MINUTES Commissioner Johnson made a motion to approve the October 1, 1996 Planning Commission Minutes as written. Commissioner Fish seconded the motion. Public-Hearing -Review and determination regarding Conditional Use , . Permit Application for Drive-ih Fast Food Restaurant (Burger Kingl and review and determination of Site Plan Application located at 372W02D Tax Lot 24001 (Agent: Dennis Hoffbuhrl Chairman Piland opened the public portion of the meeting.. Jim Bennett, Planning Director, reviewed the Planning Department Staff Report. Mr. Bennett stated that this project has been reviewed by Fire District 3 and they have found it to be acceptable. Jim stated that he wished to incorporate Exhibits D & E in the Planning Department Conditions and the Public Works Department Conditions of Approval. There was no ex-parte communication or conflicts of interest. Chairman Piland questioned the number of handicapped parking spaces shown on the plan. Jim Bennett stated that the Planning Department Staff Report on page 4, Paragraph C, should show 3 handicapped parking spaces rather than 4. Jim explained that this is access to the Chevron Station if, in the future, there is a median placed on Pine Street, otherwise there would be no access for traffic to go directly into the Chevron Station. It also gives access to the station so the traffic from Burger King or Pilot property do not have to go out onto Pine Street and then back to the station. Dennis Hoffbuhr, agent for the applicant, came forward on behalf of the application. Mr. Hoffbuhr stated that he concurred with the Staff Report. He stated that his office was representing the builders that. are going to lease to Burger King. Jim Bennett reviewed the Transportation Report from David Evans and Associates.. Subsequent to the initial traffic study, a supplemental report was done. These reports are being studied by O.D.O.T. and Jackson County and they had no comment. Chairman Piland closed the public portion of the meeting. Commissioner Johnson made a motion to adopt Resolution 367 approving the Conditional Use Permit-Application for Drive=in:Fast Food. Restaurant (Burger King) and to approve the Site Plan Application located at (372W02D Tax Lot 2400) (Agent: Dennis Hoffbuhr) subject to the conditions in the Staff Reports- including Exhibits D and E. Commissioner Fish, Vice Chairman, opened the Public Hearing. Jim Bennett reviewed the Planning Department Staff Report. Jim stated that one correction should be made in Exhibit D on Page 31: Condition #7 should be removed. There were no other conflicts of interest and no ex-parte communications. - 2 CITY OF CENTRAL POINT PLANNING COMMISSION MINUTES November 5, 1996 -Page Three For the record, Valerie Rapp said that she owns a house in the 400 block of 10th Street, but this project did not effect her. Alex Forrester, agent for the applicant, 303 N.E. "E" Street, Grants Pass, came forward on behalf of the application. Mr. Forrester passed around Exhibit "F". He used visuals and discussed the plans for the Senior Center. Sue Riegel, agent for the applicant, 303 N.E. "E" Street, Grants Pass, came forward on behalf of the application. Sue described the success of a similar project in Klamath Falls. Hanan Bowman, Oregon Housing Community Services Department, 938 S.E. King Street, Roseburg, OR., came forward on behalf of the application. Mr. Bowman discussed the criteria for receiving grants from the state. Commissioner Fish declared a 5 minute break at 8:22 p.m. Commissioner Fish reopened the meeting at 8:30 p.m. Those that came forward in favor of the application were: David Keil, 1020 Arroyo, Central Point. Barbara Pfahl, 5597 Kane Creel< Road, Central Point Stan Snook, 3286 Snowy Butte Lane, Central Point, read a letter from Phyllis Hilkey, and made a presentation from himself on behalf of the application. Mr. David Nelson, 1434 Pleasant Street, Medford. Ms. Debbie Dambrowsky, 821 Turra Linda Dr., Central Point Richard Watson, 555 Freeman, Central Point Gwen Snook, 3286 Snowy Butte Lane, Central Point. Those that came forward in opposition to the application were: Mr. Tom Chadwell, 825 N. 10th Street, Central Point, came forward in opposition to the application. Steve Froling, 936 Crest Dr., Central Point, OR Chris Schemanski, 1020 N. 10th St., Central Point. Mr. Bowman, Oregon Housing and Community Services Department, stated that it does not matter who owns to the property, the land use restrictive covenant that will be required to be recorded will go with to the property for a minimum of 51 years. Whoever owns those buildings will be required to maintain the property, as it is indicated originally in the grant, as senior housing. Commissioner Fish closed to the public hearing. Jim'Bennett suggested adding a Condition; Condition #10;- o the -- "`Conditions of Approval which states: The occupancy of the units will- be restricted to senior citizens aged 62 years or older. Commissioner Johnson made a motion to adopt Resolution No. 368 approving the Planned Unit Development on Gloria Dei Lutheran Church property (372W03AD, Tax Lots 4700 and 9100) (Applicant: Gloria Dei Lutheran