HomeMy WebLinkAboutCouncil Resolution 933RESOLUTION NO -`3_~ A RESOLUTION DECLARING THE ANNEXATION OF 6.95 ACRES OF LAND LOCATED ON THE NORTH SIDE OF BEEBE ROAD, AND THE WEST SIDE HAMRICK ROAD INTO THE CITY OF CENTRAL POINT, OREGON (Applicant(s): Shepherd of the Valley Catholic Church and Five D's LLC) (37 2W 1 B; TL 3900 & 4000) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Application has been made by the owners of certain real property for annexation into the City of Central Point, Oregon. The property consists of two tax lots and a section of road right-of--way consisting of a total of 6.95 acres. The property to be annexed is more particularly described as follows: Commencing at the Northeast corner of Donation Land Claim No. 55 in Township 37 South, Range 2 West of the Willamette Meridian in Jackson County, Oregon; thence South 0°10'20" East along the boundary of said claim, 650.80 feet to the POINT OF BEGINNING of the tract to be described, said point being the Southeast corner of the tract described in Volume 403, Page 218, Jackson County Deed Records; thence EAST along the easterly prolongation of the southerly boundary of said tract a distance of 26.72 feet to a point on the Easterly right of way line of Hamrick Road, said point being on the current City of Central Point boundary; thence South 0°16'00" East along said right of way and said City boundary, a distance of 282.87 feet to a point on the Easterly prolongation of the Northerly boundary of the tract described in Volume 445, Page 503 said deed records; thence South 89°27'00" West, leaving said easterly right of way line and said City boundary along said prolongation 27.19 feet to the Northeast corner of said tract; thence continue South 89°27'00" West along the Northerly boundary of said tract and the westerly prolongation thereof, a distance of 334.55 feet to a 3/< inch iron pin; thence South 0°55'00" East 292.89 feet to the centerline of Beebe Road; thence South 89°33'00" West along said centerline 347.66 feet; thence leaving said centerline North 0°03'00" West 581.92 feet to a 3/< inch iron pin; thence East 181.00 feet to the Southwest corner of the aforementioned tract described in Volume 403, Page 218 said deed records; thence continue East along the southerly boundary of said tract 496.30 feet to the POINT OF BEGINNING. Containing 6.95 acres more or less. The above -described property is not within the City of Central Point's Cun~ent corporate boundaries, but is contiguous to the City's existing corporate boundary and is within the Central Point Urban Growth Boundary (UGB). Section 2. The owner of the property proposed for annexation is Five D's, LLC, and there is mutual consent to the annexation. Such written consent is on file at Central Point City Hall, 155 South Second Street, Central Point, Oregon. Section 3.ORS 222.125 provides that when all of the owners of land in the territory proposed for annexation and not less than 50% of the electors residing in such territory have consented in writing to the annexation of the land in the territory and file such written consent with the City Council, the property maybe annexed without the requirement for an election or a public hearing. Section 4. Annexation of the described property is consistent with the City's ability to provide facilities and services to the real property, as required by the City's Comprehensive Plan. Section 5. Pursuant to ORS 222.125, the property described in Section 1 above, shall be and hereby is, annexed to and made part of the City of Central Point, Oregon. Section 6. The City Administrator, or his designee, shall transmit a copy of this resolution to the Oregon Secretary of State, and this annexation shall be effective when filed with the Oregon Secretary of State pursuant to ORS. 222.180.
