HomeMy WebLinkAboutCouncil Resolution 748RESOLUTION NO. 748 A RESOLUTION APPROVING AN AMENDMENT TO THE CENTRAL POINT COMPREHENSIVE PLAN MAF AND ZONING MAP (37 2W 2D Tax Lots 1800, 1901, 2.300 and 2400) (37 2W 11D Tax Lot. 101) (Applicant: Pilot Corporation) Recitals 1. This matter came before the. City on applications for an amendment to the City's Comprehensive Plan map and zoning map, seeking to re-zone 13.62 acres of land located south of Pine Street and east of I-5, from its current zoning designation of Bear Creek Greenway to C-4, Tourist and Office Commercial. 2. On April 16, 1996, the Central Point Planning Commission conducted a duly-noticed and advertised public hearing on the applications., and. recommended approval. 3. On April 18, 1996, the Central Point City Council conducted a duly-noticed and advertised public hearing on the applications. The Council reviewed the written materials submitted by the applicant, City staff reports, and heard testimony from all persons wishing to be heard.. Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Nature of Application. This matter consists of two applications, one. for an amendment to the Comprehensive Plan map and the other for an amendment to the zoning map. Both. applications seek to re-zone 13.62 acres of land in the City from its current zoning designation of Bear Creek Greenway to C-4, Tourist and Office Commercial use. Section 2. Approval Criteria. In order for an amendment to the Comprehensive Plan to be approved, Central Point Municipal Code Section 17.96.050 requires an applicant to establish that: A. There is a public need and justification for the change; and B. The proposed amendment is consistent with all applicable statewide planning goals.. Section 3. .Findings and Conclusions. A. The City Council hereby adopts by reference the findings. and conclusions contained in applicant's submitted ~~Amended Findings of Fact and l - RESOLUTION NO. 748 (041996) Conclusions" dated. December 15, 1995, as well as the findings contained. in the City staff report dated April 8, 1996, placed. in the record, all of which are by this reference incorporated herein. B. The Council finds that applicant has established the public need and justification for the proposed amendments, and further finds that the amendments are consistent with all applicable statewide planning goals. Section 4. Approval. The within applications are approved, subject to the following condition: Penninger Road shall be extended south as required by the Planning Director in connection with any site plan approval on the properties. The Central Point Comprehensive Plan map and zoning map shall be amended so that the properties located at Township 37, Range 2W, Section 2D, Tax Lots 1800, 1901, 2300 and 2400; and Township 37, Range 2W, Section 11D, Tax Lot 101 shall hereafter be designated as being within the C-4, Tourist and office Commercial use zoning district.
