC, Tax Lots 4800, 4801, 4803, and 4804 shall hereafter be designated on the Zoning Map as R-1-8, Residential Single- Family, subject to the following condition: any future subdivision development on the properties shall be limited to a maximum of 40 lots.
