A RESOLUTION PERTAINING TO SETBACK NONCONFORMITIES AT 1062 PINE STREET
1. The Oregon Department of Transportation widening of Pine Street
decreased the front yard setback for the buildinq at. 1062 East PineStreet
from 13 to 7.5 feet. The property is zoned C-4, which requiresfront and
rear yard setbacks of 10 feet. The setback reduction caused the building at
1062 East Pine Street to becomenonconforming as to the front yard setback.
2. The Oregon Department of Transportation's relocation of Freeman
Road also resulted in the establishment of a secondary arterial street
setback of 50 feet measured from the centerline of the right-of-way. The
Freeman Road right-of-way is 64 feet. The building at 1070 East Pine Street
is located 8 feet from the south boundary of the property which is also the
north right-of-way line for Freeman Road.. The road relocation caused the
building at 1070 East Pine Street to become nonconforming as to the
secondary arterial setback.
3. The same property which includes the building at 1062 East Pine
Street, includes other buildings at 1064, 1070 and 1074 East Pine Street,
all of which are part of a multiple family apartment complex on land that
is zoned C-4. The C-4 zone does not allow apartments as either a permitted
or conditional use. Therefore, the apartments are nonconforming as to use.
The City has formally determined that the apartment use is a "Class ~B "'
nonconforming use under Chapter 17.56 of the Central Point Zoning Ordinance.
4. Unrelated to the Pine Street widening, the building at 1070 East
Pine Street encroaches into the rear setback area of the property. The
building at 1070 East Pine Street is nonconforming as to the rear yard
setback.
Now, therefore,
HE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT,
OREGON that, in consideration of the use and rear yard setback
nonconformities which now exist on the property, the additional setback
nonconformites at 1062 and 1070 East Pine Street produced by the widening
of Pine Street and the relocation of Freeman Road, does and will not
prevent the continued use of this property as an apartment complex or
prevent other changes to the use or buildings which are permitted by
regulations in effect at the time of such changes.
