AN ORDINANCE PROCLAIMING THE ANNEXATION TO THE CITY
OF CENTRAL. POINT OF A CONTLGUOUS PARCEL. OF PROPERTY,
MORE PARTICULARLY DESCRIBED HEREIN, AND WITHDRAWING
THE SAME FROM JACKSON COUNTY FIRE PROTECTION DISTRICT
NO. 3 AND BEAR. CREEK VALLEY SANITARY AUTHORITY
WHEREAS, the. Planning Commission of the City of Central
Point has recommended. that. the. contiguous territory described
in Section 1 of this ordinance be annexed to the city, and the
owner of said property, owning all of the land and. real property
therein, representing all of the assessed value thereof, has
consented in writing to the annexation, and said consent. has
heretofore been filed with the City Recorder in the. mannerpre-
Bribed by law, and
WHEREAS, the territory is contiguous to .the City of
Central Point and situated within the Bear Creek Valley Sanitary
Authority and. Jackson County Fire Protection District No. 3, `nd
WHEREAS, the. City Council by Ordinance No. 1431 adopted
on the ,/~ ~ day of °~ 1981, dispensed with an election

submitting to the. registered voters of the. city the. question of
annexing said territory, and set 7:00 p.m. on May 14, 1981 in the
Council Chambers of the City Hall in said city as the time. and
place of hearing on said question of annexation and special dis-
trict withdrawal, and
WHEREAS, notices of said public hearings were published.
and posted in the manner and for the time prescribed. by law, and
said public. hearings were duly held by and before the City
Council as provided by law, by the terms of said ordinance, and
in accordance with the published and posted notices thereof, and

WHEREAS, following said. public hearing and after
having considered all of the evidence,, the City Council .found
that said annexation would. be in the best interests of the
.city, and made the findings.of fact attached hereto, marked
Exhibit °°A" and. by this reference incorporated into the within
ordinance, now® therefore,
THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS
FOLLOWS:
Section 1. The following parcel of real property
situated in Jackson County, Oregon;
Beginning at a 5/8 °° iron pin found for the
northeast corner of Lot Eighteen (18) in Block
Six (6) of HOPIESTEAD ACRES EXTENSION NO. 2 in
Jackson County, Oregon, according to the
official plat thereof, now of record; thence
West, along the north line of said EXTENSION
NO. 2, 519<14 feet to the Southeast corner of
Lot 5, Block 4 of VALLEY ESTATES - UNIT NO. 3
in the City of Central Point, said County and
State; thence North 0° 04' 40" West, 350.00
feet to the Southwest corner of Lot 7, Block 1,
said UNLT N0. 3; thence along the south line
of said Block 1, East, 519.1.4 feet to the west
boundary of Bursell Road; thence along said west
:boundary, South 0° 04' 40°' East, 350..00 feet to
the point of beginning.
be, and the same is hereby proclaimed to be, annexed to the-City
of Central Point, Oregon. -
Section 2, That the City Recorder shall submit to
the Secretary of State of the State of Oregon a copy of this
ordinance, a copy of Ordinance No. 1431, and a copy of the complete
consent documents signed by the landowner within. the territory
annexed. The City Recorder shall also, within ten days of the
effective date of this annexation, report this annexation to the
County Clerk, County Assessor and County Engineer of Jackson

County, Oregon, and the Department of Revenue of the State of
Oregon, al in the manner required by law.
Section 3. The above described territory annexed. to
the City of Central Point is hereby withdrawn from Bear Creek.
Valley Sanitary Authority .and Jackson CounT,~y Fire Protection
District No. 3, and, pursuant to ORS.222.52.0, the City of
Central Point assumes and agrees to pay the amount of taxes
.which otherwise would be extended each year therefor against the
property hereby withdrawn, with the owner of said .property to
reimburse the city in full therefor. The City Recorder shall.
forthwith file certified copies of the within ordinance. with the
Jackson County Assessor and. with the governing bodies of the
Bear Creek Valley Sanitary Authority and Jackson County Fire
Protection District No. 3.

