MINUTES Commissioner- Rapp moved to approve the August 1, 1995 Planning Commission Minutes. Commissioner Farber seconded the Motion. ROLL CALL VOTE: Dunlap, yes Farber, yes; Fish, yes; Graves, abstain; Johnson, yes, and Rapp yes, and the Minutes were approved. V. PUBLIC APPEARANCES -NONE VI. BUSINESS A. Public Hearing: Review and Determination for Tentative Plan of Unit No. 6 of Jackson Creek Estates Subdivision, located on a southerly extension of Jackson Creek Drive. Chairman Piland opened the Public Hearing. George Rubaloff, Planning Administrator, reviewed the Notice of Public Hearing dated July 21, 1995, including the nature of hearings, criteria for decision, public comments and summary of procedure. Commissioner Johnson declared a possible conflict, and took a seat in the audience. There were no other conflicts of interest or ex-parte communication declared by any of the Commissioners. George Rubaloff reviewed the Planning Department Staff Report dated August 11, 1995 including the description of application, background information . 1 CITY OF CENTRAL POINT Planning Commission Minutes August 1, 1995 -Page Two review highlights, and conclusion. He incorporated the Notice of Public Hearing dated July 21, 1995, the Mailing List Notice (100 ft. radius by reference), Maps and Plans, Application, Public Works Staff Report dated August 11, 1995 and Background Materials (letter from Secretary of State, Sanitary Sewer Service Area Agreement, Wetland Notification Form, Jackson Creek Neighborhood Development Plan, Chronology of Process, Letter to Tom Malot Construction dated July 18, 1995) into the record by reference. Susan Wilson Broadus, Public Works Director, stated that Mike Thornton of Thornton Engineering had prepared the Staff Report, and that he was in the audience and available to answer any questions or concerns. Tom Malot, Applicant, 612 E. Pine Street, Central Point, Oregon, came forward in support of the application for tentative plan. Commissioner Graves had a concern about the radius for turn-around on cul- de-sacs. Mike Thornton stated the standards for the City of Central Point. Commissioner Farber asked whether the error was in the Standards stating 50' radius or 52' that is stated in the code. Susan Wilson Broadus stated that staff would research into this. There was some discussion concerning whether the wording in the Public Works Staff Report, Exhibit B, #8 should be "Build or Bond" instead of just the word "satisfy". Commissioner Dunlap asked if there were plans for a City park in the area. Tom Malot stated that in back of Jackson Creek Unit #3, there was 4 Y= acres dedicated for a park. No one else came forward in support or in opposition to the application for Tentative Plan for Jackson Creek Estates #6. Public Hearing: Review and Determination for Site Plan of Addition to the Valley Family Practice Medical Facility located at 615 South 2nd Street, adjacent to the Serenity Lane Treatment Center. Chairman Piland opened the Public Hearing George Rubaloff reviewed the Notice of Public Hearing dated July 21, 1995, including the nature of hearings, criteria for decision, public comments, and summary of procedure. There were no conflicts of interest or ex-parte communication declared by the Commission. George reviewed the Planning Department Staff Report dated August 11, 1995 including the description of application, Land Use History, Zoning, Review Highlights, Conclusion, and incorporated the Notice of Public Hearing dated August 15, 1995, Mailing List for Notice, Maps, Application, Public Works Department Staff Report dated August 8, 1995 and Public Safety Department Review dated July 5, 1995 into the record by reference. 3 Staff Re ort to: Central Point Planning Commission ,~,~ /August 29, 1995 from: George Rubaloff, Planning Administrator ~11"' subject: public Hearing -Review and Determination for Amendment to Conditional Use Permit for furniture sales and manufacturing company at 150 North Front Street in the C-5 Zone (Applicant: John Hastings) Background Under the authority of CPMC 1.24, the Planning Commission can make decisions on Conditional Use Permit Applications. Exhibit B of this report describes the application, decision criteria and procedure. Public hearing notices were mailed on August 10, 1995. At the date of this writing, city staff has not received any written or oral comments from the public regarding the proposed amended Conditional Use Permit. Planning, Public Works and Public Safety Departments have reviewed the proposal for amending the permit and have concluded that an extension of time for paving the alleyway would be acceptable. Two stipulations of this permit are to pave the parking lot and to pave the alley within 18 months. John Hastings, owner of Hastings Furniture Company has requested that Condition No. 1 and 2 of the Conditional Use Permit be amended so that an 18-month extension is granted for completing paving requirements. Condition No. 1 requires on-site parking to be paved with asphaltic concrete. Condition No. 2 requires the applicant to improve the alleyway adjacent to the property by paving it to city standards. The proposed amendment would enable the applicant to install required paving after all the planned remodeling and improvements are. completed on the site. CRITERIA FOR DECISION The requirements for conditional use permits are set forth in Chapter 17.76 of the Central Point Municipal Code, relating to access, size and shape of site, significant adverse impact upon abutting properties, local, state and federal regulations and general health, safety and welfare. Any person interested in commenting on the proposed amendment to the conditional use permit may submit written comments up until the close of the hearing scheduled for Tuesday, September 5, 1995. Written comments may also be sent in advance of the hearing to Central Point - 8 City Hall, 155 South Second Street, Central Point, Oregon 97502, attention, George Rubaloff. 