HomeMy WebLinkAboutCouncil Resolution 777 RESOLUTION NO. 777- A RESOLUTION DENYING AN APPLICATION FOR A PLANNED UNIT DEVELOPMENT (Applicant: Gloria Dei Lutheran Church) (37 2W 03AD Tax Lot 4700) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Nature of Application and Procedural Background. This matter came before the City on applicant's Planned Unit Development ("PUD" hereafter) application for a 16-unit senior citizen housing project, to be called Living Waters Senior Housing, located on the site of the Gloria Dei Lutheran Church at 745 North Tenth Street, Central Point, Oregon, in an R-1-6 district of the City. On November 5, 1996, the Central Point Planning Commission held a duly-advertised public hearing wherein it considered the application, the City staff reports, and written comments and testimony from all interested persons in favor of and opposed to the application. The Planning Commission conditionally approved the PUD application. The Planning Commission's approval was subsequently appealed to the City Council. A public hearing was scheduled for December 5, 1996, and was continued until December 19, 1996, at 7:OO p,m. At that time, the City Council received the staff report, and considered oral and written testimony from all interested persons in favor of and opposed to the application. Section 2. Criteria Applicable to Decision. The following chapters of the Central Point Municipal Code apply to this application: (A) Chapter 1.24, Public Hearings Procedures; (B) Chapter 17.20, R-1, Residential, Single-Family District; (C) Chapter 17.60, General Regulations; (D) Chapter 17.64, Off-Street Parking and Loading; and (E) Chapter 17.68, Planned Unit Developments (PUD). Section 3. Findings and Conclusions. The within PUD application is denied for failure to meet the following criteria set forth in CPMC 17.68.040: _"B. The proposal will be consistent with the Comprehensive Plan, the objectives of the zoning ordinance and other applicable policies of the City; 1 - RESOLUTION NO. 777 (123096) "C. The location, size, design and operating characteristics of the PUD will have minimal adverse impact on the livability, value or appropriate development of the `..surrounding area; "I. The PUD will be compatible with the surrounding area." The proposed PUD would be located in an R-1-6 zoning district. The surrounding neighborhood consists of single family residential housing. The City Council finds and concludes that the proposal for 16 units contained in 6 multi-family structures is not compatible with the surrounding neighborhood of single- ... family residential structures. The R-1-6 zoning designation contemplates single-family residential structures, and the City Council finds that the proposed PUD will not be compatible with the surrounding area and would have more than minimal adverse impact on the livability and value of the surrounding area. ~_ -Passed by the Council and signed by me in authentication of its. passage this 7th day of January. 1997.
