A RESOLUTION APPROVING A MINOR LAND PARTITION
FOR STEVEN KELTON
WHEREAS, applicant Steven Kelton has filed an application for
a minor partition of property described in the. Jackson County Asses-
sor's records as 36 2W 34D, Tax Lot 208, and
WHEREAS, the Planning Commission of the City on the 2nd day of
May, 1989, by Planning Commission Resolution No. 167 recommended ap-
proval thereof with conditions as set. forth hereinafter, and
WHEREAS, a public hearing was held thereon by the Central
Point City Council on the 18th day of May, 1989, at which time the
Council received the staff report, planning commission report and
evidence thereon, now, therefore,
IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CENTRAL POINT AS FOLLOWS:
Section 1. That the recommendation of the Central Point Planning
Commission is hereby ratified and adopted by the Council.
Section 2. That said application for minor land partition be,
and same is hereby approved, subject to the following conditions as
authorized by ordinance:
a. Applicant shall sign a deferred improvement agreement
agreeing to construction of storm drains, street lights, sidewalks,
paving,. curbs, and street improvements and to inclusion in a local
improvement district for payment thereof, and waiving any rights of
remonstrance relating thereto, upon request by City.

b. The foregoing conditions shall be reduced to written form
of agreement in a form suitable for recording in the official records
of Jackson County, Oregon, specifying both of the subject parcels
which shall run with the land and be binding upon applicant's heirs,
successors and assigns. Said agreement shall include an adequate
legal description, to be furnished at applicant's expense, and shall
be recorded forthwith.
c. The outstanding sewer and water assessment originally
recorded as assessment #20 in Ordinance No. 1567 shall be evenly split
and applied to the two resulting parcels.
d. The applicant comply with the recommendations of the
Public Works Department attached hereto as Exhibit "A"

Re: T3GS R2W Section 24D Tax Lot 208
A complete plan review shall be done as apart of the submittal for build-
ing permits for this particular property. However, the following condi-
tions shall apply to this. Minor Land Partition.
1. A deferred improvement agreement shall be signed for future widen-
ing and construction cast for street asphalt paving, storm drainage,
curbs and gutters, traffic control devices, street lights, utility
crossings, sidewalks, driveway approaches, and other improvements
required for water and sanitary sewer for Upton Road and Teresa Way.
2. Water and sanitary sewer service laterals are located at the
property to be partitioned.
3. A street driveway permit shall be obtained from the Jackson Coun-
ty Public Works. Department.
4. All costs associated with this develo_cment shall be the sole
responsibility of the applicant or owner. The review done on "this
Minor Land Partition utilized the rules and regulations in effect as
of April 27, 1989. Any modifications to the Minor Land Partition
will require a new review and requirements set forth herein can be
modified based on any proposed changes.
5. A11 construction within Public Rights of Way, easements or storm
drainage systems shall be built according to the public Works' Stan-
dards in effect at the time of application for permits.
