MINUTES Commissioner Fish made a motion to approve the November 19, 1996 Planning Commission Minutes as written. Commissioner Dunlap seconded the motion. Jim Bennett reviewed the Planning Department Staff Report. Mike Thornton, reviewed the Public Works Staff Report. Herb Farber, 120 Mistletoe, Medford, came forward as agent for Noel Moore, the applicant. The public hearing was closed. Commissioner Johnson moved to adopt Resolution 373, approving the tentative plan for Minor Land Partition of 37 2W 03C Tax Lot 4400 (Noel Moore, applicant) subject to all conditions in the Staff Reports. The motion was seconded by Commissioner Dunlap. ROLL CALL VOTE: Curtis, yes; Dunlap, yes; Fish, yes; Gilkey, yes; Johnson, yes. Motion passed. Chairman Piland opened the Public Hearing. Jim Bennett reviewed the Planning Department Staff Report. Mike Thornton reviewed the Public Works Staff Report. Herb Farber, 120 Mistletoe, Medford, came forward as agent for Noel Moore, the applicant. Herb stated that he would be in favor of a Deferred Improvement Agreement for Beall Lane. Mr. Farber requested that Items 1 and 2 in the street and traffic portion of the Public Works Staff Report to be made voluntary for Tax Lots 3100 and 3200 instead of mandatory. Those lots are not a part of this application but they may wish to join in with that dedication of 10 feet and the deferred improvement agreement. This needs to be in writing from the commission. Jim Bennett stated that because of the lot line adjustment and since those two lots are not part of the partition or the tentative plan, it will be difficult for the City to require that these two properties dedicate an easement and sign a Deferred Improvement Agreement. We can amend the language to require the dedication and deferred improvement agreement for lot 3000 and request that the owners of the other two lots voluntarily dedicate that right of way and enter into a Deferred Improvement Agreement with the City. Bob Johnson, 654 Beall Lane, Central Point, came forward with a request that Mr. Moore put in the promised drainage system in back of the new properties, down and across where the property line adjustment will be located and continue over in back of lots 60 and 59 and catch that area also which would solve the flooding problem on his property. Herb Farber, agent for the applicant, stated that now that he is aware of the problem stated by Mr. Johnson, he will relay the information to the engineer and it will be resolved. CITY OF CENTRAL POINT PLANNING COMMISSION MINUTE December 17, 1996 -Page Three Commissioner Johnson made a motion to adopt Resolution 374 approving the Tentative Plan for Minor Land Partition of 37 2W 11 D, Tax Lots 3000, 3100, & 3200 (Noel Moore, applicant) subject to the conditions in the Staff Reports with the change in the language of conditions #1 and #2 under Streets/Traffic in the Public Works Staff Report to require tax lot 3000 to dedicate a 10 foot additional feet right-of-way and sign a Deferred Improvement Agreement and request that .the owners of the other two lots voluntarily dedicate that right of way and enter into a Deferred Improvement Agreement with the City. Chairman Piland opened the public hearing Jim Bennett reviewed the Planning Department Staff Report. Mike Thornton reviewed the Public Works Staff Report. Mr. Thornton stated that the City has asked for the storm drain system in this development to provide for offsite runoff onto the subdivision property and runoff from the streets and from each lot. That sentence is to be amended to include offsite runoff and especially consider the runoff from the southwest adjoining properties that appeared to have been blocked by prior development. James May, District Engineer, Bear Creek Valley Sanitary Authority, 1315 South Pacific Highway, Medford, reviewed the letter from BCVSA concerning this project. BCVSA is concerned that the plans show that the Sanitary Sewer will go around Lot 28 and that is an untenable situation as far as maintenance to that system. It would mean two manholes in the back yard and BCVSA would have to access both manholes with a very large truck to clean the lines. BCVSA would prefer to have the existing stub that is through Lot 2, Beall Estates Phase 1 at that common corner of lot 1, lot 2 and lot 28, be directly extended out into the cul-de-sac before it proceeds up the cul-de-sac. The project will not proceed without the approval of BCVSA. Chairman Piland closed the public hearing. Commissioner Fish made a motion to adopt Resolution 375 to approve the Tentative Plan for Beall Estates, Phase II, 37 2W 11 D Tax Lots 3000, 3100, & 3200 (Noel Moore, applicant) to include all conditions on the Staff Reports and also to include taking care of the storm drainage for Mr. Bob Johnson's property. Jim Bennett reviewed the request to operate a Massage Therapy business in the downtown business district and the uses permitted in Zone 3. Mr. Bennett stated that the City can require a copy of the State License as a condition prior to issuing a Business License. Commissioner Fish moved to approve the Similar and Compatible Use request relating to massage therapy in the C-3, Downtown Business District with the condition that the City require a copy of the operator's State License. Commissioner Dunlap seconded the motion. ROLL CALL VOTE: Curtis, yes; Dunlap, yes; Fish, yes; Gilkey, yes; Johnson, yes. Motion passed. The commission found that massage therapy to be a similar and compatible use in Zone C-3. VII. MISCELLANEOUS Jim Bennett reviewed the current projects in Central Point. PLANNING DEPARTMENT STAFF REPORT Date of Hearing: January 21, 1997 To: Central Point Planning Commission From: James H. Bennett, AICP Planning Director Subject: Variance and Site Plan Review Applications for Crater Iron expansion. (372W03 DC-2900,3000) The applicant, Conrad Morse of Crater Iron Inc., has applied for a Variance and a Site Plan Review that would allow the expansion of an existing awning and crane support at the facility. The property is located at 419 N. Front Street in M-1 and M-2 zoning districts. Authority: CPMC 1.24.020 invests the Planning Commission with the authority to hold a public hearing and render a decision on any application for a Variance and a Site Plan Review. Notice