ORDINANCE NO, 1476
AN ORDINANCE AUTHORIZING AND ORDERING THE CONSTRUCTION
OF 8" SEWER MAINS AND A l2" WATER MAIN IN SNOWY BUTTE LANE:
AND BEALL LANE, DECLARING THE ASSESSPIENT OF PROPERTY BENE-
FITTED, AND DIRECTING THE CITY RECORDER TO ENTER A STATEMENT
THEREOF IN THE DOCKET OF CITY LIENS, AND PROVIDING THAT
WARRANTS ISSUED FOR THE COST THEREOF BE GENERAL OBLIGATIONS
OF THE CITY OF CENTRAL POINT, OREGON
WHEREAS, the City Council has heretofore by Ordinance No. 1475,
declared its intention to authorize the improvements herein described in accord-
ance with. plans and specifications now on file with the office of the City
Administrator, and proposed to make assessments. for said improvements and
directed the City Recorder to serve notice of the intent to construct and the
proposed assessments by mailing notices to the owners of each parcel of property
proposed to be assessed and setting August 26, 1982 as the date for which ob-
jections to said construction and proposed assessments should be filed with the
Recorder.
WHEREAS, the City Recorder did provide notices. in the manner set forth
in said ordinance to each of the owners of parcels of property proposed to be
assessed, and the public hearing was held thereafter in accordance with such
notice, and after hearing all testimony, whether for or against such improvements
or proposed assessments of the cost thereof to the adjacent beneftted properties,
the City Council deems that such improvement is of material benefit to the City
and that all property to be assessed will be benefitted to the extent of the
probable value of the respective assessments to be levied for the costs thereof,
now, therefore,
THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN AS FOLLOWS:
Section 1. It is hereby ordered that an 8" sewer main be constructed
from its present terminus in Snowy Butte Lane Southerly along Snowy Butte Lane and
an 8" sewer main be constructed from its present Southerly terminus in Glenn
clay Southerly to and along Beall Lane and a 12" water line be constructed from
its Southerly terminus in Snowy Butte Lane along Snowy .Butte Lane and Easterly

along Beall Lane to connect to the existing City water line, in accordance with
plans and specifications now on file in the office of the City Administrator, and
that the costs thereof be assessed against each lot or portion thereof adjacent to
and benefitted by such improvements, in proportionate shares, as provided by the
Charter of the City of Central Point and the laws of the State of Oregon.
Section 2. Warrants for the payment of the construction of the
improvements above described may be issued. and shall constitute general obligations
of the City of Central Point, Oregon for the terms and conditions of said warrants
to be provided by Oregon Revised Statutes.
Section 3. The estimated cost of the above described improvements is
hereby declared to be the sum of $215,271..00 including interest, inspection costs,
and administrative costs in the sum of $18,927.00. Said total sum of $215,271.. is
to be paid as follows:.
Amount to be paid by City of Central Point, Oregon $ 26,000.
Amount to be assessed against benefitted property owners $189,271..
Section 4. The following described parcels of real property, designated
by Jackson County Tax Assessor`s Tax Lot Numbers, are benefitted by the construction
of said improvements in the full amount indicated for each parcel as a proportionate
share of the total amount to be assessed against all benefitted property, and, the
City Council hereby makes assessments for the costs thereof and any amounts set
opposite each description for the costs of:suc.h improvements in the City of:Ceptral
Point as follows:

Section 6. The Recorder is hereby directed to serve notice of the fore-
going assessments by publishing the withi n ordinance in a newspaper o f general
circulation with. the City of Central Point on the 30th da y of August, 1982.

Section 7. This ordinance being necessary for the immediate preservation
of the public peace, health anal safety of the City
upon the need for completion of consteuctio~n during
to eliminate a health hazard, due to failing septic
waived pursuant to Municipal Code Section 2.04.020,

passage by the Council and approval by the Mayor.

WHEREAS, Jackson County Sanitarians have determined
that failing septic tank problems exist on Snowy Butte Lane
and Beall Lane; .and
WHEREAS, the City of Central Point has agreed to
.annex said property and extend sewer and water lines to said
property through a local improvement district; and
WHEREAS, the City of Central Point on the 13th day
of August, 1.982, has adopted an ordinance annexing said Snowy
Butte property, and the. annexation as adopted by the City will
not become effective in compliance with ORS 222..04.0 until
November 3, 1982; and
WHEREAS, the City of Central Point, after a public
hearing to receive remonstrances, has adopted an ordinance on
the 26th day of August, 1982, which authorizes and orders the
construction of sewer mains and water mains and declares assess-
ments of property benefitted.
Now, therefore,
The Board of County Commissioners of Jackson County
ORDERS:
1. That pursuant to ORS 224.090 and ORS 225..080,
the assessment of property as shown by City of Central Point
Ordinance No. 1476, a copy of which is attached hereto, and by
.this reference made a part hereof, is hereby approved.
