A RESOLUTION AUTHORIZING AND DIRECTING
THE CITY ADMINISTRATOR TO INSTITUTE FORECLOSURE
PROCEEDINGS ON DELINQUENT ASSESSMENTS
WHEREAS, the City of Central Point has previously passed
ordinances assigning the cost of certain public improvements
within the City against properties specially benefitted thereby,
and
WHEREAS, the City has been required to pay the costs thereof
and by statute and Charter is authorized to foreclose upon
delinquent assessment liens, and
WHEREAS, the assessment liens on Exhibit "A", attached
hereto and by this reference incorporated into the within
Resolution, are delinquent in excess of one year, all of said
assessments being bonded and therefore subject to foreclosure
proceedings, now, therefore,
BE IT RESOLVED BY THE CITY OF CENTRAL POINT, OREGON, that:
Section 1. The list of delinquent assessments attached
hereto, marked Exhibit "A" and incorporated into the within
Resolution, is hereby adopted, ratified and confirmed by the
Council, and the "total" sums listed for each of the assessment
liens are hereby declared to be due and payable at once, pursuant
to ORS 223.270, due to the default in payment of the sums due as
listed.
Section 2. The City Administrator is directed to institute
foreclosure proceedings on the properties described in said
Exhibit "A" and against each of the property owners thereof,
pursuant to ORS 223.510, et seq., or ORS 223.610, et seq., at his
election.
Passed by the Council and signed by me in authentication of
its passage this 29th day of September , 1987.