2. Issues which may provide the basis for an appeal on the matters shall be raised in writing prior to the expiration of the comment period noted above. Any testimony and written comments about the decision described above will need to be related to the specific proposal and should be stated clearly to the Planning Commission. 3. Copies of all evidence relied upon by the applicant are available for public review, at City Hall, 155 South Second Street, Central Point, Oregon. Copies of the same are available at 15 cents per page. 4. For additional information, the public may contact George Rubaloff in the Planning Department at (503) 664-3324. SUMMARY OF PROCEDURE At the public hearing, the Planning Commission will review the proposal, and any technical staff reports, hear testimony from the applicant, proponents, and opponents and hear any arguments on the application. Any testimony or written comments must be related to the criteria set forth above. At the conclusion of the review hearing, the Planning Commission may approve or deny an amendment to the Conditional Use Permit for the Hastings Furniture Sales and Manufacturing Company. City regulations provide that the Central Point City Council be informed about all Planning Commission decisions. The Council may, on its own motion, no later than the regularly scheduled Council meeting following the decision date, call for a review of the Planning Commission decision. FRONT STREET BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Nature of Application. This is an application for a Conditional~Use Permit to operate furniture sales and manufacturing for on-premises sales in a C-5 zone. Both uses are conditional uses in the C-5 zone under CPMC 17.46.030. After due notice, the Planning Commission held a public hearing on January 4, 1994 to consider the application. Section 2. Applicable Criteria. The following chapters of CPMC apply to this application: 17.46, C-5, Thoroughfare Commercial District 17.60, General Regulations 17.64, Off-Street Parking and Loading 17.76, Conditional IIse Permits ~~ Section 3. Findinas and Conclusions. A. The requirements of CPMC Chapter 17.46 pertaining to uses, lot size, setback and screening are met. B. If the applicant complies with the conditions set forth in Section 4, the requirements of Chapters 17.60 and 17.64 pertaining to parking and paving will be met. C. The requirements of Chapter 17.76 are met. Section 4. Conditional Approval. The application herein is approved, subject to the following conditions: 1. Applicant shall, within 18 months of this approval, pave the parking lot with asphaltic concrete, to City standards. 2. Applicant shall, within 18 months of this approval, improve the alley adjacent to the subject property. Such improvements shall include a minimum of two inches of compacted asphaltic concrete, over six inches of compacted base rock and compacted subgrade, from the existing pavement south of the property to the northerly property line. Alley construction shall be to City standards and shall include drainage. 3. Applicant shall move the fifth parking space to the rear of the property and use three 8-foot by 15-foot compact parking spaces in that area. 4. Mr. Lanier stated that the applicant would comply with the requirements listed in the Staff Reports. Dale Mauck, 2348 Beall Lane, Central Point, Pastor of the Baptist Church stated that they had an oral agreement with the Grange Coop on using the parking fgt. He also explained that the reason this was not a written agreement was because of insurance reasons, and that their history with the Grange Coop and personal good faith, that the oral agreement was working just fine. Larry Blanchard stated that in looking at the requirements that the 25' clear vision should be corrected to read 15' along the south and west property lines adjacent to the alley. Chip Gabriel, 8601 S.E. Causey Avenue, Portland, representing the Care Center, stated that they had signed the documents vacating the alley. No one else came forward in support of or in opposition to the application. There was some further discussion between the agent and the Planning Commission concerningthesetbacks,zoning, conformance withordinances and the comparison with setbacks allowed Sentry Market. Commissioner Farber moved that the Public Hearing site Plan for building addition to the First Baptist Church at 100 Oak Street, and zoning variance for lot coverage standard (Agent: Richard Stevens Company for Applicant: First Baptist Church) be continued at a time based on the decision