A RESOLUTION ESTABLISHING A WASTEWATER TREATMENT PLANT
REIMBURSEMENT FEE (SYSTEMS DEVELOPMENT CHARGE),
METHODOLOGY THEREFOR, AND IMPROVEMENT PLAN
WHEREAS, Central Point Municipal Code Chapter 11.12 establishes
systems development charges, the City is a member of the Regional
Sewer Rate Committee (RSRC) which establishes sewer charges for member
agencies utilizing the Medford Water Quality Control Plant (MWQCP) and
the RSRC has established'. reimbursement systems development charges for
capital improvement costs expended on the MWQCP; and
WHEREAS, new development in the City of Central Point will
benefit from such capital improvements and should pay a proportionate
and equitable share of the costs thereof, as determined by the
methodology set forth herein; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT,
OREGON, AS FOiLOWS:
Section 1. IMPROVEMENT PLAN. Pursuant to the Regional Sewer
Agreement of September, 1985, between Bear Creek Valley Sanitary
Authority, City of Central Point, City of Jacksonville, City of
Medford, and City of Phoenix, the City of Medford is responsible for
enlarging the capacity of the Plant, at such times as the City of
Medford determines that such expansion is necessary. The other
participants in the Agreement, including the City of Central Point,
have limited input as to when or how such expansion will. be
accomplished. In connection with the duty to perform expansion work,
the City of Medford has developed a capital improvement plan, listing
projects to be funded with wastewater treatment plant systems
development charge revenues, together with the estimated costs and
projected timing of such improvements. Such plan will be updated and
revised as the need arises. The City Council hereby adopts as its
improvement plan for this wastewater systems development charge
required by Oregon Revised Statutes 223.309, the City of Medford's
improvement plan. By this adoption, the City shall automatically
adopt, without further resolution, any and all future updates,
revisions and/or new improvement plans when such be adopted by the
City of Medford..
to addition to those capital improvements listed in the City of
Medford's improvement plan, the City of Central Point hereby adopts.
the improvement plan contained on Exhibit "A", attached hereto and by
reference incorporated herein. The purpose of the capital
improvements contained on Exhibit "A" is to replace obsolete sewer
pipe within the City of Central Point as necessary.

Section 2. DEFINtTIONS. As used in this resolution, the
following definitions. apply:
(a) "Wastewater" shall have the same meaning as the words
"sanitary sewer" have in Central Point Municipal Code
Chapter 11.12, (Ordinance No. 1657), which. is the systems
development charge enabling ordinance.
(b) "Connection to system" means the actual physical
connection to the wastewater system or the time of issuance
of a building permit or wastewater permit.
(c) "Change in usage" means an increase of too or more in
the. wastewater flows measured in gallons per day and/or
strength of wastewater flow measured in milligrams per liter
of biological oxygen demand (BOD) or suspended solids (SS)
from those originally used in the determination of the
system development charge for connection to the system.
(d) "Equivalent Residential Unit (ERU)" means the
wastewater flow used. by a single family residential unit,
which is 350 gallons per day of wastewater flow and 300
milligrams per liter of BOD and 300 milligrams per litre of
SS. The term "single family residence equivalent unit" has
the same meaning as "equivalent residential unit".
Except as provided above, all other terms used in this Resolution
shall have the same meaning as in Central Point Municipal Code Chapter
11.12 (Ordinance No. 1657).
Section 3. METHODOLOGY.
(a) The methodology used to establish the reimbursement fee
shall consider the cost. of then-existing facilities, prior
contributions by then-existing users, the value of unused
capacity, rate-making principals employed to finance
publically owned capital improvements, and other relevant
factors identified by the City Council. The methodology
shall promote the objective that future systems users shall
contribute no more than an equitable share of the cost of
then-exi ting facilities.
(b) Based upon the foregoing principals, the methodology
for the determination of the wastewater SDC shall consist of
the following:
(i) The number of ERU's in the plant shall be
determined by dividing the most recent capacity expansion,
which was 6.5 million gallons per day (mgpd) by the
wastewater flow, which is 350 gpd per equivalent residential
unit (ERU), which results in a total of 18,570 ERU's added
to capacity.

(ii) The cost of constructing the capacity expansion
($11,931,494.00) shall be divided by the number of ERUs
added by said construction (18,570) resulting in a
dollar/ERU charge of $643. When adjusted to a present-day
value to account for the cost of interest on the funds from
the time of construction, using the figure of 7b, the result
is $900.60 per ERU.
Section 4. SYSTEM DEVELOPMENT CHARGE CALCULATIONS.. Based on the
methodology specified above, the SDC indicated by the available data
is determined to be $900/ERU, and is considered a reimbursement fee.
Details. of the calculation are shown on Exhibit "B", attached to this
Resolution, and by reference incorporated. herein.
Section 5. SCHEDULE OF CHARGES. Based upon the foregoing, the
City of Central Point hereby imposes a wastewater SDC in the amount of
$900/ERU. Therefore, SDC's shall be paid in accordance with the
following table:

