CITY OF CENTRAL POINT City Council Meeting Minutes February 8, 2007 I. REGULAR MEETING CALLED TO ORDER Mayor Williams called the meeting to order at 7:00 p.m. II. PLEDGE OF ALLEGIANCE tll. ROLL CALL: Mayor: Hank Williams Council Members: Becca Croft, Bruce Dingier, Dick Halley, Kay Harrison, and Mike Quilty were present. Matthew Stephenson was excused. City Administrator Phil Messina; City Attorney Doug Engle; Public Works Director Bob Pierce; Police Chief Jon Zeliff; Building Official Lois DeBenedetti; Community Planner Connie Clune; Parks and Recreation Director Katherine Boxer and City Recorder Deanna Gregory were also present. IV. PUBLIC APPEARANCES Don Pfaff, Sunland Ave Mr. Pfaff wanted to bring to the Council's attention the mess at the Pine and Hwy 99 intersection caused during the snow storm. There were several near misses that he witnessed that day. He also stated that the intersection at Mae Richardson School is a problem. The Council needs to fix these intersections before a fatal accident happens. V. SPECIAL PRESENTATION Anne Kraft, Oregon Research Institute Ms. Kraft stated that the Central Point Police Department is one of three Southern Oregon police agencies chosen to assist in "sting" operations in an effort to curtail the illegal purchase of alcoholic beverages by underage youth. VI. CONSENT AGENDA A. Approval of January 25, 2007, City Council Minutes B. Proclamation regarding underage drinking C. Traffic Safety Committee Report City of Central Point City Council Minutes February 8, 2007 Page 2 Becca Croft made a motion to approve the consent agenda with the removal of the Traffic Safety Committee Report. Mike Quilty seconded. Roll call: Becca Croft, yes; Bruce Dingier, yes; Dick Halley, yes; Kay Harrison, yes; and Mike Quilty, yes. VII. ITEMS REMOVED FROM CONSENT AGENDA There was discussion regarding the Traffic Safety Committee Report and the Barricade on Mac Ct. Council is concemed that installing the barricades might give the residents the impression this will be permanent. Public Works Director Bob Pierce stated that it was the consensus of the TSC to have the developer install the barricades (per a recommendation by their attorney) and the city remove them the same day. The street was constructed as a skinny street and there will only be parking on one side. It was never the intent of the city to leave the barricades in place. Becca Croft made a motion to approve the Traffic Safety Committee Report as presented. Kay Harrison seconded. Roll call: Becca Croft, yes; Bruce Dingler, yes; Dick Halley, yes; Kay Harrison, yes; and Mike Quilty, no. Motion approved. Vlll. PUBLIC HEARINGS, ORDINANCES AND RESOLUTIONS A. Ordinance No. 1899, An Ordinance Repealing Central Point Municipal Code Chapter 9.68 Entitled Unlawful Conduct in City Parks and Replacing it with a New Chapter 9.68 Entitled Rules and Regulations of Public Parks -Defining and Punishing Certain Offenses Against the Public General Welfare Parks and Recreation Director Katherine Boxer stated #hat this is the second reading of an ordinance amending park rules and regulations. At the last meeting Council recommended the following changes: Reword Section 9.68.040 Firearms allowing persons with concealed weapons permits to carry but not discharge guns in City parks as stated in ORS 161.173(2). Delete the statement requiring written permission from the Director to fly model aircraft in city parks. Add statement that they are permitted where posted in section 9.68.050. Change section 9.68.100 Hours of Operation to show the parks are closed between 10:00 p.m. to 6:00 a.m. with the exception of the Skate Park open hours of 6:00 a.m. to sunset each night. There was some concern about the reasons to allow a gun in the park even if it is dismantled. It was explained that there may be special events like historical re- enactments that would be allowed in the parks as long as the weapons were dismantled. At present the city does not have any events planned of this type. Ordinance No. 1900, An Ordinance Amending the Central Point Municipal Code Zoning Chapters 17.08, 17.44, and 17.60 Pertaining to Antenna Standards Community Planner Connie Clune reported that this was the second reading of an ordinance to amend the standards for Antennas. There were no recommended changes at the first reading. This request will update antenna location standards and procedures to support the growing need and advancing technology in cellular telephone systems, particularly the use of wall and roof mounted antennas. There was discussion regarding a possible list of current buildings that would support these types of antennas. It was stated that a building permit would be required. There are no specific buildings currently in mind. Kay Harrison made a motion to approve Ordinance 1900, An Ordinance Amending the Central Point Municipal Code Zoning Chapters 17.08, 17.44, and 17.60 Pertaining to Antenna Standards. Dick Halley seconded. Roll Call: Becca Croft, abstain; Bruce Dingler, yes; Dick Halley, yes; Kay Harrison, yes; and Mike Quilty, yes. Motion approved. IX. OTHER BUSINESS A. Planning Commission Report Ms. Clune presented the Planning Commission report for February 6, 2007: 1. The Commission approved a site plan application for Providence Health Systems to construct a 32,000 square foot, two-story medical office building located on the Westside Lumber property at 870 Front Street. The Commission found that the proposal satisfactorily met or exceeded site standards to include the TOD Corridor design standards. 