HomeMy WebLinkAboutCouncil Resolution 473RESOLUTION NO. 473 A RESOLUTION EXEMPTING COMPETITIVE BIDDING CONTRACTS FOR PURCHASING AND LEASING (WITH PURCHASE OPTION) OF DATA PROCESSING EQUIPMENT PURSUANT TO SECTION 3 (11) AND SECTION 5 OF THE CONTRACT REVIEW BOARD RULES AND DECLARING AN EMERGENCY WHEREAS, the City Council of the City of Central Point is designated as the City's Contract Review Board pursuant to Central Point Municipal Code Section 2.04.01.0, and pursuant to said authority, on February 9, 1978, adopted rules governing public purchasing, and WHEREAS, said rules provide for the exemption under speci- fied circumstances of data processing contracts, and for the further exemption of emergency contracts under Sections 3 (11) and Section 5 of said rules, and WHEREAS, an emergency exists with respect to the present status of the City's existing data processing system in that the previous software vendor has discontinued business, no reliable vendor remains to provide service for data processing, the City's current software documentation for budget and general ledger is inaccurate, faulty and incomplete, and a new system must be implemented prior to July 1, 1987 in order to provide accurate and cost-effective accounting data for the conclusion of the current fiscal year and for preparation of the budget for the forthcoming fiscal year, and WHEREAS, pursuant to said rules, the City staff has made reasonable efforts to solicit written proposals from all ]mown vendors therefor, which vendors appear on a list composed by the Data Systems Division of the Executive Branch of the State of Oregon, the proposed software contractor, Far West Data Control, and the proposed hardware contractor, International Business Machines, Inc., have been selected on the basis of the most competitive offer in both. the cost and quality of the products to be purchased. or acquired, the City staff has prepared a written report to the Council setting forth in detail the names of the vendors, the reasons why competitive bidding was not appropriate and descriptions of the reasons why the proposed vendors were selected and other proposals were rejected, now, therefore, BE IT RESOLVED by the City Council of the City of Central Point, Oregon as follows: Section 1. The Council hereby finds and determines that the requirements of Section 3 (11) of the City's Contract Review RESOLUTIONd N0. 473 -1 (4/9/87) Board rules have been complied with with respect to exemptions for purchase of data processing hardware and software. Section 2. The Council further finds and determines that an emergency exists within the meaning of Section 5 of the Contract Review Board rules justifying exemption of said contracts. Section 3. The Council hereby authorizes and directs the Mayor and City Administrator to execute such contracts as are necessary to purchase data processing hardware and software as specified in Exhibit "A", attached hereto, and by this reference incorporated into the within resolution, provided that such contracts are awarded within sixty (60) days following the date of the within resolution.
