HomeMy WebLinkAboutCouncil Resolution 851RESOLUTION NO. 851 A RESOLUTION ESTABLISHING A STREET SYSTEMS DEVELOPMENT CHARGE, INCLUDING A METHODOLOGY THEREFOR Recitals 1. The City received a report prepazed by the Public Works Department on a Street Systems Development Chazge (SDC) dated May, 1999, which included a reconunended methodology for calculating a City of Central Point Street Systems Development Charge for City Arterial and Collector Streets. 2. The use of Systems Development Chazges (SDCs) is a way to finance or reimburse construction of capacity increasing arterial and collector street projects as shown or referenced in the City of Central Point Street SDC Report approved on May 27, 1999, or as may periodically be revised . 3. The City by this Resolution shall establish the Street SDC and methodology for the expansion of the City Transportation System as set forth below. Now, therefore; BE IT RESOLVED BY THE CITY COUNCIL OP THE CITY OP CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Definitions. As used herein, the following definitions apply: Definitions for Street Systems Development Charge Terms: Systems Development Charge (SDC) - "Systems Development Charge" means a reimbursement fee, azi improvement fee or a combination thereof as further defined or described in CPMC 11.12. Street Systems Development Charges Report -The basic document which provides the background and substantiates the methodology and calculations for the Street Systems Development Charge. Attributable New Travel (ANT) in Vehicular Miles per Day -Vehicular Trip Ends Per Day X Average Trip Length / 2. Average Trip Length -Average Trip Lengths are derived from the 1995 National Personal Transportation Study (NPTS) developed by the U.S. Department ofTransportation (USDOT). Trip lengths reflect measurement from a departure point to an arrival at a designated facility. Le. a "one way" trip. Adjusted Trip Length -Average Trip Lengths are adjusted to reflect local conditions. Itr the City of Central Point the maximum. average trip length is determined to be 3.7 miles. Resolution No. 857. (f761099) Trip Ends - As defined by the ITE "Trip Generation Manual", 6`h Edition, a trip constitutes a trip end at the departure point and a trip end at the arrival point between facilities. E.G. a trip from home to work only would constitute 2 trip ends. Trip generation rates have been established by Institute oP Transportation Engineers for hundreds of facilities over many yeazs based on accurate statistical studies. Reduced Trip Ends - A reduced number of trip ends reflect both "passer by trips" and "diverted trips. E.G. A person going to work may also drop children off at school and also go to the store tlms causing a "passer by" trip liriled to the main trip of going to work.. An exanrple of"diverted" trip Happens when a trip is made to purchase a certain item at store "A" but instead has to also travel to store `B" or other facilities to finally obtain it. Reductions of trip end values are a matter of professional judgement based on local experience and geography. New Lane Miles ofRoad - Defined as the ANT in V ehicular Miles per Day /Capacity per Lane Mile in Vehicles per Day (currently 5500). See ANT above. Construction Cost -New Lane-Miles of Road X Construction Cost per Lane Mile of Road.. (Currently $504,600 per lane mile). Right of Way Cost -New Lane-Miles of Road X Right of Way Cost per Lane Mile of New Road. (Currently $ 21,766 per lane mile). Credits -Credits and the use thereof are defined in CPMC 11.12.110. An improvement fee credit maybe granted only for the cost of that portion of a qualified public improvement that exceeds the City's minimum standard facility size or capacity needed for the particular development property or project. Credits shall not exceed the calculated SDC. Section 2. Collection and Use of Chazee, (A) The City of Central Point shall collect the SDC in accordance with CPMC 11.12, Systems Development Charge for qualified public improvements (i) Prior to issuance of a building development permit, or construction permit of any kind, including connection to the street system, and (ii) When the City determines that increased usage of the arterial and collector system will occur, unless: (a) The SDC for the Development for which the permit has been issued has been paid in full, or (b) The Developer or pernrittee constructs the arterial or collector street to the increased capacity standazd as determined by the City and the cost of such construction exceeds the amourrt of SDCs coAected for such Development. Resolution No. 851 (061099) (iii) Charges and interest earned on the charges shall be used to pay for future arterial and collector street system improvements that are needed to increase the capacity of the system or to reimburse the City for unused capacity in the existing arterial and collector street system. Section 3. Methodoloev. (A) Based on the principles for the establishment of reimbursement fees and improvement fees in accordance with ORS 223.297 to 223.314, the methodology for the determination of the SDC shall consist of the following: (i) Determine the attributable new miles of daily capacity (ANT) created as a result of new development using: (a) Vehicular trip ends as listed in the "Trip Generation Maimal, 6th Edition, by ITE, adjusted to compensate for estimated percentage of "passerby trips" or "diverted link" trips. (b) Average trip length from National Personal Transportation Study (1995) with a maxinrurn 3.7 mile trip length determined for Central Point. (ii) Determine the lane mile capacity (5500 vehicles per day). (iii} Determine the lane mile cost as referenced in the 1999 Street Systems Development Charges Report ($504,600). (iv) In accordance with CPMC 11.12.110, deterniine Developer credits; if any, for costs ofa qualified public improvement associated with a capacity increasing project. Section 4. Svstems Development Charge Calculations. (A) Based on the methodology as specified in Section 3, the SDC is calculated by: [ANT /lane mile capacity) x Cost Per Lane Mile] -Credits =SDC (ANT/5,500 x $504,600) -Credits =SDC where, Attributable New Travel (ANT) =Vehicular Trip Ends per day x Average Trip Leugth/2; Vehicle Trip Ends are as listed in the "Trip Generation Manual", 6"' Edition, by ITE, adjusted to compensate for estimated percentage of "passerby" trips or "diverted link" trips (sununarized on the attached table); Resolution No. 85I (061099) Average Trip Length is from the "National Personal Transportation Study" (1995) with a maximum 3.7 mile trip length determined for the City of Central Point (summazized on the attached table). Details of these calculations aze provided in the City of Central Point Street Systems Development Charges Report approved on May 37, 1999; and attached hereto and by reference incorporated herein. The calculations meet the methodological requirements for both reimbursement fees and improvement fees, including compliance costs. Section 5. Schedule of Gharees. (A) Based on the 1999 report the City may impose the maximum SDC allowed as determined in Section 3 and Section 4 for facilities that expand the capacity of the collector and street arterial system. (B) The City shall provide for annual adjustment of cost factors used in the SDC calculation based on changes in the );ngineering News and Record Construction cost Index, and; (C) Perform a review and update of the Street SDC including die schedule of capacity increasing Capital Improvement projects for arterial and collector streets within one year after implementation and at 5 year intervals thereafter. Section C. Por purposes of ORS 310.145, the City hereby classifies this SDC fee as an "other fee". Section 7. The SDC established herein shall be effective on July I, 1999. ~~ t~~e. , 1999.
