AN ORDINANCE PROCLAIMING THE ANNEXATION TO THE CITY
OF CENTRAL POINT OF A CONTIGUOUS PARCEL OF PROPERTY,
MORE PARTICULARLY DESCRIBED HEREIN, AND WITHDRAWING.
THE SAME FROM ROGUE VALLEY TRANSPORTATION DISTRICT,
JACKSON COUNTY FIRE PROTECTION DISTRICT NO. 3 AND
BEAR CREEK VALLEY SANITARY AUTHORITY
WHEREAS, the Planning. Commission of the City of Central Point has
recommended. that the contiguous territory described in Section 1 of this
ordinance be annexed to the City, and the owners of said property, who also
own more than half of the land in the contiguous territory, have consented in
writing. to the annexation, and said consent has heretofore been. filed. with the
City in the manner prescribed by law, and
WHEREAS, the territory is contiguous to the City of Central Point and
situated within the Rogue Valley Transportation District, Bear Creek Valley
Sanitary Authority and Jackson County Fire Protection District No. 3, and
WHEREAS, the City Council by Ordinance No. 1470 adopted on the
25th day of June, 1982, dispensed with an election submitting to the registered
voters of the city the question of annexing said territory and set 7:.00 p.m.
on July 22, 1982 in the Council Chambers of the City Hall in said city as the
time and place of hearing on said question of annexation and special district
withdrawal, and
WHEREAS, notices of said public hearings were published and posted in
the manner and for the time prescribed by law, and. said public hearings were
duly held by and before the City Council as provided by law, by the terms of said
ordinance, and in accordance with the published and posted notices thereof, and

WHEREAS, following said public hearing and after having considered
all of the evidence, the City Council found that said annexation would be in the
best interests of the city, and made the findings of fact attached hereto, marked
Exhibit "A" and by this reference incorporated into the within ordinance, now,
therefore,
THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS:
Section 1. The following parcel of real property situated in Jackson
County, Oregon.:
Commencing at the Southwest corner of Lot "R" of the
Snowy Butte Orchards in Jackson County, Oregon, according
to the. Official Plat thereof, now of record; thence South.
89° 59' East along the South line of said Lot "R", 1.96.93
feet; thence North parallel with.the.West-line "`of-said
Lot "R", 30.0 feet to the North right of way line of Beall
Lane (County Road) for the true point of beginning; thence
continue North parallel with said West lot line 745.35 feet;
then North 890 59' West, parallel with said South lot line
196.93 feet to the West line of said Lot "R"; thence North
along said West lot line 137.53 feet to the Southwest
corner of Lot "H" of Snowy Butte Orchards; thence North
along the West line of said Lot "H" 388.0 feet; thence
South 89° 54' East parallel with the South line of Lot "H"
in Snowy Butte Orchards. 449.7 feet to the East property
line of said Lot "H", also being the centerline of a
20.0 foot roadway (known as Snowy Butte Road); thence
South along said East property line 288.0 feet to a point.

Section 2. That the City Recorder shall submit to the Secretary of
State of the State of Oregon a copy of this ordinance, a copy of Ordinance No.
1470, and a copy of the complete consent documents signed by the landowner with-
in ten days of the effective date of this annexation, report this annexation to
the County Clerk, County Assessor and County Engineer of Jackson County, Oregon,
and the Department of Revenue of the State of Oregon, all in the manner required
by law.
Section 3. The. above described territory annexed to the City of Central
Point is hereby withdrawn from Rogue Valley Transportation District, Bear Creek
Valley Sanitary Authority and Jackson County Fire Protection District No. 3, and,
pursuant to ORS 222.520,. the City of Central Point assumes and agrees to pay the
amount of taxes which otherwise would be extended each year therefor against the
property hereby withdrawn, with the owners of said properties to reimburse the
City in full therefor. The City Recorder shall. forthwith!. file certified copies
of the within ordinance with the Jackson County Assessor and with the governing
bodies of the Rogue Valley Transportation District, Bear Creek Valley Sanitary
Authority and. Jackson County Fire Protection District No. 3.
Section 4. This ordinance being necessary for the immediate preserva-
tion of the public peace, health and safety of the City of Central Point, Oregon,
based upon the need to eliminate a health hazard,. due. to failing septic tanks and
completion of construction during the construction season pursuant to Municipal
Code Section 2.04.020, an emergency is hereby declared to exist and this ordinance
shall be in full force and effect immediately upon its passage by the Council and
approval. by the Mayor.

