HomeMy WebLinkAboutCouncil Resolution 498RESOLUTION NO. 498 RESOLUTION APPROVING MINOR LAND PARTITION (Dennis C.W. Smith and Gina Smith., Applicants) WHEREAS, applicants Dennis C.W. Smith and Gina Smith have filed their application for a minor partition of property situated at 1642 Beall Lane, Central Point, Oregon, described in the Jackson County Assessor's records as 37 2W 10DA, TL 300, and WHEREAS, the Planning Commission of the City on the 3rd day of May, 1988, by Planning Commission Resolution No. 139 recommended approval thereof with conditions as set forth hereinafter, and WHEREAS, a public. hearing was held thereon by the Central Point City Council on the 9th day of June, 1988, at which time the Council received the staff report, planning commission report and evidence thereon., now, therefore, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT AS FOLLOWS: Section 1. That the recommendation of the Central Point Planning Commission and the proposed findings of fact and conclusions submitted by the applicants, which. findings and conclusions are attached hereto and by this reference incorporated into the within resolution, be and the same are hereby, ratified and adopted by the Council. Section 2. That said application for minor land. partition be, and same is hereby, approved, subject to the following conditions as authorized by ordinance: a. Applicant shall be required to dedicate a 30 foot strip of land along the eastern boundary of Parcel Two (2) of the subject property for public street purposes upon request by City. b. Applicant will be required. to dedicate a 10 foot strip of land along the southern boundary of both Parcels One (1) and. Two (2) of the subject property for public street purposes upon request by City. c. Applicant shall sign a deferred improvement agreement agreeing to construction of storm drains, street lights, sidewalks, streets, curbs and gutters and to inclusion in a local improvement district for payment thereof, and waiving any rights of remonstrance relating thereto, upon request by City. RESOLUTION NO. 498 - 1 (060688) d. The foregoing conditions shall be reduced to written form of agreement in a form suitable for recording in the official records of Jackson County, Oregon, specifying that said conditions shall constitute obligations upon both of the subject parcels which shall run with the land and be binding upon applicants' heirs, successors and assigns. Said agreement shall include an adequate legal description, to be furnished at applicants' expense, and shall be recorded forthwith.
