A RESOLUTION GRANTING APPROVAL OF A TENTATIVE PLAN FOR A
MINOR LAND PARTITION

Recitals
1. John and Roxene Durham have submitted an application for tentative
plan approval of a minor land partition on a .58-acre parcel, located on
Cedar Street between Rostelle Avenue and Freeman Road, in the southeast
quadrant of the City of Central Point.
2. The Central Point Planning Commission held a public meeting on
said application on May 5, 1992, and by Resolution No. 235 recommended
approval.
3. The Central Point City Council conducted a public hearing on said
application on May 21, 1992. The Council reviewed the Planning Commission
recommendation, the City Staff Report, and heard testimony and comments on
the application.
Now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT,
OREGON, AS FOLLOWS:
Section 1. Approval Criteria. The requirements for approval of minor
land partitions and tentative plans are set forth in CPMC Chapters 16 and
17, having to do with informational requirements and lot area, width and
access.
Section 2. Findings and Conclusions. The City Council finds and
determines as follows:
A. Tentative Plan Reauirements. The application and tentative plan
are in the correct form and contain all of the information required by CPMC
Chapter 16.10.
B. Area and Width of Lots. This partitioning in an R-1-6 zone would
create the following parcels:
Parcel No. 1 - 11,000 square feet - 110 feet x 100 feet
Parcel No. 2 - 14,090 square feet (less the 2,000 square
foot driveway access equals 12,090 for
determining minimum flag lot footage)
93 feet x 130 feet

Parcel 1 meets the minimum area (6,000 square feet) and width (60 feet)
requirements for lots contained in CPMC 17.20.050. Parcel 2 meets the area
and width requirements for flag lots contained in CPMC 1.6.36.040.
Both lots meet the general requirements for lots contained in CPMC
16.24.050.
C. Access to Fla4 Lot. CPMC 16.36.040 requires an access of at least
20 feet in width, paved with cement or asphaltic surface, for all flag lots
created by partition. The tentative plan submitted herein provides for a
20 foot wide access, to be paved with concrete, which satisfies the City
Code requirement.
Section 3. Conditional Approval. The application for tentative plan
for minor land partition herein is hereby approved, subject to the
following conditions imposed under authority of CPMC Chapter 16.36:
Conditions
1. The access for Parcel 1 shall be determined prior to
issuance of an access or building permit, and such access shall be located
at the farthest point away from the access to Parcel 2.
2. Prior to issuance of a certificate of occupancq for any
of the parcels, all roof drains, area drains, and crawlspaces shall have
positive drainage away from the structure and shall be connected to a curb
drain or an approved storm sewer. Prior to any development on any of the
parcels created by this partition, the developer shall provide the
buildings, finished floor and property topographical elevations to confirm
that all structures will have adequate drainage.
