HomeMy WebLinkAboutCouncil Resolution 626RESOLUTION NO, oa o A RESOLUTION GRANTING APPROVAL OF A TENTATIVE PLAN FOR UNIT N0. 3 OF GREEN PARK VILLAGE SUBDIVISION (Applicant: Louis F. Mahar) (37 2W 12C TL 800) Recitals 1. On March 20, 1992, Louis F. Mahar, on behalf of Pacific Trend Building Company, has submitted a tentative plan application for Unit No. 3 of Green Parlt Village Subdivision, located north of Beall Lane and west of Interstate 5 in the City of Central Point. 2. On May 5, 1992, the Central Point Planning Commission reviewed the application and by Resolution No. 234 recommended its approval. 3. On May 21, 1992, the Central Point City Council conducted a public hearing on said application, reviewed the Planning Commission recommendation and City Staff Report, and heard testimony and argument on the application. Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWSt Section 1. Approval Criteria. The criteria for approval of this application are found in CPMC Chapter 16, relating to tentative plans and subdivisions, and in Chapter 17 relating to lot sizes. Section 2. Fndnas and Conclusions. The City Council. finds and determines as follows: A. Tentative Plan Requirements. The application and tentative plan herein are in the correct form and contain all of the information required for the same under CPMC Chapter 16.10. B. Area and Width of Lots. The application is for approval of a 43-lot subdivision in an R-1-6 zone, with lots ranging in area from 7,433 square feet to 13,337 square feet, which area sizes satisfy the R-1-6 lot size requirements of 6,000 square feet for interior lots and 7,000 square feet for corner lots found in CPMC 17.20.050. The minimum width requirements of CPMC 17.20.050 are also met, with interior lots at least 60 feet wide and corner lots at least 70 feet wide. 1 - RESOLUTION N0. ~n ~~n (051492) C. Blocks and Streets. The tentative plans proposal for the layout and dimensions of streets and blocks is in compliance with the requirements of CPMC Chapter 16.20 regarding streets and CPMC Chapter 16.24 regarding blocks. Section 3. Conditional Approval. The application for tentative plan approval for Unit No. 3 of the Green Park Village Subdivision is hereby approved, subject to the following conditions imposed under authority of CPMC 16.10.090: Conditions 1. This property is located in the Ells Creek Discharge Basin. The developer shall design the Storm Drainage System so as to meet the Total Maximum Daily Loadings (TMDLs) established by DEQ for the Bear Creek Water Quality Area. The developer's engineer shall submit the requested data for review at the time construction plans are submitted for permits. The developer shall be responsible for the cost of the improvements required as a part of this condition, 2. All roof drains, area drains, and crawl spaces shall have positive drainage away from the structure and shall be connected to a curb drain or an approved storm sewer.. Developer shall provide the building's finished floor and property topographic elevations to determine that all structures will drain properly. 3. Street name signs including posts, labor and equipment for street sign installation, shall be paid for by the developer of this subdivision, and the installation shall be completed by the City. 4. A Traffic Control Signing Plan shall be included as a part of the final construction plans, and will be installed by the City and all .costs associated with traffic control sign shall be paid for by the developer. 5. A soils engineer must evaluate the strength of the soil (R-Value) to determine the street section design. The City's engineer shall be used, and the developer shall pay for the costs of these services. Farwest Avenue shall be a minimum 20 year life, given a daily traffic volume of 2000 vehicles trips per day and 2$ truck traffic. The remaining streets in this phase of the subdivision shall be designed for a 20 year life, 1000 vehicle trips per day and 2a truck traffic. 2 - RESOLUTION N0. ~~ (051492) 6. A street lighting plan shall be included in the construction documents according to the requirements of the Public Works Department.. All intersections shall be illuminated and all local streets shall have a minimum street light spacing of 200'. Developer is to install all pads and conduits for street lights as a part of.the construction of the subdivision. The developer shall also pay for street lights and for the installation of all street lights in the subdivision. 7. Developer shall install or cause to be installed, conduits for utilities at intersections, or locations determined by utility companies. Developer shall also provide conduit crossings for utility companies who will not intall their services until after the facility is constructed. The developer shall be responsible for all costs associated with the installation of these conduit crossings. 8. In order to reduce noise levels for lots located adjacent to Interstate-5, Developer shall design and construct a berm or barrier providing visual screening and noise attenuation. Such berm or barrier shall meet the standards approved by ODOT and the City of Central Point. 9. CPMC 16.12.120 provides that no street, cul- de-sac or dead-end street shall serve more than 12 lots nor be more than 400 feet long. To accommodate this standard, Lot 111 or Lot 99 must locate its access and services on Far West Avenue. In addition, the accesses for Lot 99 and Lot 111 shall be located at the farthest point possible from the intersection of Shadow Wood Court and Far West Avenue. 10. Both Glen Grove Avenue and Far West Avenue will have. dead-end water systems which can be subject to stagnation and flow problems. A water loop from Far West Avenue to Glen Grove Avenue shall be constructed as part of the improvements to the subdivision.
