RESOLUTION NO. 606
A RESOLUTION SETTING A PUBLIC HEARING BEFORE THE CITY COUNCIL
TO CONSIDER VACATION OF THE ENTIRE EAST-WEST ALLEY
BETWEEN N. FIFTH AND SIXTH STREETS IN CENTRAL POINT, OREGON
Recitals
1. Bruce Richey, on behalf of the Central Point Medical Group, has
requested vacation of the entire east-west alley located between N. Fifth
and Sixth Streets and adjacent to tax lots 1900, 2200, 5000, 5100 and 5200
of Township 37, Range 2 West, Section 2CC, in the City of Central Point. A
map of the area and a copy of Mr. Richey's letter are attached hereto,
marlced Exhibit "A" and "B" respectively.
2. The owners of all properties adjacent to the proposed alley
vacation have verbally consented to such vacation.
3. The purpose of the requested vacation is to facilitate. a planned
expansion of the Central Point Medical Center.
4. On November 12, 1991, in accordance with Chapter 1.24 of the
Central Point Municipal Code, the Central Paint Planning Commission
received and reviewed the vacation request and the accompanying City Staff
Report, and formulated a positive recommendation to the City Council
regarding the proposed vacation.
5. Pursuant to ORS 271.130, the City Council hereby elects to
initiate the vacation request on its own motion, and a public hearing is
necessary under ORS Chapter 271.
Now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT,
OREGON, that the City Council elects to initiate the vacation request
described above on its own motion, and a public hearing is hereby set for
December 19, 1991, at approximately 7:00 p.m. to consider the vacation
described herein.
Passed by the Council and signed by me in authentication of

A proposed site development plan encompassing the alley has
been approved by the Planning Commission for the Central Point
Medical Group, P.C. As part of that plan, the Central Point
Medical Group is proposing to remodel and add up to 3800 sq.ft.
to its existing medical office building. To allow the proposed
addition, a new site development plan. was necessary to create the
required number of parking spaces.
The east/west alley bisecting the. Central Point Medical
Group property creates a barrier that restricts additional
parking development and onsite circulation. By vacating a
portion of the alley bounded by the Central. Point Medical Group
property the site development plan, approved by the Planning
Commission, can be realized.
The. existing alley has no public utilities in its
boundaries. The private utilities situated in the alley will be
given a full public utility easement. While the curb cut
location will be modified, vehicular access will be maintained to
the site from Sixth Street. The property owners are willing to
grant a cross-access easement to ensure that general and
emergency vehicular access will not be restricted through the
site.
This vacation will place approximately 3400 sq.ft. of
property onto the tax roles and remove it from the City°s
maintenance schedule. The property owner's acknowledge that if a
substantial adverse affect is determined from this alley
vacation, they waive all damages against the City.

A legal description is being prepared for the portion of the
alley proposed for vacation. and will be submitted in a timely
manner for the City staff's use. All additional requirements and
conditions set forth in the Conditions for Approval will be
completed by the Central Point Medical Group.

process.