2. The Commission approved a variance to the number of parcels that access from a flag lot easement. Jackson County Roads and Public Works recommended that an existing dwelling and the two proposed residential lots be permitted to access from the flag lot easement rather then creating a second access point on Beall Lane. The Planning Commission found .that the limited access recommendation addressed Beall Lane traffic safety concerns. 3. The Commission approved a tentative plan for the creation of three single family lots at 1676 Beall Lane. The partition application was contingent upon approval of the preceding variance. The Commission approved a tentative plan for the creation of five commercial lots east of Hamrick Road and south of East Pine Street. The Commission concurred with the recommended county traffic control requirements because they were judged to be consistent with the East Pine Street Transportation Plan. Other Standard city, county and fire district conditions were imposed. Under miscellaneous items, the commission was introduced to the Upton, Scenic, 10~h Street intersection improvements and was asked for approval to remove trees to accommodate public improvements.=Even though the property has not yet been annexed into the city, the commission was presented with an arborist's report and a recommendation for removal with which they concurred. The Commission was updated on the Regional Problem Solving process. They were shown the areas where the RPS Policy Committee has tentatively supported growth and given the reasons why it was rejected elsewhere. New areas were identified on a map north of Scenic Avenue and south of Beaty Lane. Becca Croft made a motion to approve the Planning Commission Report as presented. Mike Quilty seconded. Roll Call: Becca Croft, yes; Bruce Dingier, yes; Dick Halley, yes; Kay Harrison, yes, and Mike Quilty, yes. Motion approved. X. COUNCIL BUSINESS Mayor Williams stated that he has received a request from RVCOG to send a letter of support for the Rogue River Recreational Corridor and Greenway project. They are applying for a grant for a bicycle and pedestrian bridge crossing the Rogue River at Gold Hill and would like the support of the Central Point Council. He would like to know how the Council feels about this project since it is outside the UGB. There was concern about where the grant money would come from. Mike Quilty stated that it has not been approved by the MPO at this time. It would not wise to show support for a project that might compete with money that could be designated for the Central Point. Council Member Bruce Dingier asked about Council and other Committee members taking an ethics class. Mr. Messina stated that Chief Zeliff will be conducting a class for Jackson County on March 6~' from 8:00 a.m. to 12:00 p.m. and there will be room available for Central Point Council and employees who missed the sessions here. Council Member Bruce Dingier asked about a report stating that the intersection at the Pilot Station has been reported as having the most traffic accidents in Central Point. He asked about the type of accidents. Mr. Pierce stated that he would have to look into the coding on the report. XI. MAYOR'S REPORT Mayor Williams reported that he attended the Strategic Planning meetings and the RPS meetings. 1 City of Central Point City Council Minutes February 8, 2007 Page 5 XII. CITY ADMINISTRATOR'S REPORT City Administrator Phil Messina reported that: • There will be three interns from SOU helping in Human Resources and Finance. • Kelly Madding from Jackson County has asked if Central Point would be willing to have the CP-1 area under an Enterprise Zone. They will be discussing this issue in detail at a later date if Council is interested. XIII. COUNCIL REPORTS Council Member Dick Halley reported that he attended the Central Point Forward meetings. Council Member Kay Harrison reported that she attended the Central Point Forward meetings and the Medford Water Commission meeting. Council Member Mike Quilty reported that he: • Attended the Oregon MPO Consortium meeting. • Attended the RPS meeting • Attended the Central Point Forward meetings 1 XIV. DEPARTMENT REPORTS Public Works Director Bob Pierce reported that: • The Beebe Road waterline project should go out to bid next week. • The 10"'/Upton/Scenic project opening is planned for April. They will be working with RVSS on project timing. • The rubber sidewalk is almost complete on 3`d Street. • The tree and shrub trimming is going well. Pat has been working with the residents. • A beaver family is causing some problems in Griffin Creek. The City is working with a trapper to relocate the family. Parks and Recreation Director Katherine Boxer reported that: • There will be a meeting next week between Public Works and Parks and Recreation to discuss the Don Jones park design options. • The RFP for Blue Grass Downs Park has been published. • She attended an Oregon Parks Association meeting in Salem. Building Official Lois DeBenedetti reported that she will present the 2006 Annual Building Department Report at their next meeting. Police Chief Jon Zeliff presented a Lexipol Partners monthly calendar of training. This is the training that each Police Officer takes and must pass with 100%.
