AN ORDINANCE REVISING BUILDING AND FIRE SAFETY STANDARDS
APPLICABLE TO CONSTRUCTION AND PROPERTIES
WITHIN THE CITY OF CENTRAL POINT
THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN
AS FOLLOWS:
Section 1. Central Point Municipal Code Section 8.24.170 is
hereby amended to read as follows:
8.24.170 Standards for Construction. In all areas of
special flood hazards, the following standards are required:
A. All construction shall be done in compliance with
Appendix Chapter 31 entitled "Special Construction", of the State
of Oregon Structural Specialty Code.
B. Utilities.
1. All new and replacement water supply systems shall
be designed to minimize or eliminate infiltration of flood waters
into the system.
2. New and replacement sanitary sewage systems shall
be designed to minimize or eliminate infiltration of flood waters
into the systems and discharge from the systems into flood
waters.
3. On-site waste disposal systems shall be located to
avoid impairment to them or contamination from them during
flooding.
C. Subdivision Proposals.
1. All subdivision proposals shall be consistent with
the need to minimize flood damage.
2. All subdivision proposals shall have public
utilities and facilities such as sewer, gas, electrical and water
systems located and constructed to minimize flood damage.
3. All subdivision proposals shall have adequate
drainage provided to reduce exposure to flood damage.
4. where base flood elevation data has not been
provided or is not available from another authoritative source,
it shall be generated for subdivision proposals and other
proposed developments which contain at least fifty lots or five
acres (whichever is less).
D. Review of Building Permits. Where elevation data is
not available either through the Flood Insurance Study or from
another authoritative source (Section 8.24.150(B)), applications
for building permits shall be reviewed to assure that proposed
construction will be reasonably safe from flooding. The test of
reasonableness is a local judgment and includes use of historical
data, high water marks, photographs of past flooding, etc., where
available. Failure to elevate at least two feet above grade in
these zones may result in higher insurance rates.

Section 2. Central Point Municipal Code section 8.24.180 is
hereby deleted in its entirety.
Section 3. Central Point Municipal Code section 15.04.010
is hereby amended to read as follows:
15.04 010 Standards Applicable to Building. A. All
construction, building, and related activities within the City
shall comply with all ordinances of the City and with the
following specialty codes, which by this reference are hereby
expressly adopted and incorporated into the Central Point
Municipal Code:
1. State of Oregon 1996 Edition, Structural Specialty
Code, volumes 1, 2, and 3; based on the Uniform Building Code
1994 Edition as published by the International Conference of
Building officials; specifically adopting and including sections
102 (Unsafe Building/Structures); 104.2.6 (Liability), and
104.2.10 (Cooperation of Other officials and Officers).
2. State of Oregon 1996 Edition, Mechanical Specialty
Code; based on the Uniform Mechanical Code 1994 Edition as
published by the International Conference of Building Officials;
specifically adopting and including Appendix A (The Uniform
Mechanical Standards, Uniform Fire Code Standards and the Uniform
Building Code Standards contained in Appendix A); Appendix B
(Chapters 10 and 15 only); Appendix C (Appendix C contains gas-
venting tables and is intended to serve only as a guide); and
Appendix D.
3. State of Oregon 1996 Edition, One & Two Family
Dwelling Specialty Code; based on the CABO One & Two Family
Dwelling Code 1995 Edition as published by the Council of
American Building Officials.
4. State of Oregon 1996 Edition, Electrical Specialty
Code; based on the National Electrical Code 1996 Edition as
published by the National Fire Protection Association.
5. State of Oregon 1996 Edition, Plumbing Specialty
Code; based on the Uniform Plumbing Code 1994 Edition as
published by the International Conference of Building Officials.
6. 1996 Edition of the Uniform Abatement of Dangerous
Buildings as published by the International Conference of
Building Officials.
B. No person shall conduct building or related activities
without complying with the standards set forth in the codes
described hereinabove in this ordinance; any violation of any
provision of any of said codes shall be a violation of the
Central Point Municipal Code, punishable under the general
penalty ordinance of the City.
Section 4. Central Point Municipal Code section 15.12.005
is hereby amended to read as follows:
15.12.005 Adopted. The State of Oregon 1996 Edition,
Plumbing Specialty Code, based on the Uniform Plumbing Code 1994

Edition as published by the International Conference of Building
Officials is adopted in its entirety to be hereafter referred to
as the 'Plumbing Code~~
Section 5. Central Point Municipal Code section 15.22.040
is hereby amended to read as follows:
15.22.040 Fence Requirements. A fence shall be required
completely surrounding a swimming pool. Such fence shall be in
compliance with the current edition of the State of Oregon one &
Two Family Dwelling Specialty Code (CABO Code) Appendix D
pertaining to swimming pools, spas, and hot tubs.
Section 6. Central Point Municipal Code section 8.16.020 is
hereby amended to read as follows:
8.16.020 Adoption of Uniform Fire Code and Uniform Fire
Code Standards. A. The following codes are by this reference
hereby expressly adopted and incorporated into the Central Point
Municipal Code:
1. State of Oregon 1996 Edition, Oregon Uniform Fire
Code Volumes 1 and 2; based on the Uniform Fire Code Volumes 1
and 2 1994 Editior_ as published by the International Fire Code
Institute; specifically adopting and including Appendices I-C,
I-D, II-B, II-F, III-A, III-C, IV-A, V-A, VI-A, VI-B, VI-D and
VI-F.
B. Any violation of any provision of any codes described
hereinabove in this section shall be a violation of the Central
Point Municipal Code and shall be punishable under the general
penalty ordinance of the City.
Section 7. This ordinance being necessary for the immediate
preservation of the public peace, health and safety of the City
of Central Point, Oregon, based upon the obligation of the City
to enforce current versions of the State Building and Fire Codes
and related codes, and the need to adopt said codes to protect
the safety of the public, an emergency is hereby declared to
exist and this ordinance shall be in full force and effect
immediately upon its passage.
