A RESOLUTION GRANTING CONDITIONAL APPROVAL OF A
TENTATIVE PLAN FOR A MINOR LAND PARTITION
(Applicant: Gary Whittle of Pacific Crest Properties, Inc.)

Recitals
1. Gary Whittle of Pacific Crest Properties, Inc. has submitted an
application for a minor land partition of a 4.59-acre parcel, located on
Bursell Road between Pittview Avenue and Libby Street in the southeast
quadrant of the City of Central Point.
2. The Central Point Planning Commission held a public meeting on
said application on February 4, 1992, and recommended conditional approval.
3. The Central. Point City Council conducted a public hearing on said
application on March 19, 1992. The Council reviewed the Planning
Commission recommendation, the City Staff report, and heard testimony and
comments on the application.
Now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT,
OREGON, AS FOLLOWS:
Section 1. Approval Criteria. The requirements for approval of minor
land partitions and tentative plans are set forth in CPMC Chapters 16 and
17, having to do with informational requirements, lot dimensions, and
access.
Section 2. Findings and Conclusions. The City Council finds and
determines as follows:.
A. Tentative Plan Requirements. The application and tentative plan
are in the correct form and contain all of the information required by CPMC
Chapter 16.10.
B. Area and Width of Lots. This partitioning in an R-2 zone caould
create the following parcels:
Parcel l: 11,948 square feet (116' by 103')
Parcel. 2: Approximately 185,000 square feet
(approximately 1218' by 163', minus
Parcel 1)
Both parcels meet the minimum area (6,000 square feet for Parcel 1 and
12,000 square feet for the flag lot, Parcel 2) and width (60 feet)

requirements for R-2 lots contained in CPMC 17.24.050, and they also meet
the general requirements for lots contained in CPMC 16.24.050.
C. Flag Lot Requirements. CPMC 16.36.040, pertaining to flag lots,
provides that no partition shall be approved in which a flag lot is created
unless the lot created is at least twice as large in area, exclusing
access, as the minimum lot size for the zoning district in which the lot is
located, and unless the access to the lot is no less than 20 feet wide and
paved with cement or asphaltic surface to City standards. Parcel 2, a flag
lot, contains a 50 foot wide access and is more than 12,000 square feet in
area. The requirements of CPMC 1.6.36.040 are therefore met.
Section 3. Conditional Approval. The application for tentative plan
for minor land partition herein is hereby approved, subject to the
following conditions imposed under authority of CPMC Chapter 16.36:
Conditions
1. The accesses for the parcels cannot be adequately
separated. Parcel 1 shall therefore grant an access easement to Parcel 2
to minimize the access points onto Bursell Road. At such time as a public
street is built to service further development of Parcel 2, the access for
Parcel 1 shall revert. to the new public street located on Parcel 2.
2. Prior to issuance of a Certificate of Occupancy for
either of the parcels, all roof drains, area drains, and crawl spaces shall
have positive drainage away from any structures erected on either parcel,
and shall be connected to a curb drain or an approved storm sewer. Prior
to any development on either of the parcels created by this partition, the
developer shall provide the buildings, finished floor and property
topographical elevations to confirm that all structures will have adequate
drainage..
3. Developer shall execute and fully perform the terms and
conditions of a "Development Agreement", the form of which is attached to
this Resolution, marked Exhibit "A", and by this reference incorporated
herein.
