THE MEETING WAS CALLED TO ORDER AT 7:03 p.m.
II. ROLL CALL -Those present were: Chuck Piland, Jan Dunlap, Valerie Rapp,
Karolyne Johnson, Bob Gilkey. Candy Fish is absent.

IV. MINUTES
Commissioner Johnson moved to approve the April 2, 1996 Planning
Commission Minutes with a change: remove Bob Gilkey's name as present.
Mr. Gilkey was absent. Commissioner Rapp seconded the motion. ROLL
CALL VOTE: Dunlap, yes, Johnson, yes, Rapp, yes; Gilkey, yes. Motion
passed.

VI. BUSINESS
Review and recommendation rewarding Comprehensive Plan

Project Site.
Susan Wilson Broadus, Public Works Director, made a presentation with the
overhead projector on the issues relating to Public Works which included the
looping of water lines and the sewer line access.
Sue Riegel, Interim Planner, gave a short review of the Project.
Wes Reynolds, Planning Consultant, reviewed the Planning Department Staff
report and recommended approval subject to the conditions.
Chairman Piland asked if this would provide access to all the parcels.
Wes stated that it is just the first parcel but eventually it will give access to

all of the parcels.
Dennis Hoffbuhr and Gary Hall, representatives for the applicant, came
forward in favor of the application. They stated that they did not have
anything to add to the Staff Report. They will have further comments as
the other applications are considered. The applicant does not have any
problems with the conditions as discussed.
Commission Johnson moved that the Planning Commission recommend
approval of the Comprehensive Plan Amendment/Zone Text Amendment for
property located at 37 2W 2D TL 1800, 1901, 2300, 2400 and 37 2W 11 D
TL 101, also known as the Pilot Project Site subject to Planning. Department
condition of approval requiring extension of Peninger Road to the south of
Pine Street. Commissioner Gilkey seconded the motion. ROLL CALL VOTE:
Dunlap, yes; Johnson, yes; Rapp, yes, Gilkey, yes. Motion passed.

Wes Reynolds, Planning Consultant, reviewed the Planning Department Staff
Report. He stated that this use fits the description of the zone. The fast
food restaurant is the conditional use.
Susan Wilson Broadus, Public Works Director, reviewed the Public Works
Staff Report which included the following attachments:
1. Reduction of Site Plan Submitted by Applicant
2. April 8, 1996 Letter from Jackson County
3. April 9, 1996 Letter from Pilot Corporation
Mark Servatius, Fire Chief/Building Official, reviewed the Department of
Public Safety Staff Report.
Dennis Hoffbuhr, 1062 E. Jackson Street, Medford, Oregon, representative
of the applicant, came forward in favor of the application. Dennis stated
that there is no problem with the conditions as stated in the staff reports
except for the following:
1. The specific Conditions #5 and #6, for the 6' bike lane at that

intersection. He felt that there is a better means for providing access
for bicycles at that intersection. He requested that the Planning
Commission allow the applicant to present alternative methods for
providing bicycle access to the staff and give the staff the flexibility
to make a decision concerning the alternative means for bicycle
access.
2. He also requested that the staff be directed to investigate a
reimbursement plan that requires adjacent properties and future
developers pay apro-rata share of the cost of the public works
improvements constructed by the applicant.
3. He stated that they may have to increase the size the driveway to 36
feet to allow for 2 entrance lanes and one exit lane so that they can
be guaranteed that traffic will flow through at all times.
Gary Hall, 2385 Terry Drive, Medford, Oregon, representative of the
applicant, came forward on behalf of the application. He stated that he
concurred with Mr. Hoffbuhr's statements.
Commissioner Johnson moved that the Planning Commission recommend
approval of the Site Plan Application for property known as the Pilot Project
(37 2W 2D TL 1800, 1901, & 2300 & 37 2W 11 D TL 101) (Applicants:
Hoffbuhr & Associates) subject to Planning Department and Public Works
conditions of approval with the following modifications: Modify Public
Works specific conditions number 5 & 6, requiring a six foot bike lane on
each side of the Peninger Road extension, to allow the applicant to present
alternative methods for providing bike access to the project site subject to
Public Works approval; direct staff to investigate creation of a
reimbursement mechanism that requires future developers to pay apro-rate
share of the cost of public works improvements constructed by the
applicant; modify site plan to allow a 36' driveway width on Pine Street to
accommodate fast-food restaurant traffic subject to Public Works approval.
Commissioner Rapp seconded the motion. ROLL CALL VOTE: Dunlap; yes,
Johnson, yes; Rapp, yes; Gilkey, yes. Motion passed.
Chairman Piland declared a recess at 8:50 p.m.

