HomeMy WebLinkAboutOrdinance 1481ORDINANCE NOe 1481 AN ORDINANCE ALLOWING RATE INCREASE TO McCAW COMMUNICATIONS OF SOUTHERN OREGON PURSUANT TO FRANCHISE AGREEMENT AND DECLARING AN EMERGENCY.. WHEREAS, McCaw Communications of Southern Oregon, doing business as McCaw Cablevision has applied to the City to increase its rates charged to its subscribers within the City of Central Point, and Ordinance Noe 1221 granting the franchise requires public proceedings prior to any rate in- creases, which ordinance has been modified by supplemental Ordinance Noe 1261 dated October 28, 1976 and Council Minute action on March 22, 1979, and Ordinance Noe 1446 dated October 27, 1981, and WHEREAS, notices of a public hearing on September 23, 1982 to receive testimony regarding a proposed rate increase were published in the Medford Mail Tribune on September 17, 1982 and September 21, 1982, and said public hearing having been held and the City Council having fully and completely reviewed said rate increase request and public testimony thereon, and WHEREAS, the City Council deems it to be in the best interest of the City to make certain rate revisions to said franchise, now, therefore, THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN AS FOLLOW S: Section le McCaw Communications of Southern Oregon, doing business as McCaw Ca~blevision is hereby authorized to charge its subscribers within the City of Central Point, Oregon, in accordance with the rate schedule. attached hereto, marked Ordinance Nos 1481..- 1 Exhibit "A", and by this reference incorporated into the within ordinance. Section 2. The rate schedule authorized by this ordinance shall be effective on the lst day of November, 1982. Section_3® This ordinance being necessary for the immediate preservation of the public peace, health and safety of the City of Central Point® Oregon, based upon loss of revenues to the City that would result from any further delay, second reading is waived pursuant to Municipal Code 2.04.020, and an emergency is hereby delcared to exist. Same shall also apply to increases in cost to Licensee for service contact charges by Pacific Northwest Bell and Pacific Power $ Light and government .legislated fees,. including .copyright. Distances in excess of said 100 feet, underground and distances necessitating additional poles shall be constructed at cost. Extra outlets more than 25 feet dis- tant from first outlet shall be connected at cost. (S 0 Cable TV will extend aerial service where sufficient subscriber dwelling units have contracted for service so as to yield an average of 30 subscribers per lineal mile of plant added. 'Underground line extensions are made when mutually agreed -.upon by the customer and S 0 Cable TV as to service and ease- ments. The excess of costs of underground extension over costs of an ec{uivalent overhead extension yielding 30 sub- scribers permile are shared by the customers.)