' APPLICATION FOR ANNEXATION
. Snowy Butte Lane
Central Point, Oregon
DESCRIPTION OF APPLICATION
This is an application for the annexation of unincorporated land to the
City of Central Point. The subject property consists of 16.46 acres
.along both sides of Snowy Butte Lane and north of Beall Lane, as illustrated
in Exhibit #l. The area has been divided .into 15 tax lots, which are now .
in 15 different ownerships. Fourteen of the lots have been developed for
use as homesites and all homes are presently owner-occupied.
PURPOSE OF .APPLICATION
The Snowy Butte Lane area proposed for annexation is presently a low-
density rural-residential neighborhood. The area is not served by sewer
or water systems and the residents rely on individual wells and septic
systems. Due to a high water table in this area and soils that have
severe limitations for septic systems, a high percentage of the properties
have a history of septic system failure resulting in the potential for
health hazards and the pollution of nearby drainages, including Griffin Creek.
These problems have been. studied and it has been determined that the best
long-term solution would be to provide sewer service within this area. The
most reasonable and cost-effective way to do this would be to annex the
area into the City of Central Point and serve the area with an extension of
the City's system.
Because of the potential health hazards involved and because the residents
of the area are supportive. of this annexation, the City of Central Point
has initiated .this annexation and has waived the application fees. With
the exception of one vacant lot, this area is considered developed and the
purpose of this annexation is not to promote further development. Therefore,
the City will not require that. property owners upgrade. their street to City
standards, nor will-the City accept responsibilities for street maintenance.
The overall objective is to correct the sewage problems in the most effective
manner and with the least financial impact on the present property owners.
WAIVER OF PLAT REQUIREMENTS
Because the property boundaries .are not. expected to change with this
annexation and, the'owners have no development plans beyond present levels,
the plat requirements of Central Point Municipal Code Chapter .1.20.02.0 do
.not apply and are waived.
The map of Exhibit #1 clearly shows the area's configuration, the general
shape and relative sizes of parcels, streets, and City boundary lines, and
is a reasonable. substitution for. the plat map requirement.

FINDINGS & CONCLUSIO2JS
Central Point does not have an acknowledged Comprehensive Plan and is
required to make findings supporting the consistency of the annexation
with the statewide planning goals. The following are findings and con-
clusions pertaining to both the statewide goals and the City's adopted
Comprehensive Plan.
GOAL #1: CITIZEN INVOLVEMENT
1. The City of Central Point has established a citizen involvement.
process in accordance with Goal #1. This process and the general
structure are outlined on p. I-4 of the Comprehensive Flan..
2.~ The City°s citizen involvement process includes the Citizen Advisory
Committee, the Planning Commission, the City Council, and other
.special purpose committees, as necessary.

3. The residents of the Snowy Butte area have been actively involved in
all phases of this .annexation process, have been kept informed of
progress and alternatives, and will .be encouraged to participate in
the public hearings to be held by the City.
CONCLUSION
The proposed annexation is in accordance with the City°s Comprehensive
Plan_ and statewide planning goal #1.
GOAL #2: LAND USE PLANNING
1. Central Point has established a.land use planning process and policy ,
framework as a basis for all decisions and .actions related to the use
of land, as required by Goal.#2. These are contained in the Comprehensive
Plan, Zoning Ordinance, and other portions of the. Municipal Code,
2. The Comprehensive Plan and Urban Growth Boundary of Central Point
.includes the area. proposed for .annexation, which is shown on the Plan
map as Low-density Residential, consistent with present development.
3. Goal #2 provides for "exceptions°' to goals when it is not possible to
apply a particular goal to a specific area or situation. Because of
the present levels of development in the Snowy Butte area, this area
is considered "urbanized°', is consistent with the City's future develop-
merit plans, and will not require an exception to any .statewide goals.
CONCLUSION '
The City's plans and ordinances are consistent with statewide planning
goals and the. proposed annexation is also found to be consistent.