Chairman Piland opened the public hearing.
Wes Reynolds, Planning Consultant, reviewed the Planning Department Staff
Report.
There was no conflict of interest or ex-parte communication.
Dennis Hoffbuhr and Gary Hall, representatives for the applicant, came
forward on behalf of the application.
Commissioner Dunlap sated that the applicant should consider the large
trees already on the land in the landscaping plan.
Mr. Hoffbuhr and Mr. Hall stated that they haven't evaluated the existing
trees but will see if they can integrate them into the landscaping plan.
Chairman Piland closed the Public Hearing.
Commissioner Rapp moved to approve Resolution No. 349 regarding
Application for Conditional Use Permit for property known as the Pilot
Project (1560 E Pine Street) subject to Planning Department and Public
Works conditions of approval. The motion was seconded by Commissioner
Dunlap. ROLL CALL VOTE: Dunlap, yes; Johnson, yes; Rapp, yes; Gilkey,
yes. Motion Passed. Conditional Use Permit was approved.
VII. MISCELLANEOUS
Sue Riegel introduced Jim Bennett, the new Planning Director.
Commissioner Piland thanked Sue Riegel on behalf of the Planning
Commission for her work in the last few months.
VIII. ADJOURNMENT
Commissioner Rapp made a motion to adjourn. Commissioner Gilkey
seconded the motion. All said "aye" and the meeting adjourned at 9:15 p.m.

The above-referenced applications were continued from Apri12, 1996 to the regular Planning
Commission meeting of May 7, 1996 at the request of the applicant. Staffhas been informed
by the applicant that they require additional time to explore development alternatives for the
site and will likely submit a revised version of the project. Accordingly, they have requested
a continuance of these applications to the regular Planning Commission meeting of June 4,
1996.
Recommendation
Staff recommends that the Planning Commission grant the applicant's request for a
continuance to June 4, 1996.

Summary
The applicant, Gary T. Whittle, is proposing a tentative plan for Phase IX of the Forest Glen
Subdivision consisting of twenty-eight single-family lots. These lots were originally to have
been included in Phase VIII of the Forest Glen Subdivision, but were withdrawn. The lots
are located along Coachman Drive and Looking Glass Way between Pittview Drive and
Forest Glen Drive.
Authori
CPC 1.24.020 invests the Planning Commission with the authority to hold a public hearing
and render a decision on any application for a subdivision tentative plan. Notice of the public
hearing was effected in accordance with CPC 1.24.060.
Discussion
The Planning, Public Safety and Public Works Departments have reviewed the tentative plan
for Phase D~ of the Forest Glen Subdivision and have concluded that it is in compliance with
all city requirements if all conditions of approval are met. The recommended conditions of
approval included in the Public Works Staff Report dated May ~ 1996 are incorporated
herein by reference.

