HomeMy WebLinkAboutCouncil Resolution 938RESOLUTION N0. a~ A RESOLUTION APPROVING AN AMENDMENT TO THE CENTRAL POINT ZONING MAP (37 2W 11C Tax Lot 9500 - 20.5 Acres) (Applicant: Michael Montero) Recitals 1. This matter came before the City on an application for an amendment to the City's Zoning Map, seeking to change the designation on the Zoning Map from R-1, Residential Single-Family and TOD Corridor - MMR, Medium Mix Residential (overlay) to TOD Corridor - LMR, Low Mix Residential, with portions along the southerly and easterly boundaries of the property changed to TOD-EC, Employment Commercial, and C-4, Tourist and Office Professional District as per the application. Applicants are also requesting that approximately one acre be re-zoned to TOD Corridor - OS, Open Space. 2. On February 5, 2002, the Central Point Planning Commission conducted a review of the application, and recommended approval. 3. On March 28, 2002, the Central Point City Council conducted a duly-noticed and advertised public hearing ozi the applications. The Council reviewed the written materials submitted by the applicant, City staff reports, and heard testimony from all persons wishing to be heard. Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1 Nature of Application. This matter consists of an application for an amendment to the Zoning Map, seeking to re- designate 20.5 acres of land in the city from the present Zoning i~iap deSlgiidtiCii of R-1, Re62dentlal Single_Fami_1y and. TOD Corridor - MMR, Medium Mix Residential (overlay) to TOD Corridor - LMR, Low Mix Residential, with portions along the southerly and easterly boundaries of the property changed to TOD-EC, Employment Commercial, and C-4, Tourist and Office Professional District as per the application. Applicants are also requesting that approximately one acre be re-zoned to TOD Corridor - OS, Open Space. 1 - RESOLUTION NO. nl~,~ (032102) Section 2. Approval Criteria. In order for an amendment to the Comprehensive Plan to be approved, Central Point Municipal Code Section 17.96.050 requires an applicant to establish that: A. There is a public need and justification for the change; and B. The proposed amendment is consistent with all applicable statewide planning goals. Section 3. Findings and Conclusions. A. The City Council hereby adopts by reference the findings and conclusions contained in applicant's submitted "Findings of Fact and Conclusions of Law", as well as the findings contained in the City staff report dated March 28, 2002, placed in the record, all of which are by this reference incorporated herein. B. Section 4. Approval. The within applications are approved. The Central Point Zoning Map shall be amended so that the properties located at Township 37, Range 2W, Section 11C, Tax Lot 9500, shall hereafter be designated on the Zoning Map as TOD Corridor - LMR, Low Mix Residential, with portions along the southerly and easterly boundaries of the property changed to TOD-EC, Employment Commercial, and C-4, Tourist and Office Professional District; approximately one acre is re-zoned to TOD Corridor - OS, Open Space, all as shown on the application and maps.
