YOUNG AND MICHELLE ~~OUNG WITHOUT AN ELECTION, TO WITHDRAW SAID PROPERTY FROM FIRE DISTRICT NO. 3 AND BEAR CREEK. VALLEY SANITARY AUTHORITY AND TO REZONE THE SAD'!E FROM S-R-1 TO 'R-1-8 AND SETTING A DATE FOR PUBLIC HEARINGS THEREON WHEREAS, a petition has been filed with the City of Central Point requesting and consenting to the annexation of the following described parcel of real property contiguous to the City of Central Point, by the owners of said parcel, Ronald G. Young and Michelle Young, and WHEREAS, the Council elects, pursuant to ORS 222.150, to dispense. with an election in said annexation proceedings, and to withdraw said. property, if annexed, from Jackson County Fire District No. 3 and Bear Creek Valley Sanitary Authority, and WHEREAS, notices of hearing on the issues of annexation and withdrawal were. published once each week for two successive weeks prior to the date of hearing set forth hereinafter in the Medford Mail Tribune, a newspaper of general circulation in the City of Central Point, Oregon, with the second publication no less than 24 hours prior to said hearing date and notices of the. hearing were posted in four public places in the city for two successive weeks prior to the date of hearing, and WHEREAS, concurrently with the aforementioned petition for annexation, application has been made for change of zone from. county ,designation S-R-1 to R-1-8, and the Planning Commission having held hearing thereon and made findings approving said zone change, a report of said findings having been made to the City Page 1 -- Ordinance No. ~ ..~',.~' Council, and WHEREAS, notices of hearing on the issue of said zone change were published one each week for two successive weeks prior to the date of hearing set forth hereinafter in the. Medford Mail Tribune, a newspaper of general circulation in the City of Central Point, Oregon, with the second publication not less. than 24 hours prior to said hearing date, now, therefore., THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN A5 FOLLOWS: Section 1. Proceedings are hereby initiated for annexa- tion to the City of Central Point of a parcel of approximately 4.2 acres located in the vicinity of Bursell Road and Edella Avenue (J. C. Map Page 37-2W-11C, Tax Lot 6400), which parcel is more particularly described as follows:. Beginning at a 5/8" iron pin found for the northeast. corner of Lot Eighteen (18) in Block Six (6) of HOMESTEAD ACRES EXTENSION NO. 2 in Jackson County, Oregon, according to the official plat thereof, now of record; thence West, along the north line of said EXTENSION NO. 2, 519.14 feet to the Southeast corner of Lot 5, Block 4 of VALLEY ESTATES - UNIT NO. 3 in the City of Central Point, said County and State; thence North 0° 04' 40" West, 350.00 feet to the Southwest corner of Lot 7, Block 1, said UNIT N0. 3; thence along the south line of said Block 1, East, 519.14 feet to the west boundary of Bursell Road; thence along said west boundary, South 0° 04' 40" East, 350.00 feet to the point of beginning. Section 2. The public hearing on the question of annexa- tion of the above described parcel of real property to the City of Central Point and for withdrawing said property from Jackson County Fire Protection District No. 3 and Bear Creek Valley Sanitary Authority will be held at the regular meeting of the Central Page 2 - Ordinance No, j ~..~~ ~~ Point City Council on the 14th day of May, 1981 commencing at 7:00 p.m., at the Central Point City Hall, at which date, time and place all interested persons may appear to be heard on the question of said annexation and withdrawal. Section 3. The public hearing on the question of the zone change of the above described parcel of real property from S-R-1 to R-1-8 will be held at the regular meeting of the Central Point City Council on the 14th day of May, 1981 commencing at 7:00 p.m. at the Central Point City Hall, at which. time all interested persons may appear to be heard on the question of said zone change. Section 4. This ordinance being necessary for the immediate preservation of the public peace, health and safety of the City of Central. Point, Oregon, in order that the public hear- ing may commence on the date advertised, an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately.