GOAL #3: AGRICULTURAL LANDS
1. The intent of this goal is °'to preserve and maintain agricultural lands.°'
Agricultural lands in our area are defined as having Class I-IV soils.
The. area proposed for annexation consists of Class II and Class IV soils.
2. The subject area has been divided into 15 separate tax lots, 14 of which.
.have been improved .with a single-family dwelling..
3. .The total area of the proposed annexation is 16.46 acres, with an average
tax lot size of 1.1 acres. The largest parcel contains 2.59 acres.
4. The primary use o€ these lots is for residential purposes. Small-scale
agricultural uses are secondary and intended for home consumption or to
supplement other income..
5. None of the subject parcels are apart of a larger farm unit.
6. The area proposed for annexation. is surrounded on the west, north, and
..east by the City of Central Point and lands that are proposed for future
urban development. The only lands intended. to remain in agricultural
.production are .located across Beall Lane to the south, outside the City
and the Urban Growth Boundary. ~ ~ .
7. The subject area is presently developed for non-agricultural land uses
and an exception to Goal #3, based on soil type alone, is not necessary.
CONCLUSION
The area proposed for annexation is already developed to a rural-residential
density of approximately one unit per acre, any farm uses are accessory to
the residential uses and not part-of a larger farm unit, and the area is
surrounded on three sides by urban or urbanizable lands within the city .
.limits of~Central Point. Annexation of this area is consistent with the
City's Comprehensive Plan and UGB and will not violate Goal #3.
GOAL #4: FOREST LANDS
1. The subject area does not consist of any forest lands suitable for
commercial forest uses, watershed protection, fish or wildlife habitat,
or other forest uses, as described. in Goal #4.
2. The subject area does not consist of soils having a soil site. classification
suitable for forest production.

.forest uses and, therefore, the provisions of Goal #4 are not applicable.

GOAL #5: OPEN SPACE, SCENIC AND HISTORIC AREAS, AND NATURAL RESOURCES
1, The Comprehensive Plan for Central Point contains inventories of
areas that should be protected for their open space, natural or
historic qualities, as listed in Goal #5. The Snowy Butte area
is noted only for its proximity to Griffin Creek, which is a natural
watercourse and protected by implementation policies of the Plan and
Zoning Ordinance.
2. No known historic sites or structures are located within this area.
3, The subject area does not contain any wilderness areas, cultural areas,
or unique open space or scenic-areas, as described in Goal #5.
CONCLUSION
• The. proposed annexation will not conflict with statewide goal #5 nor
with the City°s Comprehensive Plan. Annexation will not result in
any immediate additional development and any future development will
be effectively controlled by the Zoning Ordinance to prevent any
adverse impacts on Griffin Creek. The primary purpose of this proposal
is to make possible sewer service, which will reduce the pollution
potential and possibly have a positive impact on Griffin Creek.
GOAL #6: AIR, WATER AND LAND RESOURCES QUALITY
1. The provisions of Goal #6 are contained primarily in the Environmental
Resources Management Element of the Comprehensive Plan.
2. Since annexation is not expected to result in any short-term increase
in development or density, there will be no change i.n levels of impact
on air or land resource quality. Long-term development would conform .
to the City°,s R-1 zoning district and could result in an ultimate
development of approximately 84 additional single-family units. However,
because of~the tax .lot configuration and locations of existing units, it
is doubtful if this level would ever be approached. This area would
.contain less than one percent of the City's total housing stock by the
year 2000 and its impact on air or land quality would be insignificant.
3, Water quality improvement would be en important benefit of this annexation.
This neighborhood is presently relying on septic systems to dispose of
sewage. It has been determined that many of these systems are failing.
This could result in health hazards as well as contamination of Griffin
Creek and Hog Creek. The annexation would make it possible to provide
city sewer service which would eliminate these potential hazards to the
public health,,• safety and general welfare,

