HomeMy WebLinkAboutCouncil Resolution 805RESOLUTION NO. 805 A RESOLUTION APPROVING AN AMENDMENT TO THE CENTRAL POINT ZONING MAP (37 2W 03AA Tax Lots 4000 and 4100) (Applicant: Terry L. Buntin) Recitals 1. This matter came before the City on an application. for an amendment to the City's Zoning Map, seeking to change the designation on the Zoning Map from R-1-8, Residential Single- Family (8,000 square foot minimum lots.) to R-1-6, Residential Single-Family (6,000 square foot minimum lots). 2. On August 19, 1997, the Central Point Planning Commission conducted a review of the application, and recommended approval. 3. On October 2, 1997, the Central Point City Council conducted a duly-noticed and advertised public hearing on the applications. The Council reviewed the written materials submitted by the applicant, City staff reports, and heard testimony from all persons wishing to be heard. Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section. 1. Nature of Application. This matter consists of an application for an amendment to the Zoning Map, seeking to re- designate 12.96 acres of land in the city from the. present Zoning Map designation of R-1-8, Residential Single-Family (8,000 sq. ft.) to R-1-6, Residential Single-Family (6,000 sq. ft.). Section 2. Approval Criteria.. In order for an amendment to the Comprehensive Plan to be approved, Central Point Municipal Code Section 17..96.050 requires an applicant to establish that: A. There is a public need and justification for the change; and B. The proposed amendment is consistent with all applicable statewide planning goals. Section 3. Findings and Conclusions. A. The City Council hereby adopts by reference the findings and conclusions contained in applicant's submitted "Findings of Fact and Conclusions of 1 - RESOLUTION NO. 805 (100397} Law~~, dated June 2, 1997 the findings contained in the City staff report dated October 2, 1997, placed in the record, all of which are by this reference incorporated herein. B. The Council finds that applicant has. established the public need and justification for the proposed amendments, and further finds that the amendments are consistent with all applicable statewide planning goals. Section 4. Approval. The within applications are conditionally approved. The Central Point Zoning Map shall be amended so that the properties located at Township 37, Range 2W, Section 03AA, Tax Lots 4000 and 4100, shall hereafter be designated on the Zoning Map as R-1-6 Residential Single-Family (6,000 sq. ft.)
