HomeMy WebLinkAboutCouncil Resolution 688RESOLUTION N0. 688 A RESOLUTION APPROVING AN AMENDMENT TO THE CENTRAL POINT COMPREHENSIVE PLAN MAP AND ZONING MAP (37 2W 2CD Tax Lots 2500, 3000 and 3100) (Applicant: Blue Sky Partnership, Inc.) Recitals 1. This matter came before the City on applications for an amendment to the City's Comprehensive Plan map and zoning map, seeking to re-zone a .63-acre parcel of land located in the vicinity of Freeman Road, Bigham Road and South Ninth, from its current zoning designation of R-3, Multiple Family Residential, to C-4, Tourist and Office Commercial. 2. On March 8, 1994, the Central Paint Citizens Advisory Committee conducted a duly-noticed and advertised public hearing on the applications, and recommended approval. 3. On March 15, 1994, the Central Point Planning Commission conducted a duly-noticed. and advertised public hearing on the applications, and recommended approval. 4. On May 19, 1994, the Central Point City Council conducted a duly-noticed and advertised public hearing on the applications. The Council reviewed the written materials submitted by the applicant, the City staff reports, and heard testimony from all persons wishing to be heard. Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Nature of Application. This matter consists of two applications, one for an amendment to the Comprehensive Plan map, and the other for an amendment to the zoning map.. Both applications seek to re-zone a .63-acre parcel of land in the City from its current zoning designation of R-3, Multiple Family Residential use, to C-4, Tourist and Office Commercial use. Section 2. Approval Criteria. In order for an amendment to the Comprehensive Plan to be approved, Central Point Municipal Code 17.96.050 requires an applicant to establish that: A. There is a public need and justification for the change; and B. The proposed amendment is consistent with all applicable statewide planning goals.. 1 - RESOLUTION N0. 688 (052094) Section 3. Findings and Conclusions. A. The City Council. hereby adopts by reference the findings and conclusions contained in applicant's submitted "Findings of Fact" dated September 20, 1993, as well as the findings contained in the two City staff reports (Planning and Zoning Report, dated February 9, 1994, and Public Works Report, dated March 11, 1994) placed in the record, all of which are by this reference incorporated herein. B. The Council finds that applicant has established the public need and justification for the proposed amendment, and further finds that the amendment is consistent with all applicable statewide planning goals. Section 4. Approval. The within applications are approved. The Central Point Comprehensive Plan map and zoning map shall be amended so that the properties located at Township 37 South, Range 2 West, Section 2CD, Tax Lots 2500, 3000 and 3100 shall hereafter be designated as being within the. C-4, Tourist and Office Commercial use zoning district.
