AN ORDINANCE WITHDRAWING A PARCEL OF LAND ON EAST PINE STREET
FROM JACKSON COUNTY FIRE PROTECTION DISTRICT NO. 3
Recitals
1. By Resolution No. 745 dated April 5, 1996, the City of
Central Point annexed two parcels of land on East Pine Street.
Such parcels are within the boundaries of Jackson County Fire
Protection District No. 3.
2. On May 7, 1996, the Central Point Planning Commission,
pursuant to CPMC 1.24.020, conducted a public hearing to consider
withdrawal of such parcels from Fire District No. 3, and whether
such withdrawal would be in the best interests of the City.
3. On June 6, 1996, the City Council held a duly-noticed
hearing, pursuant to CPMC 1.24.020 and ORS 222.524, to consider
the withdrawal, and whether such withdrawal would be in the best
interests of the City.
Now, therefore;
THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN
AS FOLLOWS:
Section 1. Pursuant to ORS 222.520, the City of Central
Point hereby withdraws the following-described parcels of real
property from Jackson County Fire Protection District No. 3:
Parcel 1:
Commencing at the Northwest corner of Donation Land Claim No.
56 in Township 37 South, Range 2 West, Wi2lamatte Meridian, Jackson
County, Oregon; thence North 89° 56'30" East, along the Northerly
line of said Claim, 2051.65 feet; thence, leaving said Northerly
line, South 00° 02' 25" East 112.16 Eeet to the Southerly right•o£-
way line of Pine Street Por the PGY27T OP HEGIDtNING; thence North
a9° 53' 23" East, along said Southerly line, 255.59 feet to the
current Corporate boundary of the City of Central Point, Oregon;
thence, along. said boundary the Following courses: South 16°
15'00" East 492.97 feet; thence South 89° 59' 45" West 579.67 Feet
and North 00° 02' 25" East 0.72.40 feet to the aforementioned
southerly right-of-way line of Pine Street; thence, leaving said
boundary and along said Southerly line, North 89° 56' 30" East
185.85 feet to the Point of Beginning.

Parcel 2:
Commencing at a 1-1/2 inch iron pipe marking the East-
Southeast corner of Donation Land claim No. 56 in Township 37
South, Range 2 West, Willamette M¢rid ian, Jackson County, Oregon;
thence South 89° 56' 30" west, along the Southerly line oP said
Claim, 2150.90 Peet to the Northeasterly right-oP-way line of
Interstate Highway No. 5; thence North 42° 03' 27" West, along said
Northeasterly line, 493.80 feet to a .5 /8 inch iron pin £or the
POINT OF 8EGIHNING; thence, continue North 42° 03' 27" West 1326.10
feet to the ct1Yx'ant Corporate boundary of the city oP Central
Point; thence, along said boundary the following courses: North
89° 59' 17" East 507.02 feet; thence South 00° 09' 18" East 123.52
feet and North 89° 54' 45" East 131.58 £eet; thence, leaving said
boundary, South 46° 55' S1" East 71.03 Peet to a 5/8 inch iron pin;
thence South 17° 09' 30" East 210.22 feet to a 5/8 inch iron pin;
thence South 2S° 27' 20" East 259,88 feet to a 5/8 inch iron pin;
thence South OS° 24' 13" East 142.69 £eet to a 5/8 inch iron pin;
thence South 02° 10' 33" West 242.55 feet to the Point o£ Begin-
ning.
The City hereby assumes and agrees to pay the amount of
taxes which otherwise would be extended each year against the
property hereby withdrawn for the retirement of bonded debt,
subject to the right of the City to obtain reimbursement therefor
from the owner of said property.
Section 2. The City Administrator is directed to forthwith
file certified copies of the within ordinance with the Jackson
County Assessor, the Jackson County Department of Public Works,
and with the governing body of Jackson County Fire Protection
District No. 3.
Section 3. The properties previously annexed and hereby
withdrawn are hereby zoned as C-4, Tourist and Office-
Professional District.
Section 4. This withdrawal being necessary for the
immediate preservation of the public health, safety and welfare
of the City of Central Point, Oregon, and based upon the need to
conclude annexation procedures, second reading of this ordinance
is hereby waived and an emergency is declared to exist, and this
ordinance shall be in full force and effect immediately upon its
passage by the Council and approval by the Mayor.
Passed by the Council and signed by me in authentication of