GOAL NO. 1 Citizen Involvement
This proposed annexation was reviewed by the Citizens Advisory Committee
on Aprii 1, 1981, in an advertised public meeting.
This. proposed annexation was further reviewed by the City Planning Commis ion
meeting on April 21, 1981,. again in an advertised public meeting. Public .
testimony was received from the public at the CAC meeting.
GOAL N0. 2 Land Use Planning
. As previously stated, the area of the proposed annexation is within the
Urban Growth Boundary. The City of Central Point and Jackson County Planning
Commissions, along with the. governing bodies, have ruled this area as "urbanizable
land." It is self evident that much study, through many meetings, was devoted
to planning in the determination of the Urban Growth Boundary.
.GOAL N0. 3 Agricultural Lands
L.C.D.C. has rendered an opinion that where agricultural lands have been
inc7.uded within an Urban Growth Boundary, there is no conflict with the agri-
Cultural goal. The goal criteria for establishing urban growth boundaries are
.sufficient to justify agricultural land inclusions. Most of the lands surrounding
Central Point are of a soil class I through IV, and are therefore potential
agricultural lands. The Urban Growth Boundary process has removed this apparent
conflict.

The annexation of the. proposed area will insure the disposal of any sewerage.
into public sewer systems. The area under consideration is adjacent to 8,000.
square foot residential developments, and the use of septic systems adjacent
thereto is a potential health hazard. It is incumbent upon the City to protect
the residents of the City from potential health hazards, and the careful control
of properties within the Urban. Growth Boundary is a means to this end..

GOAL N0. 7 Areas subject. to Natural Disasters and Hazards
The subject area is not within any flood plain..
GOAL N0. 8 Recreational Needs
The City of Central Point has an Ordinance which requires land be. dedicated
for recreational park purposes, or a fee be paid i.n 3_ieu of said dedication, for,
. lands being developed as Subdivisions. If the subject area is annexed into they
City of Central Point., and adequately zoned for a subdivision, these fees will
:'.meet L.C.D.C. Goal No. 8.
GOAL NO. 9 Economy of Stote
It is not anticipated that the ann~xati.on of this 4.17 acres is going to
have any significant impact on the economy of the State.
GOAL N0. 10 Housing
The ;ourpose of Goal No. 10 is to insure the present and future. housing needs
of the public are net as economically as possible.
One. way to accomplish this is for a community to have an inventory of
.buildable lots within the community. An inventory of lots reduces the cost to
the consumer--the public.
Thzre does not appear to be any R 1-8 lotsavailabe in.'thesouth end of
.Central. Point, east of Highway 99.
This fact, and the availability of all public facilities adjacent to the
property meet the requirements of Goal Zo. 10. City sanitary sewers, water,
storm drain facilities and even a B.C.V.S.A. sanitary sewer are all adjacent to
the subject annexation area. This availability will reduce the cost of extending
~~ the facilities into the property,. and thereby reduce deveJ_opment costs.
GOAL NO. 11 Public Facilities and Services
As previously referred to in Goal ;30. 10, all facilities: are available
adjacent to the subject property, and have been engineered to eventually provide
for this property.
Annexation will allow City fire and police protection.

GOAL N0. 12 Transportation
The subject property abuts Bursell Road, presently a County Road. Bursell
and Hopkins Roads are a part of Old Highway 99, and were constructed to meet
highway conditions. The surface of Old Highway 99 was a thick slab of concretes
which. is still in place with an overlay of asphalt. Jackson County .Public Works
Department has. assured us the potential traffic which might: be generated by
the development of this area will not exceed the design. standards,, or have an
adverse impaet upon the road.
Annexation eaill provide the City with the authority to control the street
design which might be developed upon the subject property, including a circulate.®n
pattern between Bursell Road .and Edella (a dead-end) Street...
GOAL N0. 13 Enemy Conservation
The development of the subject area will be energy efficient due to its.
proxemi ty to existing services .
Also, the general east-west direction of a proppsed street through the
.property will allow maximum utilization of solar considerations.
GOAL. N0. 14 Urbanization .
T'ne subject property is within the Urban Growth Boundary. Therefore the
governing bodies of Central Point and Jackson County haue recognized the land
as "urbanizable lands," and have classified it accordingly. The act_of including.
:this area within the Urban. Growth Boundary coeunits the area to urban development
. for the next 20 years...
The fact that it is contiguous with the. present City limits line provides
for the orderly transition from rural to urban land use.