Beginning at the above place and time, the Central Point Planning Commission will conduct a
public hearing to review a Tentative Plan Application for a land partition located in the Single
Family Residential Zone (R-1-6) on property north of Forest Glen Drive, east of Marilee Street
and south of Pittview Avenue. The site is located on Tax Lots 100 - 202 of Jackson County Tax
Assessor Map Page 37 2W 11DA ff approved, the land partition would create twenty eight lots
ranging in size from 6,600 square feet to 7,605 square feet. The agent of record is Farber
Surveying. -
CRITERIA FOR DECISION
The requirements for approval of tentative plans are set forth in Chapter 16 of the Central Point
Municipal Code, relating to tentative plans, land partitions, street, water system, storm drainage
and sanitary sewer and CPMC Chapter 17 relating to lot dimensions. The Tentative Plan is also
reviewed for compliance with the City's Public Works Standards.
PUBLIC COMMENTS
1. Any person interested in commenting on the above-mentioned land use decision may
submit written comments up until the close of the hearing scheduled for Tuesday,
May 7, 1996.
2. Written comments maybe sent in advance of the hearing to Central Point City Hall, 155
South Second Street, Central Point, Oregon 97502.

Issues which may provide the basis for an appeal on the matters shall be raised prior to
the expiration of the comment period noted above. Any testimony and written comments
about the decisions described above will need to be related to the proposal and should be
stated clearly to the Planning Commission.
4. Copies of all evidence relied upon by the applicant are available for public review at City
Hall, 155 South Second Street, Central Point, Oregon. Copies of the same are available
at 15 cents per page.
5. For additional information, the public may contact the Planning Department at
(541) 664-3324 (extension 231).
SUMMARY OF PROCEDURE
At the public hearing, the Planning Commission will review the application, and technical staff
reports, hear testimony from the applicant, proponents, and opponents and hear arguments on the
application. Any testimony or written comments must be related to the criteria set forth above.
At the conclusion of the review hearing, the Planning Commission may approve or deny the
Tentative Plan for the proposed land partition. City regulations provide that the Central Point
City Council be informed about all Planning Commission decisions. The Council may, on its
own motion, no later than the regularly scheduled Council meeting following the decision date,
call for a review of the Planning Commission decision. Any party aggrieved by the action of the
Planning Commission may request a review of such action by the City Council by filing a
written appeal to the city no more than seven days after the date the city mails the notice of the
decision.

TENTATIVE PLAN CONDITIONS
FOREST GLEN IX
GENERAL
o ORS Chapter 468.740 requires that all developments which will disturb 5 ACRES OR
MORE of land adjacent to a stream which discharges to surface waters of the State of
Oregon shall as a part of the construction permitting process submit an "Erosion
Control Plan."
The "Erosion Control Plan" shall require a PERMIT from DEO. No construction activity
on any Tentative Plan can occur until authorization to do so has been granted by DEO.
Developer shall provide a copy of the DEO permit to the City prior to beginning
construction.
o Developer shall provide and install ladder rungs approved by the Central Point Public
Works Department for each sanitary sewer manhole with a depth greater than 4.0 feet
to the flow line of the manhole.
o Developer's engineer shall design the water system to provide a minimum flow of 1000
g.p.m. at each fire hydrant.
o Developer shall construct all utilities, streets, and other structures discussed herein,
within rights-of-way owned, or to be owned by the City of Central Point, in accordance
with all rules, regulations, ordinances, resolutions and other applicable requirements
of the City of Central Point for the construction of this development.
o This review for the Tentative Plan submitted by the applicant was done so in
accordance with all the rules, regulations and ordinances in effect as of the date of this
review. Any modifications by Developer of this project after City Planning Commission
approval, could require resubmittal of an application, and approval by the City Planning
Commission based on the recommendation of staff responsible for this review.
o All costs associated with this Development and the conditions placed on this
Development shall be the sole responsibility of the applicant/owner.
o No construction will begin on this project or any building until such time as plans and
specifications have been reviewed and approved by the Public Works Department and
other required divisions of the City and a Construction Permit has been issued for each
portion of the project requiring a permit.
o The Final Plat of this Partition shall not be approved by the Planning Commission until
all conditions as herein stipulated and approved for this project have been met by
construction and acceptance thereof, or bonding for construction.
o The City shall approve street stationing prior to Developer's engineer designing the
improvements for this Tentative Plan.

