HomeMy WebLinkAboutCouncil Resolution 806RESOLUTION NO. 806 A RESOLUTION DECLARING A DISCARDED VEHICLE AT 213 MANZANITA STREET A PUBLIC NUISANCE AND ORDERING REMOVAL BY NOVEMBER 3, 1997 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Pursuant to a written request by Darryl and Pam. Summerfield for a hearing before the City Council to determine whether three vehicles owned by the Summerfields and stored at 2.13 Manzanita Street constitute "discarded vehicles", and a public nuisance and should be abated, the City Council on October 2, 1997, held a hearing on the matter. Section 2. After hearing testimony from Code Enforcement Officer Ron Barnett, the Summerfields, and several other persons, the City Council finds that the Summerfields are in violation of CPMC 10.12.040 which prohibits the keeping of discarded vehicles, and the Council declares the 1979 Mercedes to be a public nuisance. Section 3. Pursuant to the authority granted the City Council in CPMC 10.12.090, the Summerfields are hereby given until November 3, 1997, to remove or screen from view in compliance with CPMC 10.12.040 the 1979 Mercedes and, further, to demonstrate that the 1974 Vega and Corvette vehicles are operable and are therefore not "discarded" under CPMC 10.12.010. If it is determined that the Vega and Corvette are not operable, those vehicles are declared public nuisances and shall also be either removed or screened from view in compliance with CPMC 10.12.040 by November 3, 1997. Any discarded vehicles remaining on the property after November 3, 1997, shall be immediately removed by the Citv without further action by the City Council.