In case of a remodel in types 4-il which results in no increase in the
units on which the charge for a new building is calculated, the Systems
Development Charge for the re,aodel will'•ba calculated on the basis of the
fixtures added using the amounts in Item 12.
When ttie charges are changed From time to time, the prior schedule of
charges shall remain in effeot for all buildings for which a completed
application for building permit was filed. prior to the effective date of
the new schedule.
The definitions of the types of buildings and the types of sewer service
shall be as follows:
1. A single family residence shall be defined as a building containing one
kitchen, designed and/or used to house not more than one family, including
all necessary employees of such family, such building having a single sewer
service connection. Mobile homes occupying a separate lot and providing
permanent housing with a separate sewer connection shall. be classed as a
single family residence.
2. A multiple Family residence shall be defined as a building or a group
of buildings housing two or more families, living independently o£ each
other, a family being defined as one or more persons living as a single
house-keeping unit or household with sewer service being provided through
not more than one sewer connection. Common buildings in an apartment house
complex requiring sewer service shall be charged as commercial buildings
and that portion of buildings housing common laundry facilities shall be
charged as laundries and laundromats.
3. A mobile home park, including travel trailer parks, is defined as any
area or tract of land having a sewer connection and where sewerage
collection pipes are extended to two or more spaces occupied by or intended
to be occupied by a mobile home, travel trailer or motor home which are
defined as a vehicle with or without motive power which is designed, used
or intended for use as a place of human habitation, or as eating, sleeping
or living quarters or any combination thereof. A mobile home space is
defined as the individual location having a sewer hookup for each such
vehicle. For purposes of determining the system development charges for
mobile home parks' common buildings such as recreation halls, etc., shall
be charged as commercial buildings. Buildings housing laundry £acilities
shall be charged as laundries and laundromats and food or drink service
buildings shall be charged as food preparation and/or serving.
4. Schools are defined as any building or group of buildings used for
school purposes more than 12 hours per week, involving assemblage for
instruction, education or recreation. Schools may be public or private.
5. Churches shall be defined as a building or structure whose principal
use ie for worship and in which the incidental use for school or
recreational purposes is less than 12 hours per week. Church buildings
used for school purposes in excess of 12 hours per week shall be charged
the system-development charge per student capacity in addition to the
charge per 100 seats as a church.
6. General hospitals are defined as a building or structure used for the
temporary housing of ill or inured persons and containing facilities for
medical or surgical treatment of such persons. No additional charge shall
be made for laundry and food and drink preparation and serving facilities
in hospitals.
7. Convalescent hospitals or rest homes are defined as a building or
structure used for housing of persons convalescing from illness or injury
or persons requiring close personal care. No additional charge shall be
made for laundry and food and drink preparation and serving facilities
included in convalescent hospitals.
8. Hotels and motels are defined as a building or group of buildings used
for temporary housing of persons, such building containing rooms or units
not normally equipped with kitchen facilities and intended for use of
transient persons. Those areas within hotels and motels to be used for
preparation and serving of food and drink shall be charged at the SFREU for
food preparation and/or serving. Commercial areas within hotels and motels
including convention facilities and other such common areas other than
lobby areas shall be charged at the SFREU for commercial and dry industrial
areas. Areas used for laundry facilities in hotels and motels shall be
charged at the SFREU £or laundries and laundromats. Such additional
charges for food and drink, commercial and laundry shall be in addition to
the charge per roam or motel unit.
9. Food preparation and/or serving includes restaurants, taverns,
delicatessens and wholesale and retail bakeries, but does not include
canneries, dairies, cheese factories, packing houses and similar facilities
which shall be classified as "industrial" under Item 13.
10. Service stations and garages are defined as buildings used for
servicing and maintenance of automobiles, trucks and equipment.
11. Car washes are defined as buildings or structures used for washing of
vehicles.
12. Laundries and laundromats are defined as buildings or structures or
parts of buildings and structures used for housing and operating laundry
equipment..
13. Commercial buildings are defined as all buildings used for conducting
of wholesale or retail trade. Dry industrial buildings or structures are
those buildings or structures housing light industrial activities where use
of water and subsequent discharge of sewer does not occur in connection
with the industrial process. Warehouses and other storage buildings with
sewer connections are classified as dry industrial buildings.
14. Industrial buildings are defined as those buildings or structures
housing industrial activities using water and discharging waste to sewers.
15. Undefined buildings and sewer use are those. not defined above.
16. Additional loading or change of use is defined as an increased demand
for waste water treatment resulting from. replacement of an existing
structure or facility, addition to an existing facility, or a change in use
of an existing.£acility. The system development charge shall be determined
on the basis of the number of single family residence equivalent units with
the additional loading or the new use equivalent units of the original
facilities. No refund will be given if the change of use results in a
decreased sewer loading. Any addition to an existing single family
residence which does not result in an additional dwelling will be exempt
from additional charge.
The Regional Sewer Rate Committee shall appoint a Technical Committee
consisting of a representative from each of the participating agencies,
such representative to be technically qualified and knowledgeable in sewage
treatment matters. The function of the Technical Committee shall be to
determine the single family residence equivalent units. in the case of
application £or a sewer connection by an industry and in the case of
additional loading by an existing industry having a sewer coru~ection. Such
Committee shall also determine the single family residence equivalent units
in the event of an application for a sewer connection for a building not
defined in this listing of system development charges. In determining the
number of single family residence equivalent units to be assigned, the
Technical Committee shall consider the anticipated volume and strength of
sewage to be generated from the industry or other undefined connection in
relation to the volume and strength of sewage from an average single family
residence.. Determinations made by the Technical Committee shall be subject
to appeal to the Regional Sewer Rate Committee.
Section 6. COLLECTION OF CHARGE Effective July 1, 1991,
the wastewater treatment plant systems development charge is
payable to the City of Central Point upon connection to the
wastewater system or upon issuance of a permit to expand
equivalent fixture units connected to the wastewater system. The
Public Works Director shall collect such charges pursuant to
Central Point Municipal Code Chapter 11.12.090 (Ordinance No.
1657), and shall not issue such. permit until the charge has been
paid in full or arrangements for such payment have been made
pursuant to Central Point Municipal Code Chapter 1.1.12.090.
