A RESOLUTION RELATING TO CENTRAL POINT'S ACCEPTANCE
OF THE STATE OF OREGON COMMUNITY DEVELOPMENT GRANT' FUNDS
FOR WOODSTOVE REPLACEMENT AND HOUSING REHABILITATION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL
POINT, OREGON, AS FOLLOWS:
Section 1. The City of Central Point's Finance Director is
hereby appointed as the Certifying Officer for the 1995 Grant
Contract #H95021 between the City of Central Point and the State
of Oregon to use Community Development Block Grant funds for
Woodstove Replacement and Housing Rehabilitation in the City and
surrounding County neighborhoods.
Section 2. The City hereby finds that the following
activities proposed in its 1995 Oregon Community Development
Grant project for the Central Point Woodstove Replacement and
Housing Rehabilitation are exempt from environmental review
requirements because they are defined as exempt activities in
Part 58.34 and they consist solely of:
Grant Administration (Exempt under 58.34(a)(3))
Environmental Studies (Exempt under 58.34(a)(1))
Section 3. A. The City of Central Point recognizes that
discrimination in the sale, rental, lease, advertising of sale,
rental or lease, financing of housing or land to be used for
construction of housing, or in the provision of brokerage or
rental services because of race, color, sex, disability (physical
or mental}, familial status (children) or national origin is
prohibited by Title VIII of the federal Fair Housing Amendments
Act of 1988. It is the policy of the City of Central Point to
support the Fair Housing Amendments Act of 1988 and to attempt to
ensure equal opportunity in housing for all persons regardless of
race, color, religion, sex, disability (physical and mental),
familial status (children) or national origin.
B. Within the resources available to the City of Central
Point through city, county, state, federal and community
volunteer sources, the City of Central Point will assist all
persons who feel they have been discriminated against because of
race, color, religion, disability (physical and mental), familial
status (children) or national origin in the grocess of filing a
complaint with the Oregon Civil Rights Division or the U.S.
Department of Housing and Urban Development, Seattle Regional
Office Compliance Division, so that such persons may seek equity
under federal and state laws.

C. The City shall publicize this resolution and through
this publicity shall cause real estate brokers and sellers,
private home sellers, rental owners, rental property managers,
real estate and rental advertisers, lenders, builders,
developers, home buyers and home or apartment renters to become
aware of their respective responsibilities and rights under the
Fair Housing Amendments Act of 1988 and any applicable state or
local laws or ordinances.
D. The City's publicity will at a minimum include, but not
be limited to:
1. The printing, publicity and distribution of this
resolution;
2. The distribution of posters, flyers, pamphlets and
other applicable Fair Housing information provided by local,
state and federal sources, through local media of community
contacts; and
3. The publicizing of locations where assistance will
be provided to those seeking to file a discrimination complaint.
Section 4. A. The City will replace all occupied and
vacant occupiable low/moderate-income dwelling units demolished
or converted to a use other than as low/moderate-income housing
as a direct result of activities assisted with funds provided
under the Housing and Community Development Act of 1974, as
amended, as described in 24 CFR 570.488(b).
B. All replacement housing will be provided within three
years after the commencement of the demolition or conversion.
Before entering into a contract committing the City to provide
funds for an activity that will directly result in demolition or
conversion, the City will make public by publication in a
newspaper of general circulation and submit to the Oregon
Economic Development Department the following information in
writing:
1. A description of the proposed assisted activity;
2. The location on a map and number of dwelling units
by size (number of bedrooms) that will be demolished or converted
to a use other than as low\moderate-income dwelling units as a
direct result of the assisted activities;
3. A time schedule for the commencement and completion
of the demolition or conversion;
4. The location on a map and the number of dwelling
units by size (number of bedrooms) that will be provided as
replacement dwelling units. If such data are not available at
the time of the general submission, the City will identify the
general location on an area map and the approximate number of
dwelling units by size and provide information identifying the
specific location and number of dwelling units by size. as soon as
it is available;
5. The source of funding and a time schedule for the
provision of replacement dwelling units;

6. The basis for concluding that each replacement
dwelling unit will remain a low/moderate-income dwelling unit for
at least 10 years from the date of initial occupancy; and
7. Information demonstrating that any proposed
replacement of dwelling units with smaller dwelling units (e.g.,
a 2-bedroom unit with two 1-bedroom units) is consistent with the
housing needs of lower-income households in the jurisdiction.
C. Central Point will be responsible for tracking the
replacement of housing and ensuring that it is provided. within
the required period.
D. Central Point will be responsible for ensuring that
requirements are met for notification and provision of relocation
assistance, as described in 24 CFR 570.488(c)(2), to any lower-
income person displaced by the demolition of any dwelling unit to
another use in connection with an assisted activity.
E. Consistent with the goals and objectives. of activities
under the Act, Central Point will work with local public housing
authority to target Section 8 existing program certificates to
households being displaced, and recruit area landlords to
participate in the program.
