HomeMy WebLinkAboutCouncil Resolution 930RESOLUTION NO~ A RESOLUTION DECLARING THE ANNEXATION OF 4.5 ACRES OF LAND LOCATED ON THE NORTH SIDE AND INCLUDING TULANE AVENUE, NORTH OF TAYLOR ROAD AND EAST OF GRANT ROAD INTO THE CITY OF CENTRAL POINT, OREGON (Applicant(s): Twin Creeks Development Co. LLC) (37 2W 03CC; TL 100) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Application has been made by the owners of certain real property for annexation into the City of Central Point, Oregon. The property consists of one tax lot and a section of road right-of--way consisting of a total of 4.5 acres. The property to be annexed is more particularly described as follows: That property know by Assessor's Map No. 372W03CC100 and all of Tulane Avenue more particularly described as follows: Commencing at a brass cap monumenting the southwest corner of Section 3, Township 37 South, Range 2 West of the Willamette Meridian, Jackson County, Oregon; thence North 89°99'38" East, along the south line of said section, 1330.58 feet, to the southeast corner of the southwest quarter of the southwest quarter of said Section 3; thence South 0°19'39" East, on the southerly projection of the east line of said quarter-quarter, 30.00 feet, to the south right of way line of Taylor Road; thence South 89°99'38" West, along said right of way line, 7.00 feet; thence North 0°19'39" West, 60.00 feet, to the southeast corner of Parkview Subdivision, recorded in Volume 7, Page 17 of the Plat Records of said County; thence North 0°19'39" West, along the east line of said Parkview Subdivision, 698.75 feet, to the northeast corner of said subdivision, to the POZNT OF BEGINNING; thence continue North 0°14'39" West, along the extension of said east line, 900.00 feet, to the north line of said quarter-quarter, thence South 89°50'37" West, along said north line of said quarter-quarter, 393.00 feet; thence South 0°14'39" East, parallel with the east line of said quarter-quarter, 900.00 feet; thence Sovth 89°50'37" West, parallel with the north line of said quarter-quarter, also being on the north line of said Parkview Subdivision, 350.63 feet, to the northwest corner of Tulane Avenue; thence South, along the west line of said Avenue, 60.00 feet; thence North 89°50'37" East, 793.63 feet to the east line of said Avenue; thence North, along said east line, 60.00 feet; thence North 89°50'37" East, along said north line of said Subdivision, 200.00 feet to the POINT OF BEGINNING. The above -described property is not within the City of Central Point's Current corporate boundaries, but is contiguous to the City's existing corporate boundary and is within the Central Point Urban Growth Boundary (UGB). Section 2. The owner of the property proposed for annexation is Twin Creeks Development Co. LLC, and there is mutual consent to the annexation. Such written consent is on file at Central Point City Hall, 155 South Second Street, Central Point, Oregon. Section 3.ORS 222.125 provides that when all ofthe owners ofland in the territoryproposed for annexation and not less than 50% of the electors residing in such territory have consented in writing to the annexation of the land in the territory and file such written consent with the City Council, the property maybe annexed without the requirement for an election or a public hearing. Section 4. Annexation of the described property is consistent with the City's ability to provide facilities and services to the real property, as required by the City's Comprehensive Plan. Section 5. Pursuant to ORS 222.125, the property described in Section 1 above, shall be and hereby is, annexed to and made part of the City of Central Point, Oregon. Section 6. The City Administrator, or his designee, shall transmit a copy of this resolution to the Oregon Secretary of State, and this annexation shall be effective when filed with the Oregon Secretary of State pursuant to ORS. 222.180.
