HomeMy WebLinkAboutOrdinance 1446ORDINANCE NO. 1446 AN ORDINANCE ALLOWING RATE INCREASE TO SOUTHERN OREGON BROADCASTING COMPANY PURSUANT TO FRANCHISE AGREEMENT AND DECLARING AN EMERGENCY WHEREAS, Southern Oregon Broadcasting Company, doing business as Southern Oregon Cable TV has applied to the City to increase its rates charged to its subscribers within the City of Central Point, and Ordinance No. 1221 granting the franchise to Southern Oregon Cable TV requires public proceedings prior to any rate increases, which ordinance has been modified by supplemental Ordinance No. 1261 dated October 28, 1976 and Council Minute action on March 22, 1979, and WHEREAS, notices of a public hearing on October 8, 1981 to receive testimony regarding a proposed rate increase were published in the Medford Mail Tribune on October 4, 1981 and October 6, 1981, and said public hearing having been held and. the City Council having fully and completely reviewed said rate increase request and public. testimony thereon, and WHEREAS, the City Council deems it to be in the best interest of the City to make certain rate revisions to said franchise, now, therefore, THE PEOPLE OF THE. CITY OF CENTRAL POINT, OREGON, DO ORDAIN AS FOLLOWS: Section 1. Southern Oregon Broadcasting Company, doing business as Southern Oregon Cable TV is hereby authorized to charge its subscribers within the City of Central Point, Oregon, in accordance with the rate schedule attached hereto, marked Exhibit "A", and by this reference incorporated into the within ordinance. Page l - Ordinance No. 1446 Section-2. The rate schedule authorized by this ordinance shall be effective on the 1st day of November, 1981. Section 3. This ordinance being necessary for the immediate preservation of the public peace, health and safety of the City of Central Point, Oregon, based upon loss of revenues to the City that would result from any further delay, second reading is waived pursuant to P~Iunicipal Code 2.04.020, and an emergency is hereby declared to exist. EXHIBIT A;- (1) t~lhere distance is greater than 1.00 feet from energized cable, any charges occurring monthly resultant from (2) below shall be additional to regular monthly rate at cost thereof. Same shall also apply to increases in cost to Licensee for service contact charges by Pacific Northwest Bell and Pacific Pottier & Light and government legislated fees, including copyright. (2) Based on aerial footage of 100 feet from curbline along energized feeder cable. Distances in excess of said 100 feet, underground and distances ~~ necessitating additional poles shall be eonstructed at cost.* Extra outlets rrore than 25 feet distant from first outlet shall be connected at cost.