Church) subject to all of the conditions in the staff reports and the exhibits, and adding two conditions: (1) condition #10 which states: the occupancy of the units will be restricted to the senior citizens aged 62 years or older and (2) add Condition #11 which states: the applicant shall keep all the existing trees. Review and Determination regarding a Site Plan Application for Central Point Wrecking (Applicant: A. J. McClearvl Ken Gerschler reviewed to the Planning Department Staff Report. Commissioner Fish made a motion to the adopt Resolution #369 to approve to Site Plan Application for Central Point Wrecking (Applicant: A.J. This is concerning a 10 foot wide strip of land originally dedicated to the city. Commissioner Fish ma e a motion to recommend approval to vacate the Right-of-Way along nor h side of Beall Lane adjacent to Jackson Creek Estates. Bennett, AICP Planning Director Subject: Site Plan Review for Milton and Kathleen Gorden (Tax Lot 372W3DD-7000). Summary Thomas J. Sharpe as an agent for Milton and Kathleen Gorden, has requested a review of the site plan for new construction and remodeling of the commercial building located at 155 North First Street. The project site is approximately 0.38 acres and is located at the corner of 1st and Manzanita Streets. The zoning designation of the site is C-5, Thoroughfare Commercial. thori _ CPMC 1.24.020 invests the-Planning Commission with the authority to render a decisiomon any Site Plan Review application. Notice of the public hearing was effected in accordance with CPMC 1.24.060. Back ound: On July 2, the Central Point Planning Commission granted approval to a Variance to allow a reduction in the amount of required off-street pazking and a reduction in the required front and side yard setbacks for the commercial building located at 155 North First Street. Discussion: Milton and Kathleen Gorden are proposing to enlarge and remodel the commercial building located at 155 North First Street. The proposed improvements include a remodel of the existing 3000 foot building and the constructian of a 3467 square foot addition. E? Site Plan Standards: CPMC 17.72.040 sets out the standards that are to be used as the basis for any decision on a Site Plan application. A. Landscaping and fencing must be consistent with the neighborhood and used to screen activities and uses that may impact existing neighborhood uses. The Gorden's project is bordered by two public streets and two alleyways. A 15 foot landscaped strip is proposed adjacent to the 1st and Manzanita intersection. B. Ingress and egress points must be designed and located to maintain and improve traffic flows on public streets. Access to the site will be from on 1st Street only. C. Off-street parking and interior circulation must be adequate to serve the site and maintain good pedestrian and vehicle traffic flows. The Gorden's project will provide 23 off-street parking spaces including one handicapped parking space. D. Signs for the project must be designed and located to be compatible with the use and not interfere with traffic control devices or traffic flows. The Site Plan does not include a sign at this time. E. The site must be designed to be accessible to fire apparatus and have adequate fire fighting facilities. Fire apparatus will have access to the site from 1st and Manzanita Streets and from the alleyways located to the West and North. .: F. The project must comply with all applicable city ordinances and regulations and must.be aesthetically acceptable in relation to the neighborhood and the City of Central Point. Staff finds that the Gorden's project is in compliance with all city ordinances and regulations. Recommendation• Staff recommends that the Planning Commission take one of the following actions: 1. Approve the Site Plan application for the remodel and new construction at Milton and Kathleen Gorden's commercial buitding based on the information and staff conclusions contained in the record and subject to the recommended conditions of approval; or 2. This project is in the Thoroughfare Commercial (C-5) Zone. The proposed improvements include the addition of 3,467 square £eet to the facility and minor remodeling to the existing structure. On-site improvements include landscaping, parking.and utility corisections. The specific site is located on Tax Lot 7000 of Jackson County Tax Assessor Map Page 372W03DD. CRITERIA FOR DECISION The requirements for approval of Site Plans are set forth in Chapter 17 of the Central Point Municipal Code, relating to Thoroughfare Commercial, General Regulations, Off-street Parking and Loading, Site Plan, Landscaping and Construction Plans. The proposed plan is also reviewed in accordance to the City's Public Works Standards. PUBLIC COMMENTS Any person interested in commenting on the above-mentioned land use decision may submit written comments up until the close of the meeting scheduled for Tuesday, November 19, 1996. 