GOAL #7: AREAS SUBJECT TO NATURAL DISASTERS AND HAZARDS
1. This goal is "to protect life and property from natural. disasters
and hazards." The only known disaster potential in the subject area
is the potential flooding of Griffin Creek..
2. The flooding potential of Griffin Creek has been established and
mapped by the federal flood. insurance program, as shown in Exhibit #4.
The floodway of Griffin Creek extends primarily to the west of the
creek and would have minimal effect on the area. The 100 year flood
plain would extend into the Snowy Butte area but would not affect any
existing dwellings, although any future development would .have to
conform to specific building requirements enforced by the City.
CONCLUSION
The subject area in partially located within the floodway and flood
plain of Griffin Creek. Annexation of this area will have no immediate
effect on flood safety and will not require. modifications to the existing
structures. Any future development within the area will be controlled by
the City°s administration of appropriate building codes:related to such.
flood-prone areas. The proposed annexation will not conflict with
Goal #7 nor with the City°s Comprehensive Plan.
GOAL #8: RECREATIONAL NEEDS
1. The provisions of this goal are reflected in the City's Parks and
.:Recreation Element of the Comprehensive Plan which attempts to balance
the recreational demands with appropriate facilities.
2. .The subject area could accommodate a theoretical ultimate. population
of about 250, based on maximum development under the R-1 zoning district.
However, as was previously discussed, there are development constraints
that will considerably reduce the future development potential. Even at
the maximum potential, this area .would contain about 1.6 percent of the
City's total population in the year 2000 and would have negligible impact
on citywide. recreational needs or demands.
3. The subject area has been included in Central Point's proposed Urban
Growth Boundary and population projections have been figured into the
citywide recreational. needs.
4. If higher density development occurs in the subject area in the future,
it will contribute toward recreational facilities through land dedication
requirements or through the payment of fees in lieu of dedication, as
required by the City of Central Point.

Annexation of the Snowy Butte area will not have any significant effect
on the City's recreational demands or facilities. Future potential
development of the area has already-been included in the City's future
recreational need projections and City requirements will help ensure that
any future development will contribute to the City's park system. This
annexation is not in conflict with Goal. #8 or with the Comprehensive Plan.

GOAL #9: ECONOMY OF TfiE STATE
1. The proposed annexation is not for the purpose of new development, but
to correct a potential health hazard.
2. Although annexation may. result in some employment benefits related to
the installation of sewer lines, the overall impact in this area will
be very .small.
CONCLUSION
The proposed annexation will. not have a significant impact on the
economy of the State, County, or City of Central Point.
GOAL #10; HOUSING
1. Although the Snowy Butte. area is within the City's proposed Urban
Growth Boundary, it is not intended that this annexation will result
in any short-term housing development. All but one of the 15~tax lots
are presently in residential use and owner-occupied. Additional
residential development could lessen .the desirability of this° mall
neighborhood and erode its present character. .
2. The Comprehensive Plan shows the subject area as Low-density Residential.
with a potential for six dwellings per acre. It is possible that the
area will eventually enter a transition stage that will .result in new
.development, but probably not at levels approaching the. maximum density.

The intent of this annexation is not to provide for additional .housing.
The area is already developed as a low-density residential area and
further residential development over the. next two decades will not
contribute significantly to the City's housing stock. There is no
conflict with Goal #10 nor .with the Comprehensive Plan. ~~
GOAL #11: PUBLIC FACILITIES & SERVICES
1. The primary purpose of this annexation is to provide sewer services to
an area that is experiencing failing septic systems and potential
hazards to public health.
2. Goal #11 requires °'a timely orderly and efficient arrangement°' of public
facilities4 The annexation. would coordinate the sewer facilities with.
adjacent City systems rather than encouraging the affected residents to
construct a more expensive and longer line to BCVSA's lines to the west.
3. The proposed sewer plan is consistent with the City's future development
.plans, would serve an already-developed area within the UGB, and would
have no immediate impact on the growth rate, although it would provide
for future planned growth in accordance with the City's plans and zoning.

