ROLL CALL: Chuck Piland, Jan Dunlap, Candy Fish, Don Foster, Bob Gilkey, and Karolyn Johnson. Angela Curtis was absent. Also present were Tom Humphrey, Planning Director, Lee Brennan, Public Works Director, Ken Gerschler, Planning Technician, Sue Meyers, Public Works Technician, Jim Bennett, City Administrator, Mayor Rusty McGrath, and City Councilmen Bill Walton and John LeGros. III. CORRESPONDENCE There was no correspondence. IV. MINUTES Commissioner Fish made a motion to approve the Planning Commission Minutes of August 18, 1998, and September 1, 1998. Motion was seconded by Commissioner Gilkey. ROLL CALL: Dunlap abstain on August 18, 1998, yes on September 1, 1998; Fish, yes; Foster, yes; Gilkey, yes; Johnson, yes on August 18, 1998, abstain on September 1, 1998. V. PUBLIC APPEARANCES There were no public appearances. VI. BUSINESS A. Public Hearing to consider a request by Brad Miller to review a Tentative Plan fora 78 unit Planned Unit Development located east of North Pacific Highwav (US 991 and south of Scenic Avenue in the R-1 and R-2 zoning districts. There were no ex-parte communications or conflicts of interest. Commissioner Fish stated that she had a listing in the area that had sold, but any decision would not affect the sale. Tom Humphrey, Planning Director, stated that there were some items regarding this Tentative Plan that were not resolved at Staff level, and then City of Central Point Planning Commission Minutes September 15, 1998, Page 2 reviewed the Planning Department Staff Report. The applicants have submitted a preliminary development plan for a Residential Planned Unit Development (PUD) consisting of 78 single family lots. These will be manufactured homes, set on foundations. Individual homes will be owned but the land will be leased from the applicants. The PUD is being pursued because it allows the applicants more development flexibility with lot area, private roads, etc. without the necessity of applying for variances. Landscaping has not been fully addressed. For this reason staff is recommending that a condition be added which would require the completion and submission of a landscaping plan with the final development plan that the Commission will review. A final development plan shall be submitted to the City within six months of approval or by March 15, 1999, and the following conditions shall also apply. The project must comply with all local, state and federal regulations. The applicant shall submit a copy of the Covenants, Codes and Restrictions (CC&Rs). The applicant shall schedule and attend pre-design meetings with other agencies to more specifically identify utility easements, placements of fire hydrants and pipelines. The applicant shall provide a tot lot. Lee Brennan presented the Public Works Staff Report. The report recommended that the Developer demonstrate that all infrastructure connections not impose on the existing infrastructure. The Public Works Department also suggested inclusion of a locking pedestrian gate at the fire lane to facilitate pedestrian access to Nancy Avenue. PWD recommends a 25-foot wide street with no parking allowed and an entrance wide enough to accommodate residents, as well as traffic flow from highway 99. A minimum 5 foot sidewalk is recommended as well as a landscape buffer/sound wall. The Developer shall also develop a facility plan for the storm drain infrastructure. City Staff would expect reimbursement by the Developer for a prorated portion of the Highway 99 water line. The water distribution system will need to be designed in accordance with City Standards. Appropriate rights-of way and easement requirements will need to be met. All improvements to Highway 99 shall be coordinated and approved by ODOT and the City Public Works Department, at the expense of the Developer. City approved traffic barricades and street termination on Nancy Avenue and Marys Way shall be implemented at the Developer's expense. Creek setback requirements must be met, and a flood study of Griffin Creek must be performed. City of Central Point Planning Commission Minutes September 15, 1998, Page 3 Commissioner Gilkey asked if there would be any park land set aside for recreation. Tom Humphrey stated that there would be a nature area plus amenities located on approximately one acre of land. Commissioner Fish suggested that space 56 and 57 could be used for RV parking to accommodate the appropriate creek setback. Brad Miller, applicant, of 2364 East McAndrews, Medford, discussed the proposed PUD in depth. He pointed out that senior citizens are actually an asset to the community as they would not further burden the school system, the transportation system, etc. Commissioner Piland asked Mr. Miller about some of the private restrictions that would be placed on the PUD. These included double car garages, at least one shade tree and landscaping in the front yard, foundations, no rooftop antennas, and chain link fencing with white slats. Charlotte Leonard, 1885 Nancy Avenue spoke on behalf of the PUD. She said the residents of Green Glen Estates are happy with the fence but are concerned about flooding. They would like to see a hydrologist involved in the flood study. She stated this is a proposal she and neighbors can live with. Jovana Parker, 1220 Comet, also commented on the flood issue. Lee Brennan pointed out that there are no storm drains on Comet, which creates a problem. Barbara Sanday, 1845 Nancy Avenue, was opposed to the PUD, as she felt it would decrease property values in the