HomeMy WebLinkAboutOrdinance 1748ORDINANCE N0. ~7y~ AN ORDINANCE WITHDRAWING A PARCEL OF LAND ON HIGHWAY 99 FROM JACKSON COUNTY FIRE PROTECTION DISTRICT N0. 3 Recitals 1. By Resolution No. 746 dated April 5, 1996, the City of Central Point annexed a 14-acre parcel of land located at 4732 N. Pacific Highway. Such parcel is within the boundaries of Jackson County Fire Protection District No. 3. 2. On May 7, 1996, the Central Point Planning Commission, pursuant to CPMC 1.24.020, conducted a public hearing to consider withdrawal of such parcel from Fire District No. 3, and whether such withdrawal would be in the best interests of the City. 3. On June 6, 1996, the City Council held a duly-noticed hearing, pursuant to CPMC 1.24.020 and ORS 222.524, to consider the withdrawal, and whether such withdrawal would be in the best interests of the City. Now, therefore; THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN AS FOLLOWS: Section 1. Pursuant to ORS 222.520, the City of Central Point hereby withdraws the following-described real property from Jackson County Fire Protection District No. 3: Commencing at the Northeast corner of the Northwest one- quarter (1/4) of Section 3 in Township 37 South, Range 2 West of the Willamette Meridian in Jackson County, Oregon; thence South 00° 16' 50" East along the Easterly line of said one-quarter (1/4) Corner d d.iStanCe Of 1438.10 feet to the POINT OF BEGINNING; thenoe South 89° 43' 10" West 267.12 feet; thence South 88° 43' 20" West 324.94 feet; thence South 88° 49' 10" West 659.23 feet to a point o the Northeasterly right-of-way line of Pacific Highway; thence along said right-of-way line, North 35° 08' 30" West 537.27 feet to a 5/8 inch iron pin; thence leaving said right-of-way line, North 89° 49' 10" East 901.06 feet to the Southwest corner of GREEN GLEN SUBDIVISION, UNIT N0. 2, according to the Official Plat thereof, now of record in said Jackson County; thence North 88° 44' 03" East (Record North 88° 44' 41" East) along the Southerly boundary of said subdivision, 611.29 feet to the Southeast corner thereof; thence North 89° 49' 10" East 46.00 feet to a point on the aforementioned Easterly line of the Northwest one-quarter (1/4) of said Section 3; thence South 00° 16' 50" East along said Easterly line, 433.70 feet to the Point of Beginning. Containing 13.99 acres, more or less. 1 - ORDINANCE No. ~7y (052396) The City hereby assumes and agrees to pay the amount of taxes which otherwise would be extended each year against the property hereby withdrawn for the retirement of bonded debt, subject to the right of the City to obtain reimbursement therefor from the owner of said property. Section 2. The City Administrator is directed to forthwith file certified copies of the within ordinance with the Jackson County Assessor, the Jackson County Department of Public works, and with the governing body of Jackson County Fire Protection District No. 3. Section 3. The property previously annexed and hereby withdrawn is hereby zoned as follows: 375 2W 3B Tax Lot 500: R-1-6 37S 2W 3B Tax Lot 600: R-2 Section 4. This withdrawal being necessary for the immediate preservation of the public health, safety and welfare of the City of Central Point, Oregon, and based upon the need to conclude annexation procedures, second reading of this ordinance is hereby waived and an emergency is declared to exist, and this ordinance shall be in full force and effect immediately upon its passage by the Council and approval by the Mayor.