4. The annexation would withdraw the. properties from Fire District ~3
and the City would assume police and fire protection responsibilities.
The area contains only 14 dwellings, is not considered a high fire
hazard area, and has good access from Beall Lane.
5. The City of Central. Point will not require that Snowy Butte property
owners upgrade their street to city standards as a condition of this
annexation.. Also, the City will not accept maintenance responsibilities
for Snowy Butte Lane.
6. At some. time in the future, if new development is proposed within the
subject area, the City may require that the street and other public
facilities be brought up to city standards as a condition or require-
ment of project approval.
CONCLUSION
The primary intent of this annexation is to provide a public faeility
.(sewer) to an area that•is already developed, is within the Central
Point Urban Growth Boundary, and is surrounded on three sides by lands
already within the City limits. This annexation will require City
police and fire protection, but not street maintenance. The impact on
the City's ability to provide services will be minimal and the provision
of the sewer facility is not expected to promote additional growth in
the near future. The annexation~is consistent with Goal ~n11 and with
.the Comprehensive Plan.
GOAL #12: TRANSPORTATION
1. The Circulation/Transportation Element of the Comprehensive Plan
addresses the requirements of Goal #12 in providing for the develop-
meet of a safe, eonvenient and economic transportation system.
2. .Snowy Butte Lane is a private street having a twenty-foot. right-of-
way. The street serves only those properties in the subject area
and does not provide a through route between Beall Lane and Glenn
Way. The residents have expressed their wish to have the street
remain unimproved and privately. maintained.
3. Snowy Butte Lane is not essential to the development of the City°s
transportation system and is not proposed for improvements at this time.
.Should the area propose future development that would require improved
access, the City may, at that time, require that the street be brought
up to City standards and perhaps eventually linked to Glenn Way to
providebetter circulation and access,
CONCLUSION
The proposed annexation. will not result in any significant increase in
the. area°s development or density and will not result in increased
traffic within this neighborhood. The proposal is not inconsistent.
with the City's Comprehensive Plan nor with .Goal n12.

GOAL #13 ENERGY.CONSERVATION
1. The proposed annexation will not promote any changes in local land uses
and, therefore, will have minimal impact on energy conservation or
utilization.
2. The annexation will permit the City to extend. sewer lines to the affeeted
area. Because the only other feasible alternative is to extend lines
a greater distance to BCVSA lines and at greater costs, this annexation
will result in greater efficiency and lower cost in the provision of
this utility.
CONCLUSION
The impact of this annexation will be minimal in terms of energy con-
servation and will result in .the more efficient provision of Sewer
services. Therefore, this annexation is not inconsistent with Goal #13
nor with the Public Facilities & Services Element of .the City's Plan.
GOAL #14: URBANIZATION
1. The Urbanization Element of the. Comprehensive Plan provides for the
City's future direction and extent of growth in the most. efficient
manner. The subject area is included within the proposed Urban Growth
Boundary. Although .the entire UGB has not been agreed to by Jackson
County, this. particular portion is surrounded on three sides by lands
already within the City and its inclusion has not been questioned.
2, This annexation will result in the orderly provision of public facilities
within an area that is already developed in accordance with the City's
Comprehensive Plan. The provision of sewer facilities is not expected
to promote additional ..unplanned growth.
3. The long-range development plan for Central Point includes the subject
area, which is necessary to meet the future residential needs of the
community.
CONCLUSION
This annexation is consistent with the City's Comprehensive Plan and
with Goal #14.

The following statewide planning goals do not pertain to the Central Point
area nor to this proposed annexations

GENERAL CONCLUSION AND RECOMMENDATION
The proposed Snowy Butte annexation to the City of Central Point is
found to be consistent with the City°s Comprehensive Plan and with
all statewide planning goals, The annexation is intended to open the
way for the extension of the City's sewer system to correct the
present problem of failing septic system a The annexation and the
provision of sewer facilities are nQt expected. to have any significant
adverse impacts on the area or on the community and are not expected
to promote unplanned growth in the Snowy Butte neighborhoods
It is recommended that the City of Central Point approve this request
for annexationo

North parallel with the West line of said Lot °'R", 30>0 feet to the North right