surrounding area. Nancy Ihde, 555 Freeman Road, manager of The Meadows, took a neutral stand. She felt that seniors are the least taxing on the community and give a lot back. She was concerned that standards be established, kept and met, regarding the type of housing. Quality control and CC&Rs were her primary recommendations. Dave Girden, 1815 Marys Way, was concerned that the RV storage would butt up against the end of Nancy Avenue. He asked that the Miller PUD be required to create an attractive barrier at the end of each of the dead-end streets. Fle was also concerned about flooding and asked what the residents of the neighborhood could do to help the situation. He requested that Mr. Miller let the neighbors know about any future meetings. Brad Miller spoke about the price and size of the homes that will be placed in the PUD. He stated that only three colors will be available and all of the homes would be the same brand. The public portion of the hearing was closed. Commissioner Johnson made a motion to adopt Resolution 433 per staff reports and discussion approving a request by Brad Miller for a Tentative Plan fora 78 unit Planned Unit Development located east of North Pacific Highway (US 99) and south of Scenic Avenue in the R-1 and R-2 zoning districts, with landscaping taken into consideration on the dead end streets. Motion was seconded by Commissioner Dunlap. ROLL CALL: Dunlap, yes; Fish, yes; Foster, yes; Gilkey, yes; Johnson, yes. B. Public Hearing to consider a request by Neil and Linda Scheuneman to partition a single narcel located east of the intersection of Cedar Street and Freeman Road in the R-3 zoning district. There were no ex-parte communications or conflicts of interest. Ken Gerschler, Planning Technician, stated that after receiving a copy of the Staff Report, at Hoffbuhr Surveying's recommendation, the Scheunemans submitted a letter asking for a continuance. Commissioner Fish made a motion to continue the Public Hearing to consider a request by Neil and Linda Scheuneman to partition a single parcel located east of the intersection of Cedar Street and Freeman Road in the R-3 zoning district. Commissioner Gilkey seconded the motion. All said "aye" and the motion passed. C. Consideration of a request by Donna Beck to review a Site Plan to construct a new duplex on a residential lot also occupied by a single family dwelling located at 160 Haskell Street in the R-3 zoning district. Tom Humphrey reviewed the Planning Department Staff Report. This application has been forwarded to the Planning Commission because it involves the addition of new dwellings where a home is presently located. The existing residence has been remodeled recently and the Central Point Municipal Code requires a garage or carport be constructed. The Municipal Code also requires that all areas used for off street parking and maneuvering be paved with durable materials for all-weather use and adequately drained. Lee Brennan presented the Public Works Staff report. The Developer shall enter into a suitable deferred improvement agreement with the City for any public improvements to Haskell Street. All driveways, access roads, and parking areas should either have asphalt or cement concrete surfaces. The developer shall implement a site drainage/storm drain plan. Darren LeComte, contractor representing Donna Beck, stated that the majority of homes in the area do not have paved driveways or sidewalks, and it would be a large cost to pave the driveway area. Commissioner Gilkey made a motion to extend beyond the 10:00 p.m. deadline. Commissioner Fish seconded the motion. All said "aye" and the motion passed. Lee Brennan stated that Ms. Beck would need a variance from the City Council to gravel rather than pave the driveway. Commissioner Piland suggested that they might chip-seal, and plan to pave in two years. Allen Freeman, 249 Hiatt Lane, spoke in favor of the Beck Duplex, stating that he would like to share the cost of a fence between the two properties. Darren LeComte asked about the storm drain and Lee Brennan stated that they would need a catch basin in the parking area. Tom Humphrey recommended that if the applicants elected to proceed, the Planning Commission could vote on the issue, and the applicants could then go to the City Council for a variance on the paving of the driveway. Commissioner Johnson made a motion to adopt Resolution 434 per staff reports and discussion, approving a Site Plan to construct a new duplex on a residential lot also occupied by a single family dwelling located at 160 Haskell Street in the R-3 zoning district; requiring a concrete driveway apron, chip seal or better driveway and a deferred improvement agreement for sidewalks. Commissioner Fish seconded the motion. ROLL CALL: Dunlap, yes; Fish, yes; Foster, yes; Gilkey, yes; Johnson, yes. VII. MISCELLANEOUS A. Tom Humphrey stated that the Walnut Grove Village Manufactured Home Park has asked for a modification of their site plan. Many of their residents have requested amini-storage unit in place of part of their RV storage area. Commissioner Gilkey made a motion to accept the modification of the site plan for Walnut Grove Village Manufactured Home Park to accommodate a mini storage unit area, to be used exclusively by the residents. Commissioner Dunlap seconded the motion. All said "aye" and the motion passed. VIII. ADJOURNMENT Commissioner Gilkey made a motion to adjourn. Motion was seconded by Commissioner Foster. All said "aye" and the meeting adjourned at 11:00 p.m.