2. For additional information, the public may contact die Planning Departrnent at (541) 664- 3321 (ext. 231) SCIMMARY OF PROCEDURE At the meeting, Plarutiitg Commission will review the applications, technical staff reports, hear testimony from the applicant, proponents, and opponents and hear arguments on the application. Any testimony or written comments must be related to the criteria set forth above. At the conclusion of the review the Planning Commission may approve or deny the Site Plan Application. City regulations provide that the Central Point City Council be informed about all Plazuung Commission decisions. 13 EXHIBTP "D" RECOMMENDED CONDTTIONS OF APPROVAL 1. The project shall be constructed in accordance with the approved site plan. 2. The proposed landscaping and irrigation shall be installed prior to occupancy. Landscaping shall be continuously maintained in a healthy, growing condition. 3. A building permit shall be obtained for the building addition and irrigation system. 4.Off-street parking shall be provided as shown on the approved site plan. All off-street parking shall be located outside of any public right of way. Any modification to the off-street parking shall be submitted to the Planning Commission for approval prior to occupancy. 5. A sign permit shall be obtained for all signage. 6. The applicant shall submit to the City's Public Works Department plans and specifications for all improvements proposed for construction or modification within the City's rights-of--ways or easements. All construction shall conform to the City's Standard Specifications and Uniform Standard Details for Public Works Construction and such other special specifications herein. No construction shall commence until the Public Works Department has reviewed, approved, and issued a permit for the proposed improvements. The developer shall pay for all costs associated with the design and installation of the improvements specified on these plans. Streets/1Yatlic: 1. Storm Drainage: The developer shall construct an adequately sized storm drainage system to provide for onsite runoff. The drain system shall wnnect to a public system adequate to handle the increased runoff: The design shall use the rainfallfmtensityeurve obtained from the Public Works Department for hydrology calculations. Sanitary Sewer: 1. The applicant shall conform to the requirements of BCV SA for any new service connection to the 10- inch sanitary sewer located in Manzanita Street. Water System: 1. The construction shall comply with Oregon Health Division requirements for Backflow prevention. IJ Public Work's Staff Report 11/13/96 Site Work: 1. Three of the proposed parking spaces appear to lie partially in the right-of--way for 1st Street - which would be in violation of the city code. 2. Provide agrading/paving plan with the construction drawing submittal to the Public Works Department. All structures shall have roof drains and area drains with positive drainage away from the structure and drain lines connected to a curb drain, or an approved stonn sewer. Rights-of-ways/Easements: 1. The construction drawings shall show all right-of--way and easement boundaries associated with the project. The project site is approximately 1.62 acres and is located along the east side of Front Street, opposite Central Point Lumber. The zoning designation of the site is C-5, Thoroughfare Commercial. Notice of the publichearing was effected in accordance with CPMC 1.24.060. Discussion: The Grange CO-OP would like to remodel the interior and exterior of the existing retail store located at 89 Alder Street. The current site meets the minimum parking requirements as addressed in CPMC 17.64 and no new landscaping is proposed at this time. The exterior remodel of the building is comprised of fascia, sign and building entrance improvements. The Site Plan depicts a series of options that the Grange CO-OP would like to construct. ~7 Site Plan Standards CPMC 17.72.040 sets out the standards that are to be used as the basis for any decision on a Site Plan application. The applicant has submitted supporting documentation in support of these required standards. Staff has reviewed this documentation and concludes that the site plan as submitted is in compliance with all site plan standards and regulations subject to the recommended conditions of approval. This project is in the Thoroughfare Commercial (C-5) Zone. The proposed improvements include re-roofing and replacement of door headers. It also includes a -new canopy structure over the existing main west entrance. These improvements will not change the . footprint or the squaze footage of thebuilding. CRITERIA FOR DECISION The requirements for approval of Site Plans .are set forth in Chapter 17 of the Central Point Municipal Code, relating to Thoroughfare Commercial, General Regulations, Off-street Parking and Loading, Site Plan, Landscaping and Construction Plans. The proposed plan is also reviewed in accordance to the City's Public Works Standazds. PUBLIC COMMENTS 1. Any person interested in commenting on the above-mentioned land use decision may submit written comments up until the close of the meeting scheduled for Tuesday, November 19, 1996. 2. The project shall be constructed in accordance with the approved site plan. 2. A building permit shall be obtained for the construction. 3.
