HomeMy WebLinkAboutCouncil Resolution 937RESOLUTION NO ~ 3~7 A RESOLUTION DECLARING THE ANNEXATION OF 9.85 ACRES OF LAND LOCATED ON THE EAST SIDE OF HAMRICK ROAD, AND THE SOUTH SIDE OF WEST VILAS ROAD INTO THE CITY OF CENTRAL POINT, OREGON Applicant: Central Point Lodge #135 (37 2W O1BB; TL 1100) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Application has been made by the owners of certain real property for annexation into the City of Central Point, Oregon. The property consists of one tax lot and sections of road right-of--way consisting of a total of 9.85 acres. The property to be annexed is more particularly described as follows: BF,GINNING at a point for ttte Northwest comer of Patcel No. 1 of Partition Plat recorded June 4, 1998 as Partition Plat No. P-34-1998 of "Record of Partition Plats" in Jackson County, Oregon, and filed as Survey No. 15762 in the office of the Jackson County Surveyor, said point being on the Southeasterly right-of--way line of Hanuick' Road; thence South 00°15'30" West along fire Westerly boundary of said Parcel No. 1, a distance of 672.82 feet to a point for the Southwest comei of said Parcel No. 1, said point also being the Northwest corner of CENTRAL POINT EAST DEVELOPMENT', PHASE 7, according to the Otficiat Plat thereof, now of record in said Jackson County; thence continue South 00°15'30" West along the Westerly boundarybf said subdivision, 395.96 feet to the Northeast corner of Lot 197 of said subdivision; thence Soutlt 89,°44'10" West along the boundary of said subdivision 284.41 feet to fire Northeast corner of CENTRAL POINT EAST SUBDIVISION; PHASE•4, according to the Official Plat thereof, now of record in laid Jackson County; thence continue South 89°44'10" West along the Northerly boundary of said subdivision 218.74 feet to the Northwest corner of Lot 96 of said subdivision; thence continue South 89°44'10" West 50.00 feet to a point on the centerline of Ilamrick Road; thence along said centerline North 00°13'55" West 226.21 feet; tftence along the arc of a 573.00 foot radius curve to the right (the long chord to which bears North 19°27'15" Easf 356.05 feet) an arc distance of 393.75 feet; thence North 39°,08'24" Past 748.32 feet; thence along the arc of a 573.00 foot radius curve to the riglrt (tlte long chord to which bears North 40°33'55" East 28.50 feet) an ate distance of 28.51 feet to a point which bears South 60°39' 10" East 73.29 feet front the most-Southerly corner of Lot 15 of NEW HAVEN ESTATES, PIIASE 1, according to the Official plat thereof, vow of record hi said Jackson County; thence leaving said centerline, South 60°39'10" East 30.79 feet {o a point on the aforementioned Southeasterly riglrt-of--way line of Hamrick Road; thence along said riglit-of--way line along the arc of a 543.00 foot radius curve to the left (the long chord to whicli Dears South 40°55' 14" West 33.75 feet) an arc distance of 33.75 feet; thence continue along said right-of--way line South 39°08'24" West 103.29 feet to the POINT OF BEGINNING. Containing 9.85 acres, more or Icss. The above -described property is not within the City of Central Point's Current corporate boundaries, but is contiguous to the City's existing corporate boundary and is within the Central Point Urban Growth Boundary (UGB). Section 2. The ownerofthe propertyproposed for annexation is Boise Cascade Coq oration, and there is mutual consent to the annexation. Such written consent is on file at Central Point City Hall, 155 South Second Street, Central Point, Oregon. Section 3.ORS 222.125 provides that when all ofthe owners of land in the territory proposed for annexation and not less than 50% of the electors residing in such territory have consented in writing to the annexation of the land in the territory and file such written consent with the City Council, the property maybe annexed without the requirement for an election or a public hearing. Section 4. Annexation of the described property is consistent with the City's ability to provide facilities and services to the real property, as required by the City's Comprehensive Plan. Section 5. Pursuant to ORS 222.125, the property described in Section 1 above, shall be and hereby is, annexed to and made part of the City of Central Point, Oregon. Section 6. The City Administrator, or his designee, shall transmit a copy of this resolution to the Oregon Secretary of State, and this annexation shall be effective when filed with the Oregon Secretary of State pursuant to ORS. 222.180.