of legal counsel for either January 18, 1994 if no further notice is required for the Supplemental Finds (Received January 4, 1994) addressing setback variance request or continue to February 1, 1994 if further notice is required. Public Hearing - Review and Determination for Conditional Use Permit application for operating furniture sales and manufacturing for on-site sales at 150 North Front Street in the C-5 Zone. The site is located on the east side of Front Street between Laurel and Manzanita Streets. (Agent: John Hastings for groperty owner Orlin Cartwrightl. Chairman Piland opened the Public Hearing. George Rubaloff referred to his Memo of December 29, 1993 and the preface stating the authority of CPMC 1.24 for the Planning Commission to review and make the land use decision on the application. ..,. ~~ ,y, CITY OF CENTRAL POINT Planning Commission Minutes January 4, 1994 -Page Seven Mr. Rubaloff fully outlined the Notice of Public Hearing, dated December 14 1993, including the nature of hearings, criteria for decision, public comments and summary of procedure. He also stated that for the record, John Hastings has purchased the property since the Notice went out and is the owner of record now. d' There were no conflicts of interest or ex-parte communication. Rubaloff reviewed Planning Department Review, dated December 27, 1993 including the review statements and requirements and other considerations. He referred to item 1. under requirements, and since writing the report, observed buffering the north property line. Item 2, hours of operation is discretionary. Item 3, parking and maneuvering is not discretionary and must be in accordance with the parking design standards prior to operating business and issuance of certificate of occupancy, and Item 4, needs to be corrected so that the parking spaces conform to City regulations. Rubaloff also commented on the special setback requirements of Front Street, which is a State Highway. Larry Blanchard referred to the Public Works Department Staff Report dated December 29, 1994, and added that some revisions need to be made to Item 1. section (2) to add "(see #1 Exhibit "a") and on Item 6, section a, to remove the wording "See (3) Exhibit "A". Larry Blanchard stated that the Master Transportation Plan has not been completed, so we don't know if the 110' right of way width on Front Street will be required in the future. George Rubaloff stated that he and the City attorney had just had a conversation concerning CPMC 12.02 in regards to the word "development" that it still isn't clear on just what is considered "development"? Larry Blanchard stated that the City needs a clear definition of what it means by "Development". ~~~ , i7 ,~, i 456 ~.; ; CITY OF CENTRAL POINT Planning Commission Minutes January 4, 1994 -Page Eight Mark Servatius, Fire Chief/Building Official stated that this change in the structure would require a Building Permit, there needs to be a 1 hour fire occupancy separation wall and door assembly. John Hastings,. Applicant, 150 N. Front, Central Point came forward in support of the Conditional Use Permit. Mr. Hastings asked if the two parking spaces in the back of the property could be modified to three compact parking spaces. He also stated that even if he were to pave the alley, the dust control would still not be complete as the meat trucks would still drive in on the adjoining dirt road. Mr. Hastings stated that he wanted to take this area "which is an eyesore" and fix it up, paint, landscape, and other improvements. He stated that the hours of operation including manufacturing would be Sam to 5pm. In answer to whether the applicant would be required to pave the alley, Larry Blanchard stated that they needed to get an interpretation from the City Attorney concerning the term "development". Larry Blanchard in response to a question about location, referred to a correction of Item 6. Discussion under 1. Mainlines, the sentence a. should read "The existing water mainlines in North Front Street shall provide for fire protection and domestic use for this property." Commissioner Fish commented that this building has been in poor condition over the years. Hastings stated that if the City approve his Conditional Use Application, that he would apply the gravel now, and do the paving later. No one else came forward in support of, or in opposition to the Conditional Use Application. Chairman Piland closed the Public Hearing. Commissioner Farber moved that they approve Resolution #272 for the Conditional Use Permit for operating furniture sales and manufacturing for on- site sales (Agent: John Hastings for property owner Orlin Cartwright) according to the Staff Report, but with the condition that the 5th parking spot be created at the rear and be removed from the 60' special set back and with ample maneuvering room and Applicant have 18 month period of time with which to complete the paving of the parking and maneuvering areas on the property (including the alley (off-site) if it is legally determined to be "Development", is CITY OF CENTRAL POINT Planning Commission Minutes January 4, 1994 -Page Nine with any improvement requiring imposition of 12.02, that the Front Street (Highway 99 Frontage) be done through an Irrevocable Consent.
