HomeMy WebLinkAboutCouncil Resolution 692RESOLUTION NO. /09„2 A RESOLUTION APPROVING AN AMENDMENT TO CENTRAL POINT COMPREHENSIVE PLAN MAP AND ZONING MAP (37S 2W Section 11) (37 2W Section 12) (Applicant: Pacific Crest Properties, Inc.) Recitals 1. This matter came before the City on applications for an amendment to the City's Comprehensive Plan Map and Zoning Map, seeking to re-zone two parcels of land in the southeast quadrant of the City, specifically: (a) A 16.49-acre parcel from its current. zoning of Residential Low Density (R-1-6) to a proposed zoning of Residential High Density (R-3); and (b) A 4.6-acre parcel from its current zoning of Residential Medium Density (R-2) to a proposed zoning of Residential Low Density (R-1-6). Exhibit "1", attached hereto and by reference incorporated. herein, is an area map showing the parcels. 2. On March 8, 1994, the Central Point Citizens Advisory Committee conducted a duly-noticed and advertised public hearing on the applications, and recommended approval. 3. On March 15, 1994, the Central Point Planning Commission conducted a duly-noticed and advertised public hearing on the applications, and recommended approval. 4. On May 19, 1994, the Central Point City Council began a duly-noticed and advertised public hearing on the applications. The hearing was continued until June 2, 1994, at which time the City Council reviewed the written materials submitted by the applicant, City staff reports, and heard testimony from all persons wishing to be heard. Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Nature of Application. This matter consists of two applications, one for an amendment to the Comprehensive Plan Map and the other for an amendment to the Zoning Map. Bath applications pertain to the. re-zoning of two parcels of land in 1 - RESOLUTION NO. ~qa (060344) the southeast quadrant of the City, as set forth above. The applications seek to re-zone a 16.49-acre parcel from R-1-6 to R-3, and a 4.6-acre parcel from R-2 to R-1-6. Section 2. Approval Criteria. In order for an amendment to the Comprehensive Plan to be approved, Central Point Municipal Code 17.96.050 requires an applicant to establish that: A. There is a public need and justification for the change; and B. The proposed amendment is consistent with all applicable statewide planning goals. Section 3. Findings and Conclusions. A. The City Council hereby adopts by reference the findings and conclusions contained in the following exhibits, which are in the record: 1. Applicant's "Findings of Fact" dated November 4, 1993; 2. Applicant's "Supplemental Findings"; 3. Applicant's "Traffic Analysis; and. 4. Applicant's "Traffic Study" prepared by Hardey Engineering. B. The Council finds that, with the imposition of certain limitations on densities set forth below, the applicant has established the public need. and. justification for the proposed amendments, and further finds that the amendments are consistent with all applicable statewide planning goals. Section 4. Conditional Approval. The within applications are approved, subject to the condition set forth below. The Central Point Comprehensive. Plan Map and Zoning Map shall be amended as follows: A. The 16.49-acre parcel, fully described on Exhibit "2", attached hereto and by reference incorporated herein, shall. hereafter be designated as being within the Residential High Density (R-3) use zoning district; and B. The 4.6-acre parcel, fully described on Exhibit "3", attached hereto and by reference incorporated herein, shall hereafter be designated as being within the Residential Low Density (R-1-6) use zoning district. Conditions 1. The City finds that in order to mitigate the effects of additional traffic generated by the re-zoning of the 16.49-acre parcel, it is necessary to limit development densities on that parcel. Exhibit "4", attached hereto and by reference incorporated herein, shows the 16.49-acre parcel. The area 2 - RESOLUTION NO. ~ qa (060394) designated on Exhibit "4" as "R-3 20 Units Per Acre" shall not be developed to densities exceeding 20 units per acre, notwithstanding any other density standards set forth in the Central Point Municipal Code. The area designated "R-2 12 Units Per Acre" on Exhibit "4" shall not be developed to densities exceeding 12 units per acre, notwithstanding any other density provisions set forth in the Central Point Municipal Code.