Forest Glen IX
1. All structures shall have roof drains, area drains, and crawl spaces with positive
drainage away from the structure and drain lines connected to a curb drain, or an
approved storm sewer. The developer shall provide the necessary storm drainage
improvements and lot grading to assure that all streets, lots, and all properties will
drain properly. The developer shall submit a grading plan with the construction
drawings and perform such grading and drainage improvements which satisfies this
drainage condition leaving only minor grading required for each lot during construction.
2. Construction of this development shall include all street improvements, lighting, water,
sanitary sewer, storm drainage, utilities, ingress and egress improvements, and
sidewalks.
3. The City's Engineer shall at the cost of the developer, evaluate the strength of the
native soils and determine the street section design in accordance with the Public
Works Department Design Standards.. The street design shall be based the following
design criteria:

4. The construction drawings for this Tentative Plan shall include a Street Lighting Plan,
Utility Plans and a Traffic Control Plan in accordance with the requirements of the City
of Central Point Public Works Department. The construction drawings shall include
clear vision areas designed to meet the City of Central Point Public Works Standards.
Developer shall pay all costs associated with the design and installation of the street
and lighting improvements specified on these plans.
5. The construction drawings will indicate type, size and location of water service, water
mains and fire hydrants in accordance with the City's Public Works Standards and the
recommendation of the Department of Public Safety.
6. Developer's engineer shall design the Sanitary Sewer system to serve the development
of this tract and all future development which will be tributary to this development.
A minimum 15' easement as required by DEQ shall be provided for all sanitary sewers
located on private property.

7. Developer shall construct an adequately sized storm drainage system to provide for
runoff onto the subdivision property and from each lot. As a part of the construction
of the improvements for this Tentative Plan, Developer's engineer shall provide a
complete set of drainage calculations for sizing the storm drainage system for this
development. Developer shall submit this information to the Public Works Department
at the time construction drawings for the subdivision are submitted to the Public Works
Department for permits for construction of the storm drainage improvements. The
engineer shall use the rainfall/intensity curve obtained from the Public Works
Department for hydrology calculations.
8. Developer shall provide a 20' easement for the 48" storm drain located along the west
line of Lots 248 through 255. Developer shall provide a 10' easements for the minor
storm drains located on Lots 244 - 247 and Lots 264 - 266.
9. The City has filed a Wetlands Use Notification Form with the Division of State Lands.
Developer shall obtain the required permits from the Division of State Lands prior to
beginning construction. A copy of the permit(s) shall be filed with the Department of
Public Works.

Discussion

Recitals
1. Billy W. Hogan, applicant, on behalf of Marian G.

Summary
The proposed zone text amendment would allow a reduced street frontage for padlots from
forty feet to thirty feet. This would give padlots the same street frontage requirement as cul-
de-sac lots.

CPMC 1.24.020 invests the Planning Commission with the authority to review and make
recommendations to the City Council on amendments to the text and map of the zoning
ordinance.
Discussion
The City Council approved Resolution No. 749, declaring the city's intent to amend CPMC
17.60.130 pertaining to minimum street access frontage for lots, on Apri122, 1996. Upon
recommendation of the Planning Commission, the City Council will hold a public hearing and
may adopt an ordinance amending the CPMC as stated in their Resolution of Intent.

THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN
AS FOLLOWS:
Central Point Municipal Code Section 17.60.130 is hereby
amended to read as follows:
17.60.130 Access. Each lot shall abut a minimum frontage
of forty feet upon ,a public street, other than an alley, with the
exception of ~'i~'~~;~z'3 lots fronting on a cul-de-sac;; which may
be permitted a"'reduced"frontage of not less than thirty feet,
provided all driveway and off-street parking requirements of
Chapter 17.64 can be met. This section is not intended to
prohibit the creation or development of flag lots.
