A RESOLUTION APPROVING A MINOR LAND PARTITION
FOR ROBERT HAYS AND MICHAEL MORAN
WHEREAS, applicants Robert Hays and Michael Moran have filed
an application for a minor partition of property described in the
Jackson County Assessor's records as 37 2W 3DD, Tax Lot 9406, and
WHEREAS, the Planning Commission of the City on the 7th day of
February, 1989, by Planning Commission Resolution No. 159 recommended
approval thereof with conditions as set forth hereinafter, and
WHEREAS, a public hearing was held thereon by the Central
Point City Council on the 16th day of February, 1989, at which time
the Council received the staff report, planning commission report and
evidence thereon, now, therefore,
IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CENTRAL POINT AS FOLLOWS:
Section 1. That the recommendation of the Central Point Planning
Commission is hereby ratified and adopted by the Council.
Section 2. That said application for minor land partition be,
and same is hereby approved, subject to the following conditions as
authorized by ordinance:
a. Applicants shall sign a deferred improvement agreement
agreeing to construction of storm drains, street lights, sidewalks,
paving, curbs, and street improvements and to inclusion in a local
improvement district. for payment thereof, and. waiving any rights of
remonstrance relating thereto, upon request by City.

b. The foregoing conditions shall be reduced to written form
of agreement in a form suitable for recording in the official records
of Jackson County, Oregon, specifying both of the subject parcels
which shall run with the land and be binding upon applicant's heirs,
successors and assigns. Said agreement shall include an adequate
legal description, to be furnished at applicant's expense, and shall
be recorded forthwith.
Passed by the Council and signed by me in authentication of
its passage this 16th day of March 1989.
