HomeMy WebLinkAboutCouncil Resolution 490RESOLUTION NO. 490 A RESOLUTION ADOPTING FINDINGS AND CONCLUSIONS AND APPROVING MINOR LAND PARTITION APPLICATION OF DANIEL AND LAURA LEE PATTERSON WHEREAS, an application for a minor land partition has been made by Daniel and Laura Lee Patterson for property situated at 3385 Snowy Butte Lane within the City, a more particular descrip- tion is attached hereto, marked Exhibit "A", and which is by this reference incorporated into the within resolution, and WHEREAS, the Central Point Planning Commission has reviewed and approved the application, and public hearing was held before the City Council on the 17th day of December, 1987, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section t. The relevant criteria applicable to the within application are as follows: (a) The Comprehensive Plan designates the site as single family residential. (b) The Zoning Ordinance designates the site as R-1. (c) Central Point Municipal Code Section 16.44.010 D defines "minor partition" as a partition which does not include the creation of a road or street. (d) Central Point Municipal Code Section 16.44.040 A requires the applicant to provide for the installation of all necessary public improvements as a condition of approval. (e) Central Point Municipal Code Section 17.20.050 A, B and C specify the minimum lot area requirements for creation of a lot in the R-1 zone. (f) Central Point Municipal Code Section 16.44..050 requires access to flag lots to be no less than 20 feet wide. Section 2. The City Council hereby finds as follows: (a) The proposal is in compliance because the applicant has a deferred improvement agreement with the City to provide for the necessary public improvements at such time as the City requires the same. RESOLUTION N0. 490 - 1 (121587) (b) The proposal meets the minimum lot area requirements for R-1 zone. (c) The proposal provides for a 20 foot easement for ingress, egress and service to the parcel being created. (d) The proposal provides for the required dedication of property to extend the Snowy Butte Lane right-of-way. Section 3. The Council finds that the record herein and the findings therefrom support the conclusion that the proposal is in compliance. with the City's Comprehensive Plan and the applicable standards of the City Zoning and Subdivision Code, and the proposed minor land partition application is hereby APPROVED subject to compliance with the relevant requirements of the Public Works Department, Fire and Life Safety Regulations and the Uniform Building Code.
