A RESOLUTION DECLARING THE COUNCIL'S INTENT
TO ANNEX A 1.5 ACRE PARCEL OF LAND CONTIGUOUS
TO THE CITY OWNED BY JEAN KORNER, SAID PROPERTY
BEING ON THE EAST SIDE OF FREEMAN ROAD BETWEEN OAK
STREET AND CHESTNUT STREET, AND MORE PARTICULARLY
DESCRIBED IN THE JACKSON COUNTY TAX ASSESSOR'S RECORDS
AS 37 2W 2D TAX LOT 1400, WITHOUT AN ELECTION, AND
TO WITHDRAW THE SAME FROM JACKSON COUNTY FIRE PROTECTION
DISTRICT NO. 3 AND BEAR CREEK VALLEY SANITARY AUTHORITY, TO
ESTABLISH THE ZONE THEREON IN ACCORDANCE WITH THE CITY'S
COMPREHENSIVE PLAN AND MAP, AND SETTING A DATE FOR.
PUBLIC HEARING THEREON
WHEREAS, a petition has been filed with the City of Central
Point,. Oregon, relating to the proposed annexation of the
property described hereinafter, in which petition all of the
owners of land and not less than fifty percent of the electors
residing in the territory to be annexed have consented in writing
to the annexation, and
WHEREAS, ORS 222.125 provides for annexation without
elections or public hearings when all. of the owners of land in
the territory proposed to be annexed and not less than fifty
percent of the electors therein consent in writing to the
annexation. and file a statement of such consent with the City
Council, and the foregoing petition for annexation complies with
said statute and with Central Point Municipal Code 1.20 relating
to annexations, and.
WHEREAS, the Council has elected pursuant to ORS 222.125 to
dispense with an election submitting said proposed annexation to
the electors of the City, but is required by Central Point

Municipal Code Section 1.24.020D3 to hold public hearing upon
said annexation, and is therefore desirous of fixing a time and
date for public hearing upon annexation and, in the event of
annexation, upon the issues of withdrawal of said territory from
Jackson County Fire Protection District No. 3 and Bear Creek
Valley Sanitary Authority, and to establish the zoning district
therefor pursuant to the City's Comprehensive Plan, zoning
ordinance and Section 1.24.020D2, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL
POINT, OREGON, AS FOLLOWS:
Section 1. Proceedings are hereby initiated for the
annexation. to the City of Central. Point of the parcel of real
property consisting of 1.5 acres on the east side of Freeman Road
between Oak and Chestnut Streets, and more particularly described
in Jackson County Tax Assessor Records as 37 2W 2D Tax Lot 1400,
and a more particular legal description of which parcel is
attached hereto, marked Exhibit A, and which is by this reference
incorporated into the within resolution.
Section 2. The public hearing on the question of annexation
of the described property to the City, the withdrawal of the same
from Jackson County Fire Protection District No. 3 and Bear Creek
Valley Sanitary Authority, and the establishment of the zoning
district(s) of said property, shall be held on the 19th day of
July 1990, commencing at 7:00 p.m. at the regularly
scheduled Central Point City Gouncil meeting at Central Point

City Hall, Central Point, Oregon, at which time and date all
persons may appear and be heard on said questions of annexation,
special district withdrawal and establishment of zoning
district(s).
Section 3. The City Administrator is directed to cause
notice of said hearing to be published once each week for two
successive weeks prior to the date of hearing in the Medford Mail
Tribune, a newspaper o£ general circulation in the City of
Central Point, Oregon, with the second publication to be no less
than 24 hours prior to said hearing, and to cause notices of said
hearing to be posted in four public places in the City for two
successive weeks prior to the date of hearing.

Beginning at a point on the west boundary line of Donation Land Claim tdo.
56 in Tovrnship 37 South, Range 2 West of the Willamette Meridian in
Jackson County, Oregon, said point being 17.59 chains South of the
northwest corner of said Claim; thence East 408.0 feet; thence North
160.0 feet; thence West 408.0 feet; thence South 160.0 feet to the point
of beginning.
