HomeMy WebLinkAboutOrdinance 1594~_ _ r"y , ORDINANCE N0. 1594 ' AN ORDINANCE AMENDING SECTION 13.04 OF THE CENTRAL POINT MUNICIPAL CODE REGARDING WATER RATES AND REGULATIONS WHEREAS, the Council has determined that the amendments as set forth herein are just and equitable, and in the best interest of the citizens of the City of Central Point, now therefore, THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON DO ORDAIN AS FOLLOWS: Section 1. Section 13.04.010 of the Central Point Municipal Code is hereby amended as follows: Section 13.04.010 Rates--Established. Commencing on the December 20, 1987 billing period, the following rates are fixed and specified as the minimum rates to be charged per month for water and used in the city: A. 3/4 1 1-1/2 2 3 4 6 8 inch connect, minimum charge per 667 cubic feet or fraction, $7.77; inch connect, minimum charge per 667 cubic feet or fraction, 9.13; inch connect, minimum charge per 667 cubic feet or fraction, 10.44; inch connect, minimum charge per 667 cubic feet or fraction, 12.29; inch connect, minimum charge per 667 cubic feet or fraction, 28.19; inch connect, minimum charge per 667 cubic feet or fraction, 41.52; inch connect, minimum charge per 667 cubic feet or fraction, 76.33; inch connect, minimum charge per 667 cubic feet or fraction, $112.87; Ordinance No. 1594 _ 1 B. Commencing on the December 20, 1987 billing period, any amount of water used in excess of the minimum amounts above provided shall be paid for at the rate of sixty six cents ($0.66) per one hundred cubic feet and the user shall be billed for the same at the time of billing for the amount used in excess of the minimum amounts above provided. C. The rates for use of water outside the city limits shall be one and one-half times the rate charged to users within the city. D. The rates in subsections A and B above will be adjusted upward by Council resolution effective on October 20th of each succeeding year by a minimum of five percent (5Z) or by a percentage amount equal to the annual percentage change in the U.S. City Average Consumer Price Index (CPI) for All Urban Consumers, whichever is greater. The comparison month will be July of each year. The rates for use of water outside the city limits shall remain one and one-half times the rate charged to users within the city. E. For the first or last month of service the minimum charge per 667 cubic feet or fraction shall be prorated on a daily basis, based on a thirty-day month, beginning on the date of connection. The minimum prorated charge shall be one dollar. Section 2. Section 13.04.020 of the Central Point Municipal Code is hereby amended as follows: Section 13.040.020 Apartments, multiple dwellings, mobile home narks, and planned unit developments -- Rates. A. In lieu of the water service charge based upon the size of connection as set forth in Section 13.04.010, the charge to apartments, multiple dwelling residences (including motels and hotels), mobile home spaces, and planned unit developments shall be Ordinance No. 1594 - 2 a minimum charge of seven dollars and seventy-seven cents ($7.77) per 667 cubic feet or fraction thereof multiplied by the number of living units or mobile home spaces for which water service is provided. B. Any amount of water used in excess of 667 cubic feet multiplied by the number of living units or mobile home spaces for which water service is provided shall be paid for at the rate of sixty six cents ($0.66) per gallon. C. For purposes of new construction the number of living units or mobile home spaces for which water service is provided shall be calculated for such living units or mobile home spaces after they are initially occupied. The number of living units or mobile home spaces initially occupied for the purpose of such rate computation shall be as reported by the owner or manager of each such apartment, multiple dwelling or mobile home park and shall be designated on forms to be furnished by the City and delivered or mailed to the City on or before the tenth day of each month. In the absence of a timely report of actual occupancy by the owner or manager of each such apartment, multiple dwelling or mobile home park, occupancy shall be deemed to be one hundred percent. If water is provided and no living units or mobile home spaces are occupied the charges for water service shall be calculated assuming an occupancy of one unit. D. It is unlawful for any person to make any false statement or report to the City as provided for herein. E. A living unit for purposes of this section shall mean such room or rooms designed for and capable of being used for living accommodations of one or more persons as a single housekeeping unit or household or overnight accomodation. Ordinance No. 1594 - 3 '. _. ,,..-', F. The water service charges established by this section shall be effective for water service provided from and after the December 20, 1987 billing period. Section 3. Section 13.040.040 of the Central Point Municipal Code is hereby amended as follows: Section 13.04.040 Water month designated. For the purposes of computing water charges hereunder, a month sall be a period from the twentieth day of each month to the twentieth day of the succeeeding month. Meter reading shall be done on or about the twentieth day of each month and done in such a manner to provide, as nearly as practical, twelve equal periods between readings.