of the required public hearing was effected in accordance with CPMC 1.24.060. Background: According to Conrad Morse, Crater Iron Inc. purchased the parcel in 1971 and the city rezoned the largest parcel (Tax Lot 2900) from M-1 to M-2. City records indicate that the rezoning occurred on June 1st, 1971 when the City Council adopted Ordinance 1020.. Discussion: The applicant is requesting a variance to the rear yard setback and the minimum off-street parking requirement. CPMC 17.48.070 requires that properties in the M-1 zoning district provide a setback of 10 feet for rear property lines. The enclosed site plan depicts the structure to be located within 1 foot of the rear property line. CPMC 17.64.040 (I-1) requires that assembling and manufacturing businesses provide not less than two spaces per three employees on the two largest shifts, or, one space per 500 square feet of gross floor area, whichever is greatest. The gross floor area for the Crater Iron facility is approximately 15,500 square feet, thus requiring a minimum of 31 spaces. Crater Iron currently has 14 spaces available. The type of addition proposed at the Crater Iron facility will not reflect any additional changes in the current parking demands. The M-1 zoning ordinance requires that raw materials be stored within a sight restrictive fenced area. Mr. Morse has assumed that Tax Lot 3000 has always been zoned M-2 and currently has iron beams stored on the parcel. The Jackson County Assessor has listed Tax Lot 3000 as M-2 zoning in the public record. Mr. Morse would like to pursue a zone change from M-1 to M-2. The Planning Commission in granting Variance(s) shall find that: 1. The variance(s) will provide added advantages to the neighborhood or the city, such as beautification or safety. 2. The variance(s) will not have any significant adverse impacts upon the neighborhood. 3. The variance(s) will utilize property within the intent and purpose of the zone district: 4. Circumstances affect the property that generally do not apply to other property in the same zoning district. 5. The conditions for which the variance(s) are requested were not self-imposed through the applicant's own actions, nor the actions of the applicant's agents, employees or family members. The Planning Commission in approving, conditionally approving, or denying the plans submitted, the Planning Commission shall base their decision on the following standards: A. Landscaping and fencing and the construction of walls on the site in such a manner as to 2 cause the same to not substantially interfere with the landscaping scheme of the neighborhood, and in such a manner as to use the same to screen such activities and sights as might be heterogeneous to existing neighborhood uses. The Planning Commission may require the maintaining of existing trees for screening purposes and for sound and sight insulation from existing neighborhood use. The applicant does not propose any new landscaping at this time. The project area is surrounded by M-1 and M-2 parcels to the north, west and south and by C-5 to the east. B. Design, number and location of ingress and egress points as to improve and to avoid interference with the traffic flow on public streets. Access to the site is obtained exclusively through Front Street. Visibility north and south on Front Street is good and the presence of a center traffic island facilitates relatively safe turns in and out of the facility. C. To provide off-street parking and loading facilities in such a manner as is compatible with the use for which the site is proposed to be used and capable of use, and in such a manner as to improve and avoid interference with the traffic flow on public streets. D. Signs and other outdoor advertising structures to ensure that they do not con#lict with or deter from traffic control signs or devices and that they are compatible with the design of their buildings or uses and will not interfere with or detract from the appearance or visibility of nearby signs. The applicant has not proposed any new signage at this time. E. Accessibility and sufficiency of fire fighting facilities to such a standard as to provide for the reasonable safety of life, limb and property, including, but not limited to, suitable gates, access roads and fire lanes so that all buildings on the premises are accessible to fire apparatus. Jackson County Fire District 3 responded with "no comment" on this project. Recommendation: Staff recommends that the Planning Commission take one of the following actions: 1. Adopt Resolution No._ and approve the Variance and Site Plan Review expansion at Crater Iron, based on the findings of fact and staff conclusions contained in the record and subject to the recommended conditions of approval; or 2. Deny the proposed Variance and Site Plan Review; or 3. Continue the public hearing for the Variance and Site Plan Review at the discretion of the Commission. We always felt that tax lot 3000 was zoned M-2, so it came as a surprise that the records show a M-1 zone. We intend to request a zone change from M-1 to M-2 to be consistent with our requirements. We have owned our property since 1971 and we plan on making this location our home for now and into the future. Any testimony or written comments must be related to the criteria set forth above. At the conclusion of the review the Planning Commission may approve or deny the Site Plan Application and the Variance Application. City regulations provide that the Central Point City Council be informed about all Planning Commission decisions. ~~ ~~~ i4. EXHIBIT "E" CONDITIONS OF APPROVAL 1. The project shall be constructed in accordance with the approved site plan. 2. A building permit shall be obtained for the construction. 3. The site plan approval shall expire in one year, January 21,1998 unless a building permit has been issued and construction has commenced and diligently pursued toward completion. 4. The portion of the project located in the M-1 zoning district must conform to CPMC 17.48.030. All raw materials, finished products, machinery and equipment, with the exception of automobiles and trucks normally used in the business, shall be stored within an entirely enclosed building or sight-obscuring, nonpierced fence not less than six feet in height. 1, ~~
