ROLL CALL -Those present were: Chuck Piland, (Jan Dunlap) Herb Farber, Candy Fish, Randy Graves, Karolyne Johnson and Valerie Rapp. Jan Dunlap and Karolyne Johnson had previously notified the Commission that they would not be able to attend. III. CORRESPONDENCE -None IV. MINUTES Commissioner Fish moved to approve the August 15, 1995 Planning Commission Minutes. Commissioner seconded the Motion. ROLL CALL•yOTE: Farber, yes; Fish, abstain; Graves, yes and Rapp yes,-and the Minutes were approved. V. PUBLIC APPEARANCES -NONE VI. BUSINESS A. Public Hearing -Review and determination regarding amendment to Conditional Use Permif for Hastings Furniture Company located at 150 N. Front (Applicant: John Hastings). George Rubaloff, Planning Administrator, reviewed the Notice of Public Hearing, dated August 10, 1995, including the Nature of Hearing, Criteria for Decision, Public Comments, and Summary of Procedure. Chairperson Piland opened the Public Hearing. None of the Commissioners declared a conflict of interest or ex-parte communication. George Rubaloff reviewed the Planning Department Staff Report dated August 29, 1995, highlighting the Background, and incorporated the Letter from John Hastings, Notice of Public Hearing, List of Owners, Assessor's Map, Approved Site Plan, Resolution #272 (CUP) and the Planning Commission Minutes of January 4, 1994 into the record by reference. CITY OF CENTRAL POINT Planning Commission Minutes September 5, 1995 -Page Two John Hastings, Applicant, 150 N. Front Street, Central Point, Oregon, came forward in support of the amendment to the Conditional Use Permit. He explained that he is in the process of making improvements in the back of the property, and does not want to pave until these improvements are completed. The proposed division is located in the Residential Two-Family District (R 2 Zone) located in the general vicinity of where Glengrove Avenue connects to Columbine Way. Phase VII of Forest Glen Subdivision is located on a 2.St acre site further described as Tax Lot 1800 of Tax Assessor Map 37 2W 11A. This phase of the development features eight lots ranging in size between 9240 and 11765 square feet. The proposed development features a northwesterly extension of Glengrove Avenue and a easterly extension of Columbine Way. The property owners of record are Gary T. Whittle, James K. Johnson and Barry N. Bloomberg. The authorized agent in the application process is Herbert A. Farber of Farber Surveying Company. The requirements for approval of subdivisions and tentative plans are set forth in CPMC Chapter 16, relating to street, water system, storm drainage and sanitary sewer and CPMC Chapter 17 having to do with lot dimensions. The Tentafive Plan is also reviewed in accordance to the City's Public Works Standards. PUBLIC COMMENTS Any person interested in commenting on the above-mentioned land use decision may submit written comments up until the close of the hearing scheduled for September 19, 1995. 4 ` ~ 2. Written comments should be sent to Central Point City Hall, 155 South . Second Street, Central Point, Oregon 97502, attention, George Rubaloff. 3.. Issues which may provide the basis for an appeal on the matters shall be raised prior to the expiration of the comment period noted above. Any testimony and written comments about the decisions described above will need to be related to the proposal and should be stated clearly to the Planning Commission. 4. Copies of all evidence relied upon by the applicant are available for public review in Room 214, City Hali, 155 South Second Street, Central Point, Oregon. Copies of the same are available at 15 cents per page. 5. For additional, information, the public may contact George Rubaloff in the Planning Department at (503) 664-3324. At the public hearing, the Planning .Commission will review the application, and technical staff reports, hear testimony from the applicant, proponents,,. and opponenES artd hear any arguments on the application. Any testimony or written comments must be related to the criteria set forth above. At the conclusion of the review hearing, the Planning Commission may approve or deny the Tentative Plan for Phase VII of Forest Glen Subdivision. City regulations provide that the Central Point City Council be informed about all Planning Commission decisions at the regularly scheduled Council meeting following the decision date. The Council may, on its own motion, call for a review,of the Planning Commission decision. The "Erosion Control Plan" shall require a PERMIT from DEO. No construction on any Tentative Plan storm drainage system can occur until authorization to do so has been granted by DEQ. o Developer shall provide and install ladder rungs approved by the Central Point Public Works Department for each sanitary sewer manhole with a depth greater than 3.0 feet to the flow line of the manhole. o Developer's engineer shall design the water system to provide a minimum flow of 1000 g.p.m. at each fire hydrant. o Developer shall construct all utilities, streets; and other structures discussed herein, within rights-of-way owned, or to be owned by the City of Central Point; in accordance with all rules, regulations, ordinances, resolutions and other applicable requirements of the City of Central Point for the construction of this development. o This review for the Tentative Plan submitted by the applicant was done so in accordance with all the rules, regulations and ordinances in effect as of the date of this review. All structures shall have roof drains, area drains, and crawl spaces with positive drainage away from the structure and drain lines connected to a curb drain, or an approved storm sewer. The developer shall provide the necessary storm drainage improvements and lot grading to assure that all streets, lots, and all properties will drain properly. The developer shall submit a grading plan with the construction drawings and perform such grading and drainage improvements which satisfies this drainage condition leaving only minor grading required for each lot during construction. 2. Construction of this development shall Include street, lighting, water, sanitary sewer, storm drainage utilities, ingress and egrets improvements, and sidewalks. All improvements shall be designed and constructed in accordance with City of central Point Standards and Specifications for Public Works Construction. 3. The City's Engineer shall at the cost of the developer, evaluate the strength of the native soils and determine street section design in accordance with the Public Works Department Design Standards. The construction drawings for this Tentative Plan shall include a Street Lighting Plan and a Traffic Control Plan in accordance with the requirements of the City of Central Point Public Works Department. The construction drawings shall include clear vision areas designed to meet the City of Central Point Public Works Standards. Developer shall pay for all costs associated with the design and installation of the street and 'lighting improvements specified on these plans. 5. The construction drawings will indicate type, size and location of water mains and fire hydrants in accordance with the City's Public Works Standards and the recommendation of the City's Fire Chief. 6. Developer's engineer shall design the sewer system to serve the development of this tract and all future development which will be tributary to this development. 7. Developer shall construct an adequately sized storm drainage system to provide for runoff onto the subdivision property and from each lot. As a part of the construction of the improvements for this Tentative Plan, Developer's engineer shall provide a complete set of drainage calculations for sizing the storm drainage system-for this. development. Developer shall submit this information to the Public Works Department at the time construction drawings for the subdivision are submitted to the Public Works Department for permits for construction of the storm drainage improvements. It was determined that the time and costs involved for a Conditional Use Permit would be excessive. Barry Fronek moved that Council approve Resolution 736 amending Title 17 of the Central Point Municipal Code to add Mobile Food Vendor as a permitted use in the C-3, C-4 and C-5 Zones.
