AN ORDINANCE WITHDRAWING A PARCEL OF LAND LOCATED ON
HIGHWAY 99 AND SCENIC AVENUE FROM JACKSON COUNTY
FIRE PROTECTION DISTRICT NO. 3
Recitals
1. By Resolution No. 765 dated August 16, 1996, the City of
Central Point annexed two parcels of land located on Highway 99
and Scenic Avenue. Such parcels are within the boundaries of
Jackson County Fire Protection District No. 3.
2. On ~~.~-e„„b(,~ ~7 1996, the Central Point Planning
Commission, pu sr' uant to CPMC 1.24.020, conducted a public hearing
to consider withdrawal of such parcel from Fire District No. 3,
and whether such withdrawal would be in the best interest of the
City.
3. On ,c,,,fl4,,,,,,he,~ ~9 1996, the City Council held a duly-
noticed hearing, p rsuant to CPMC 1.24.020 and ORS 222.524, to
consider the withdrawal, and whether such withdrawal would be in
the best interests of the City.
Now, therefore;
THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN
AS FOLLOWS:
Section 1. Pursuant to oRS 222.520, the City of Central
Point hereby withdraws the following-described parcel of real
property from Jackson County Fire Protection District No. 3:
Commencing at the Northeastcorner of the Northwest one-
quarter (1/4) of Section 3 in Township 37 South, Range 2 West of
the Willamette Meridian in Jackson County, Oregon; thence North 89°
47' 04" West along the Northerly line of said Section 3, a distance
of 657.22 feet to the POINT OF BEGINNING; thence SOllth 00° 16
50" East 30.00 feet; thence continue South 00° 16' 50" East 990.52
feet; thence South 89° 49' 10" West 901.06 feet to a point on the
Northeasterly right-of-way line of Pacific Highway, said point
being marked with a 5/8 inch iron pin; thence along said right-of-
way line North 35° 08` 30" west 409.31 feet; thence continuing
along said right-of-way line North 32° 16' 45" West 400.50 feet;
thence North 35° 08' 30" West 435.40 feet to a point on the
aforementioned Northerly line of said Section 3; thence South 89°
47' 04" East along said line 1596.17 £eet to the Point of
Beginning. Containing 29.37 acres, more or less.

The City hereby assumes and agrees to pay the amount of
taxes which otherwise would be extended each year against the
property hereby withdrawn for the retirement of bonded debt,
subject to the right of the City to obtain reimbursement therefor
from the owner of said property.
Section 2. The City Administrator is directed to forthwith
file certified copies of the within ordinance with the Jackson
County Assessor, the Jackson County Department of Public Works,
and with the governing body of Jackson County Fire Protection
District No. 3.
Section 3. This withdrawal being necessary for the
immediate preservation of the public health, safety and welfare
of the City of Central Point, Oregon, and based upon the need to
conclude annexation procedures, second reading of this ordinance
is hereby waived and an emergency is declared to exist, and this
ordinance shall be in full force and effect immediately upon its
passage by the Council and approval by the Mayor.
