AN ORDINANCE DECLARING THE COUNCIL'S INTENTION TO
CAUSE THE CONSTRUCTION OF AN 8" SEWER MAIN AND A 12" WATER
MAIN IN SNOWY BUTTE LANE AND BEALL LANE, TENTATIVELY
APPROVING PLANS THEREFORE, AND PROPOSING ASSESSMENT
TO BENEFITTED PROPERTY OWNERS, SETTING A PUBLLC HEARING
THEREON AND PROVIDING NOTICE TO PROPERTY OWNERS
WHEREAS, petitions have. been received signed by over 50% of the owners
of street frontage and acreage on Snowy Butte Lane and Beall Lane beginning at a
point on Snowy Butte Lane approximately 115 feet west of the centerline of Glenn
Way and extending Southerly along. Snowy Butte Lane and Easterly along Beall Lane
approximately 1100 feet for the construction of 8" Sewer mains along Snowy Butte
Lane and Beall Lane and a Sewer main extending from the Southerly end of Glenn
Way to Beall Lane, and also the construction of a 12" Water main along Snowy Butte
Lane and Beall Lane, and the City Administrator has caused to be prepared prelimin-
ary plans, specifications and cost estimates and proposed assessments for said
improvements, now,. therefore,
THE PEOPLE OF THE CITY OF CENTRAL POINT D0 ORDAIN AS FOLLOWS:
Section 1. The plans, specifications and cost estimates and proposed.
assessments for the construction of an 8" Sewer line from its present terminus in
Snowy Butte Lane Southerly to Beall Lane and the construction of an 8" Sewer line
from its present terminus in Glenn Way Southerly to Beall Lane, and then Westerly
along Beall Lane approximately 800 feet and also Easterly along Beall Lane approxi-
mately 200 feet, and the construction of a 12" Water main from its present termi-
nus in Snowy Butte Lane Southerly to Beall Lane. and then Easterly along Beall Lane
approximately 1100 feet to connect to the existing City water line, and the boundary
of the proposed Local Improvement District, attached. hereto as Exhibit "A", are
hereby approved.

Section 2. The City Council. of the City of Central Point, Oregon,
hereby declares its intention to cause the construction of said project in accord-
ance with said plans and specifications, on file in the office of the City Adminis-
trator at City Hall, Central. Point, Oregon, and to assess each lot, or portion
thereof, adjacent to and benefitted by such improvements, its proportionate share
of the cost thereof as provided by law.
Section 3. The estimated cost of the Sewer main and the Water line is
hereby determined to be the sum of $ 21.5,271. including interest, inspection costs
and administrative costs in the sum of $ 18,927. Said total sum of $ 215,271.
is to be paid. as follows:
Amount to be paid by Central Point $ 26,000.
Amount to be assessed against benefitted
property owners. $ 189,271,
Section 4. The following described parcels of real property, designated by
Jackson County Tax Assessor's tax lot numbers, are benefitted by the construction of
said improvements in the full amount indicated for each parcel as a proportionate
share of the total amount to be assessed against all benefitted property, and the
Council proposes to make assessments for the cost thereof in the amount indicated
for each parcel:

Section 5. The 26th day of August 1982, at 7:00 'P. M. in
the Council Chambers, City Hall, Central Point, Oregon, is hereby set as the date,
time and place for a public hearing to consider protests against said improvements
and the assessment thereof, by adjacent property owners or other persons.
Section 6. The City Recorder is hereby directed to serve notice of said
hearing upon the aforesaid property owners by mailing or personally delivering a
copy of this ordinance to the owners of each of the properties to be assessed as
set forth in Section 4 of this ordinance, at least ten (10) days before the date of
said hearing and by posting five (5) copies of this ordinance:, one thereof at each

of five (5) public and conspicuous places in the City of Central Point of which
three (3) shall be within the proposed Local Improvement District. boundaries,
fora period of more than ten (10) days prior to said hearing.
Section 7. This ordinance being. necessary for the immediate preservation .
of the public peace, health and safety of the City of Central Point, Oregon based
upon the need for completion of construction during the construction season and to
eliminate a health hazard, due to failing septic tanks, second reading is waived
pursuant to Municipal Code. Section 2.04..020, and an emergency is declared to exist
and this ordinance shall be in full force and effect immediately upon its passage
by the Council. and approval by the Mayor.
Passed by the Councii and signed by me in authentication of its passage
this 12th day of August 1982.
